1) The exception to the rule of removing food from a pot while it is still on the fire is water, as water doesn't improve or boil better or faster due to mixing and thus may be removed with a ladle or a cup even while still on the fire.


Some Poskim (including Rav Moshe Feinstein Zatzal in Igros Moshe Orach Chaim Vol. 4 Siman 74:Bishul;14) are lenient as well with a pot of clear soup (which does not include any solids such as meat, vegetables or the like)

However, other Poskim are stringent even with soup and do not exclude any foods, besides plain water, from the prohibition of mixing. (Ruling of Rav Shlomo Zalmen Auerbach Zatzal quoted in Me'Or HaShabbos Vol. 2 letter 32:1)

2) If one needs to add [cooked] water to a pot of food that is cooking (e.g. a Cholent that is drying out and unless [hot] water [from the urn] is added it will become totally burnt) the water should be poured into the pot slowly and calmly, as if it is done fast and with a gush it will ultimately cause the food in the pot to become mixed via the stream of new water. (See Shmiras Shabbos K'Hilchasa Perek 1 footnote 42 quoting Rav Shlomo Zalmen Auerbach Zatzal. Maran Rav Yosef Shalom Elyashiv Shlita maintains that the best way to add this water is to remove the pot from the fire and take it to the urn to add the water and then to return the pot to the fire. See Orchos Shabbos Perek 1 footnote 196)

Can you give ma'aser from money that you don't have yet?

Meaning, I want to make a large check out to tzedakah from my year's salary, but, being that the year is not over yet, I did not receive all of my salary-checks yet.

Can I give ma'aser-money on money that I didn't earn yet, and it will be counted as ma'aser from that money?

Answer:


Yes, you may give Ma'aser retroactively on money that will be earned at a later date.

Bad things happen.

They happen to good people.



Contrary to common perception, bad things also happen to bad people. The difference is not so much in what happens, but in what happens to the person.



When bad things happen to bad people, they are confirmed in their badness. "We knew it all along," they say. "The world is a bad place. The only way to get anywhere in life is by being badder than all the other baddies."

When something bad happens to a good person, it makes him or her a better person.



Trust in G-d is a great virtue. The Talmud and other sources of Jewish lore are full of shining examples of men and women whose faith in G-d and their trust in His salvation never wavered, even in the most trying of circumstances.


But, said the founder of Chassidism, Rabbi Israel Baal Shem Tov, there are times when it is forbidden to trust in G-d.



Trust in G-d, said the Baal Shem Tov, is a great virtue when applied to one's own life. But to resort to trust in G-d in matters concerning others' lives is a grave sin. If you hear of a fellow in need and you say "G-d will provide," if your reaction to your neighbor's difficulties is "G-d will help," you're not being pious. You are simply shirking your responsibility toward your fellow man.


The same double standard applies to taking a "philosophical view" on pain and suffering. To justify another person's suffering, to see something positive and gainful in another's pain, is callous, cruel and plain wrong. Unless you are a prophet (in which case G-d might appear to you and say, "Go to so-and-so and tell him that such-and-such happened, or will happen, because he did this-and-that"), you have no business explaining other people's lives. Or defending G-d's way of running His world (He doesn't need your help).


But that's exactly what a good person does regarding his or her own troubles. When something bad happens to him, he says: "Where did I go wrong?" She says: "Someone is trying to tell me something. What might that be? What can I learn from this?" He says: "Now I can appreciate the value of health and prosperity. Now I understand what so-and-so was going through."


A good person who lived 850 years ago put it thus: "To say, 'This is just how the world runs, and this trouble happened to happen,' is an act of cruelty, for it causes a person to persist in his negative ways... [rather,] it should serve to rouse the heart and open pathways of return to G-d" (Rambam).

1) A pot which contains in it food that is totally cooked, according to some Rishonim may still not be mixed with a spoon or another utensil, as long as it is still on the fire or another heat source.(See Mishna Berura Siman 318:113 quoting the Elya Raba and the Sha’ar HaTziyun Os 136 where he quotes the Mogen Avraham that this is the opinion of the Kol Bo who rules that doing so is a biblical prohibition)
Most contemporary Poskim are stringent with this and indeed prohibit mixing any food even if it is fully cooked, while it is still on the fire.
Likewise, fully cooked food should not be removed from the pot while the pot is still on the fire or other heat source.
Once the pot with the fully cooked food has been removed from the fire or other heat source there is no prohibition of removing its contents, according to all Poskim ( See Mishna Berura Siman 318:117. Regarding actual mixing of this fully cooked food, the Mishna Berura writes that if one wants to be stringent he may be, but regarding removing food from such a pot there is no room at all for being stringent.)
Some Poskim rule that if the pot was on a blech and it was removed from right above the fire to a different place on the blech (even to a place where it can reach Yad Soledes Bo), as long as it is fully cooked some food may be removed with a spoon. (See Igros Moshe Orach Chaim Vol. 4 Siman 74:Bishul;13. This leniency does not apply to a hot plate, which is considered a heat source.)
2)The prohibition of removing food while it is still on the fire applies only to liquid foods that can be mixed and not to dry foods.
Thus it is permitted to cut a piece of Kugel or similar food from a pan that is on the fire or other heat source, as doing so will not affect the rest of the food in the pan in any way. (Ruling of Rav Shlomo Zalmen Auerbach Zatzal and YBL"T Maran Rav Yosef Shalom Elyashiv shlita, quoted in Me’Or HaShabbos Vol. 2 Letter 19:2)

Reader’s Question:

When giving Ma’aser by check in Eretz Yisrael -where the check is usually changed at a money changer who takes about 1.5% -do you need to add that amount to the check so that the recipient will get the full ma’aser? (My earning go to an American account and I live in Eretz Yisroel).


Answer:





If the check can be deposited in a bank and thus be redeemed for the full amount, you have satisfied your obligation. The fact that the recipient may use an alternate method to cash the check, and thus lose a percentage is the recipient’s choice, and not your concern.

1)A pot which contains in it food that is not yet totally cooked may not be mixed with a spoon or another utensil, as doing so causes the food to cook quicker; this is a biblical prohibition. (See Shulchan Aruch Siman 318:18 and Mishna Berura S"K 114)
Even if the pot is no longer on the fire or other heat source, so long as the contents are Yad Soledes Bo, the biblical prohibition of mixing is in place. (See Bais Yosef end of Siman 318 Dibur Hamaschil Kasav HaRan)

2)Furthermore, not only may the aforementioned food not be mixed [for the purpose of mixing], it is similarly forbidden to remove any of the food from the pot as by inserting a spoon or ladle into the pot to remove some food it will inevitably be mixed; this additional prohibition is rabbinical in nature. (See Mishna Berura Siman 318:117)

This too applies so long as the contents of the pot are Yad Soledes Bo, even if the pot has been removed from the fire or heat source. (Shulchan Aruch ibid.)

Reader's Question:

The Aruch Hashulchan writes that saying "Pitum Haketores" by mincha is a minhag yafeh (proper custom).

Ever since I saw that, I have been saying the parsha of pitum haktores before mincha, although I daven nusach ashkenaz.

Is there any problem with saying it and why if the aruch hashulchan says it is a minhag yafeh do we not find nusach ashkenaz people saying pitum haktores before mincha.

I was always told that we dont say it by shacharis before aleinu becasue we may rush through it and it states, im Chisar achas mekol.......chayav misa.

Would this same theory apply to mincha?

I dont know if people are as rushed by mincha as they are by shacharis in morning rushing off to work.

Answer:



Many people I know that daven Ashknaz do in fact say it, and certain Ashkenaz siddurim do in fact have it.

It is possible that the reason for many not saying it is indeed the same reason as by shacharis, as many people will rush by Mincha as well.

There is nothing wrong with saying Pitum Haketores before Mincha, even if you normally daven Nusach Ashkenaz (as the Aruch Hashulchan did!).

1)A very common practice in most Jewish homes on Friday nights is using a ladle to dish chicken soup into bowls.


The Pot in which the chicken soup was cooked is a Kli Rison.


The question is what status the ladle has?


Do we view the ladle as a Kli Sheini, and thus the bowl from which the soup is being eaten would be a Kli Shlishi.


Or do we say that since the ladle was submerged in the Kli Rishon it assumes the status of that Kli Rishon and thus the bowl from which the soup is being eaten would only be a Kli Sheini.


This makes a big difference, as Challah, baked croutons, raw spices and other non cooked items may not be added to a Kli Sheini.



2)The prevalent Psak is as follows:


If the ladle was sitting in the pot for a long time, or if it was submerged in succession a lot of times, all Poskim rule that it assumes the status of the Kli Rishon and all the Halachos of a Kli Rishon apply to it, and the soup that was transferred via this ladle to a bowl is only a Kli Sheini. (See Mishna Berura Siman 318:87)


If, however, the ladle was not sitting in the pot at all and was simply used to dish out the soup and then removed from the pot, regarding bread and baked croutons, we are lenient and give it the status of a Kli Sheini, and thus the bowl from which the soup is being eaten would be a Kli Shlishi and they can be added. (Shu"t Minchas Yitzchak Vol. 5 Siman 127:3 quoted in "The Shabbos Kitchen" by Rav Simcha Bunim Cohen Shlita page 36 footnote 38)


However, regarding raw spices we are stringent and give it the status of a Kli Rishon, and thus the bowl is only a Kli Sheini and no raw spices may be added until the soup is further transferred into another bowl, a Kli Shlishi. (ibid.)

What if someone wanted to give Tzedakah to a certain organization but before they were able to the organization shut down? Or they saw an ad online [and wanted to give to it] and can't find it anymore and forgot the name [of the organization]?


Answer:



According to the Shulchan Aruch one cannot make a Neder (promise) in his mind. The Rama argues and maintains thata Neder can be made in your mind. (Yoreh Deah Siman 259:13)

The above is only if it was a real promise to give. One who merely thinks about giving Tzedaka, but doesnt make up his/her mind to actually give isn't considered a real pledge according to everyone.(Aruch HaShulchan Siman 258)


The Chazon Ish ruled that one who made up his mind to give Tzedaka to a certain poor person who was collecting, and then the poor person disappeared (similar to your case of the organization closing down) you can give the money to a different poor person (or in your case a similar institution)


The best thing to do always when pledging Tzedaka is to say it's "Bli Neder", thus if you run into issues you will not have a promise to deal with. (Psak of Rav Shlomo Zalmen Auerbach Zatzal)

1)The reason that food in a Kli Sheini does not cook is because the cold walls of the second utensil cools off the food and it is no longer getting hotter or retaining its heat enough to effectively cook something else.



Based on the above logic, some Poskim (including the Mogen Avraham) thus rule that a "Davar Gush, a solid food" such as a piece of meat or a potato that is transferred from a Kli Rishon to a Kli Sheini still retains its status in the new utensil as a food in a Kli Rishon so long as it is above Yad Soledes Bo. (See Mishna Berura Siman 318:65)

The reasoning is that solid food doesn't come in contact with the walls of the Kli Sheini for it to effectively begin cooling it and furthermore a solid food retains its heat for a much longer period of time than a liquefied food.

A Davar Gush is Mevashel, even in a Kli Shlishi and beyond, as long as it is Yad Soledes Bo. (See Mishna Berura Siman 447:24)

It is best to be stringent with this and avoid adding uncooked spices or butter onto a potato or placing Ketchup onto a hot piece of meat, even when it's already in a Kli Sheini. (See Shmiras Shabbos K'Hilchasa Perek 1:58. See footnote 173* regarding table salt)

2) Some Poskim go so far as to rule that one must be careful to avoid placing a Davar Gush (such as a piece of hot Kugel) and a non cooked juicy food (such as Cole slaw, pickles or similar salads or side dishes)in the same plate where the liquid will ultimately touch the hot Davar Gush and become cooked. (Maran Rav Yosef Shalom Elyashiv Shlita, Rav Shmuel Wosner Shlita and YB"L Rav Yisroel Yaakov Fisher Zatzal rule this way as quoted in Sefer Me'Or HaShabbos Vol. 1 page 263)

Other Poskim (including Rav Shlomo Zalmen Auerbach Zatzal) are lenient with this. (See Me'Or HaShabbos ibid. for the reasoning behind this leniency)

Is one allowed to eat in a home of a family member who thinks he/she is frum {religious}and I know for a fact they do not necessarily tovel all of
their utensils (and even if they said they did, they had left a sticker on the utensil si the Tevilah wasnt valid)?

It's a close relative, so we kind of don't have a choice sometimes.


Answer:



Well, if you are not 100% sure that the food you will be eating in this home is 100% Kosher according to your standards, you may not eat the food.

Regarding the utensils, if they havent been toveled, you may not eat off of them. You must either use paper dishes, or lift the food (if it's kosher of course) off the plate and eat it from your hands.


When it comes to doing what Halacha mandates, we can not say "we have no choice" and must follow the guidelines of the Torah, even at the expense of feeling embarrassed or uncomfortable etc.


It woud be best to tactfully try and explain to them the basic halachic requirements of Tevilas Keilim etc. in the hopes that they will be willing to learn and change.

Of course, a Rav should be consulted in each situation, as every specific variable can have an impact on a Psak.

Rabbeinu Bechayeh writes in חובת הלבבות: The definition of bitachon is complete peace of mind, when one is fully calm, knowing that he could rely and trust in Hashem.



When a person will contemplate how Hashem loves him, cares for him, is able to fill his needs, and knows what is best for him.



As well as He is the only one who controls his life and always does good even to those who are undeserving - he will then feel full bitachon in Hashem.



Such trust can only be found in Hashem, for everything else (benefactors or money) can fail or discontinue.

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH





Halachos for Erev Shabbos Kodesh



1)A utensil that contains in it a raw food or drink may be placed into a Kli Sheini containing hot water (or other liquid) for the purpose of warming up the raw food or drink, as Chazal did not prohibit this in the Gezeira of "Mechzi K'Mevashel".


Thus, for example, a baby's bottle which contains cold water may be immersed in a bowl of hot water, as long as it's a Kli Sheini and as long as part of the bottle is not under water(as then we may have a problem of Hatmana, covering, a Melacha which we shall B'Ezras Hashem discuss in due time)


2)A liquid food which was cooked and then became totally cold again, may be placed in a Kli Sheini; here too it isn't subject to the Gezeira of mechzi K'Mevashel. (Mishna Berura Siman 318:23. See also Shu" t Minchas Shlomo Vol. 2 Siman 33:22 for more discussion about this.)



Halachos for Shabbos Kodesh


1)It is worthwhile to know that there is an opinion of the Chayei Adam (quoted in the Mishna Berura Siman 318:48) that although there is no Bishul in a Kli Sheini that is Yad Soledes Bo (besides for Kalei HaBishul), if the contents of the Kli Sheini are so hot that they are considered "Hayad Nichvis Bo, the hand will be burned by even a slight touch" then it can cook even in a Kli Sheini.


This stringency is not mentioned in any of the Rishonim or Poskim before the Chayei Adam, and thus most Poskim including the Mishna Berura do not follow this stringency.




2)However, the Chazon Ish (Orach Chaim Siman 52:19) suggests being stringent with this and some scrupulous people are careful to avoid adding anything into a hot Kli Sheini as it is difficult to differentiate between the hotter temperature of "Yad Nichvis Bo" and the lower temperature of "Yad Soledes Bo"


This stringency does not apply to a Kli Shlishi, even according to the Chazon Ish. (ibid.)

Correction: In yesterday's halachos I inadvertently omitted a word in the following halacha which caused the halacha to be understood incorrectly. It should be read as follows:



Likewise, placing a raw lemon into a glass of hot tea, which is in a Kli Shlishi, is also permitted as it is evident that the purpose of the lemon is to enhance the flavor of the tea and NOT to become a "cooked lemon".

I heard that one is not allowed to eat while your outside in the market place (i.e. in public). Is this also referring to being on a train and eating (like a sandwich)?


Answer:



The Talmud (Kiddushin 40b) says that one who "eats in the street" is compared to a dog. Another opinion in the Gemara says that one who "eats in the street" is disqualified from giving testimony in a Jewish court of law. The Halacha (brought in Shulchan Aruch Choshen Mishpat Siman 34:18) is like the second opinion.


The reason for this is that one who eats in the street is lacking basic human dignity.


The commentaries debate exactly what constitutes "eating " and what exactly constitutes "in the street"


Obviously, a place designated for eating such as a picnic area in a public park or a "food court" in a mall, although public, isn't subject to this Halacha.


Also, food which is common to eat in the street, such as chewing gum or sucking a candy, is permissible. (Loudly making bubbles with buble gums however, can be a problem in public)


Also, walking down the street wolfing down a piece of pizza, or sitting on a train eating a burger, fries and a large coke would also be undignified.


Each person must determine his/her own limitations based on their particular circumstance to decide if what they are doing is dignified and befitting for the child of Hashem, which we, as Jews, are and we must always act accordingly.


When in doubt, a Rav should be consulted.

How important is it for a person to eat vegetables in their daily diet?


Answer by HaRav Avigdor Miller Zatzal:



When we make Borei Pri Ha'adama, we have to know, we're thanking Hakadosh Baruch Hu for one of the very great benefits and happiness of life. And I want to concentrate on onions and potatoes.



When you pass a restaurant and on the side you see big sacks full of onions and potatoes, you're seeing something that's a Chesed Hashem. What's more tasty than potatoes fried in onions? Borei Pri Ha'adama, Hakadosh Baruch Hu wants to make us happy. Now He could have given us nothing but plain bread and that's all. NO, Hakadosh Baruch Hu gives us all kinds of tastes, every vegetable has a different taste. He even gives us red onions too, sometimes.

All kinds of apples, fruits of different tastes, Hakadosh Baruch Hu is Chesed. Not only He wants to give us life, Mechalkel Chaim, not only He supplies for the living, but B'chesed, He gives it with Chesed, too. So when He gives us our food, not only does He give us food, He gives it B'chain, B'chesed U'vrachamim.



So we say, Hakadosh Baruch Hu, why are you doing all this? For one purpose, Ba'avur Shmo Hagadol, we should recognize Your Great Name. So if you eat something that you like, don't just swallow it down and forget about it, you have to pay for it, besides the Brocho, recognize His Great Name.



So let's say your wife serves you mixed vegetables, look in the mixture and count, oh, here's sugar corn, there's green peas, there's string beans, there's onions, count each separate, you'll find six different kinds. Oh, six different kinds of taste? You have to be grateful to Hakadosh Baruch Hu six times as much, and the purpose is, Ba'avur Shmo Hagadol, to recognize His Great Name.



It's important to eat vegetables in order to recognize the Chesed Hashem. Of course each vegetable contributes something to your health, but that's for experts to tell you exactly which, but there is no question, when a person eats the Pri Ha'adamah and also the Pri Ha'eitz he can become very great in Emunah, because you see the miracles.

Why is it that the vegetables before they're ripe, is not beneficial for you? only when they're ripe is good for you to eat them? You know why that is? So you'll say, well, if it's not ripe it will harm your stomach, it will make you sick to eat them. You know, when the apple becomes ripe it's a sign that the seeds inside are fit to germinate. The seeds inside don't become right enough to plant until the apple is sweet enough to eat. So as you eat the apple and spit out the seed, let's say you're eating in the garden, you spit out the seed, now the seeds are ripe enough to grow. But had the apple been sweet before the seeds were ripe, you spit out green seeds, nothing would grow. So Hashem said No, it's going to be synchronization, simultaneous, the sweetness of the apple, it's ripeness and the softness takes place at the same time that the seeds become ripe.

And so you'll do both things, you'll eat the apple and then when you finish eating, inside is a coupon that entitles you to another one. That's the seeds, and spit out the seeds, another apple tree will grow.

1)Although we learned that there is no biblical prohibition of Bishul in a Kli Sheini (besides for items that are Kalei HaBishul), still Chazal enacted a Gezeira (edict) and prohibited placing most raw foods into a Kli Sheini which is Yad Soledes Bo, as it is "Mechzi K'Mevashel. Looks like cooking" (see Mishna Berura Siman 318:34)



The exception to this rule is spices, which may be added to a Kli Sheini, even if they have not been previously cooked, as their purpose is to enhance the flavor of the food in the Kli Sheini and not to cook the spices. (Mishna Berura ibid.)

Likewise, placing a raw lemon into a glass of hot tea, which is in a Kli Shlishi, is also permitted as it is evident that the purpose of the lemon is to enhance the flavor of the tea and to become a "cooked lemon". (See Chazon Ish Orach Chaim Siman 52:19)

Another exception is adding cold water to a Kli Sheini of hot liquid; here too Chazal did not consider it "Mechzi K'Mevashel".(See Pri Megadim, Aishel Avraham, Siman 318:32)



2) This Gezeira of "Mechzi K'Mevashel" does not apply once the item is in a Kli Shlishi and thus any raw foods, with the possible exception of Kalei HaBishul, may be placed in a Kli Shlishi. (Although according to the Chazon Ish ibid. there is no difference between a Kli Sheini and Kli Shlishi which are Yad Soledes Bo regarding Kalei HaBishul, still the Poskim say that in regard to the Gezeira of Mechzi K'Mevashel, even the Chazon Ish would agree that the Gezeira was not intended for a Kli Shlishi)

If I am already chewing on a piece of gum and I later put another piece in my mouth for taste, do I make another brocha?


Answer:



No, as long as the item you made the original Bracha on is still being eaten, no new Bracha is recited on another of the same food of that Bracha, be it another piece of gum or another similar SheHakol.


If it is a totally different item, however, from the original item(such as gum and chicken), then another Bracha is required unless you specifically had in mind at the time of the Bracha that you would also be eating the new item.

Hashem is always blessing u with his bounty. Indeed, Hashems love for us - his children, is called 'Ahava She'eino Teluyah B'davar' - 'An uncoditional love'.

However, most of the time we do not appreciate these blessings since we have grown accustomed to them. For this reason, the Yetzer Hara - our Evil Inclination, need not busy himself with stealing the limelight and claiming attribution for these blessings which we do not fully appreciate anyway.



However, when it comes to our pursuit of all forms of pleasure and enjoyment, here the Yetzer Hara must aggressively assert himself and claim rights (to) and attribution for these pursuits. This is because the elation, pleasure and enjoyment from (joyful) pursuits, are and should be an inherently spiritual feeling and experience.

The Mesilas Yesharim tells us in his opening paragraph to his acclaimed sefer - that our purpose on this Earth and the purpose of our creation, is to derive pleasure from our service of Hashem Yisborach! It is a big misconception for us to think that being Jewish requires any type of nullification from deriving pleasure in this world and/or requires that we engage in any form of self flagellation.

Hakadosh Baruch wants us to enjoy life!



It is for this purpose that he created us in the first place and it is the purpose of our existence on this Earth. Hashem is constantly showering us with his blessings and bounty and we are suppossed to find enjoyment in these blessings and to express appreciation to him for these brachos.

It is also for this reason that the Yetzer Hara works so hard to steal away our ability to channel our enjoyments towards spiritual pursuits and accomplishments. Insted, he would like us to run after the mundane and lowly enjoyments that rip us away from our creator and seeks to lay claim to these enjoyments as the defining purpose of our existence.

We can find unlimited spiritual enjoyment and pleasure in our learning of Torah, doing mitzvos and connecting to Hashem through the powr of Tefiloh-Prayer.

The Rambam writes in his letter to his Son regarding th Tefilos on Rosh Hashana, that "when a Jew closes his eyes in Prayer and supplication before Hashem and talks to him, he experiences an enjoyment the likes of which cannot be rivaled in any other way!"

1)It is permitted to add cold milk which has been pasteurized into a Kli Sheini containing hot liquid above Yad Soledes Bo as their pasteurization is considered cooking and thus they are like any other cooked liquid which may be added to a Kli Sheini containing hot liquid. (See Mishna Berura Siman 318:31 and Shmiras Shabbos K'Hilchasa Perek 1:55 and footnote 157)





2) Freshly ground coffee beans which have not been processed at all may not be added to hot water on Shabbos, even in a Kli Shlishi or higher as long as the water is Yad Soledes Bo. (Chazon Ish Siman 52:19. See also Shmiras Shabbos K'Hilchasa Perek 1:57)

Instant coffee, however, (as well as instant tea and sugar) which has been cooked during its processing, may be added to hot water in a Kli Sheini, according to many Poskim. (Rav Shlomo Zalmen Auerbach Zatzal ruled this way as quoted in Sefer MeOr HaShabbos Vol. 3 42:2. Many other Poskim rule this way as well based on the Mishna Berura Siman 318:71)

However, some Poskim require a Kli Shlishi for instant coffee, as although it is cooked, it undergoes an additional dry heat process which will give it a status of baked, and thus due to problems of Yesh Bishul Achar Afiyah, placing it in a Kli Sheini will be problematic. (Maran Rav Yosef Shalom Elyashiv Shlita rules to be stringent with this if possible; ibid footnote 76. See also Igros Moshe Orach Chaim Vol. 4 Siman 74; Bishul 15, Shu"t Minchas Yitzchok Vol. 1 Siman 55 and Shu"t Be'er Moshe Vol. 2 Siman 21)

One thing I always get confused with- Sometimes it happens that my obligations to wash netilas yadayim after going to the bathroom and to wash netilas yadayim for hamotzi coincide.

What is the correct process?

Do I wash my hands once or twice?

Do I say Asher Yatzar first or al netilas yadayim first?


Answer:



There are a few different options regarding one who uses the bathroom and now wants to wash for bread.


The Shulchan Aruch (Siman 165:1) rules that the hands should be washed, Asher Yatzar recited and then the hands washed again and Al Netilas Yadayim recited. The Mishna Berura explains the reasoning of the Shulchan Aruch as follows: If the hands are washed only once, if Asher Yatzar is recited first followed immediately by Al netilas Yadayim, it will be a Hefsek between the washing and the Al Netilas Yadayim. If Al Netilas Yadayim is said first and Asher yatzar said immediately afterwards, it will be aHefsek between the Al Netilas Yadayim and the Hamotzi on the bread.


To say Al Netilas Yadayim, say Hamotzi and eat the bread and then say Asher Yatzar is also not proper, as Asher Yatzar should ideally be said immediately after exiting the restroom and washing the hands.


The Mishna Berura quotes some Poskim (including the Mogen Avraham) who say that the best thing is to wash the hands after the bathroom in a way that the washing will not be acceptable for eating bread (e.g. less than a revi'is, without a utensil etc.) and to recite Asher Yatzar and then to wash again a valid washing and recite Al Netilas Yadayim. This option is the most commonly accepted option amongst contemporary Poskim, as doing so avoids all the problems of Hefsek and also satisfies the opinion of the Shulchan Aruch. (See Halichos Shlomo, Tefilah, Perek 20:26)


The Mishna Berura then quotes other Poskim that maintain that saying Asher Yatzar between Al Netilas Yadayim and hamotzi is not a hefsek, and thus if one already washed a valid washing upon exiting the restroom he can B'dieved say Al Netilas Yadayim followed by Asher Yatzar followed by Hamotzi.

1)"Kalei HaBishul, things which are easily cooked" are different than other items in that they can be cooked even in a Kli Sheini as long as it is Yad Soledes Bo.



There is a lot of discussion amongst the Poskim as to which foods fall under this category.

The Mishna (Shabbos 145b) lists a few foods that fall under this category.

Some Poskim maintain that any food which aren't specifically excluded in the Talmud from being Kalei HaBishul, can indeed be considered Kalei HaBishul (Opinion of the Mogen Avraham Siman 318:18 and Mishna Berura Siman 318:42. See also Bais Yosef Siman 318 quoting the Sefer Yereim)

Other Poskim maintain that only foods which are obvious that they are easily cooked (such as in the case of putting bread into hot soup or eggs which are known to boil even in a Kli Sheini or pouring hot water on tea leaves), are considered Kalei HaBishul but otherwise there is no need to treat any other foods as such. (Chazon Ish Orach Chaim Siman 52:19)

2) Some Poskim rule that Kalei HaBishul may be placed into a Kli Shlishi, as only up to Kli Sheini, as well as Irui from a Kli Sheini directly onto them will cook them.

However, many Poskim including the Chazon Ish maintains that Kalei HaBishul will get cooked even in a kli Shlishi and higher (i.e. Kli Revi'i, a fourth utensil , Kli Chamishi, fifth utensil etc. as long as the water is Yad Soledes Bo) and thus placing a food which is determined to be a Kalei HaBishul into a Kli Shlishi is a prohibition of Bishul.

According to this, it would be prohibited to use tea bags on Shabbos even in a Kli Shlishi and higher. (This is indeed the Psak of the Mishna Berura Siman 318:39 where he sternly rebukes those who use tea bags, the Aruch HaShulchan Siman 318:28, the Chazon Ish ibid., and many contemporary Poskim. Although Rav Moshe Feinstein Zatzal in Igros Moshe Orach Chaim Vol. 4 Siman 74; Bishul 15 rules that tea bags in a Kli Shlishi are not a prohibition of Bishul, he writes that he himself is stringent. Also in Igros Moshe Orach Chaim Vol. 2 Siman 85 he writes to avoid tea bags and make tea essence before Shabbos as per the ruling of the Mishna Berura. See also "The Shabbos Kitchen" by Rav Simcha Bunim Cohen Shlita page 33 where he rules stringently and prohibits using tea bags altogether, even in a Kli Shlishi or higher.)

A while ago you answered questions regarding Netilas Yadayim, and one of the things mentioned was that hands must be dry before washing.

While I have always learned this to be so, someone challenged this stating that it's a chumra (stringency) and not the halacha- can you please clarify this for me?


Answer:


Technically it may be considered a "chumrah". Let me explain:


The Chofetz Chaim indeed Paskens that wet hands is not a problem at all (Biur Halacha Siman 162:2)

Other Poskim, including the Chazon Ish (Orach Chaim Siman 24:20), maintain that one whose hands are wet before washing is not Yotzei, possibly even not B'Dieved.

Therefore, the custom of scrupulous people is to be "Machmir" with this and to make sure the hands are totally dry before washing.

See also K'tzos HaShulchan from Rav Chaim Na'eh Zatzal Siman 33:13 where he states that it is praiseworthy to be makpid on this.

Chizuk For Today:




I was going in for my fifth c-section and I was terrified! I imagined all the worst incidences in all past four c-sections amplified and rolled into my upcoming operation. I decided to phone Susan, a good friend of mine who was also a repeated c-section case for her support.



Susan had been through a lot, and thus was able to see things in perspective and offer sage advice. In fact, after her second c-section she was diagnosed with stage 4 cancer. Baruch Hashem, after much prayer, and a year of heart wrenching treatment she was proclaimed cancer free. Unfortunately though, the drugs that they had used were so strong, that she was told that there was only a 10% chance that she would be able to become pregnant again.





After she had given me the necessary support she asked me "So what are you going to do with the pain?"

I wasn't quite sure what she was referring to... "I guess grin and bear it" I replied

"No", she answered, "Please pray for me. Each time there is pain please pray that Hashem will give me more children."

I was quite taken aback at her request. "Who I am to pray for this woman? I am just little old me?"

But then I heard her words echoing in my head "There is nothing to do with the pain, its going to be there anyway. So you might as well use it for something worthwhile..."

And so it was. Throughout the surgery and recovery period, each time there was pain, I pleaded that Hashem should allow her miraculously to have more children.

And yes, 2 weeks after the circumcision of my son, she was pregnant!

Just before her third c-section, Susan phoned me for support.

"What about the pain?" she asked, "I am so nervous about it".

"Susan," I replied "why not find someone to pray for each time there is pain. You and I both know that it's going to be there anyway, so you might as well use it for something positive."

"But who am I?" Susan retorted, "I am not anyone grand - I'm just little old me"

While Susan was in treatment for her cancer, she had met a woman named Sarah who also was diagnosed with end stages cancer. Baruch Hashem, Sarah had survived, but she was told that due to the strength of the drugs, that already in her late 20's she had started to go into premature menopause, and therefore would never be able to have more children.

And so it was. Throughout her c-section and recovery period, Susan, prayed with all her might that Sarah should be able to have children.

Two weeks after Susan's son's circumcision Sarah was miraculously pregnant!

Yes, Hashem listens to even "little old me"... You don't have to be great for Hashem to listen to your pleas...

1)Before we continue, we will review and clarify a few things as I am receiving a lot of questions regarding the following definitions and their status:

Kli Rishon, the First utensil: This is the actual pot or pan in which the food was cooked. As long as the contents of a Kli Rishon are hotter than Yad Soledes Bo, even after it has been removed from the fire or other heat source it is able to cook other [uncooked] items and doing so is a biblical prohibition of Bishul.

Kli Sheini, the second utensil: This is the utensil into which the contents of a Kli Rishon have been transferred. Once the hot food is in a Kli Sheini, even though the food is still boiling hot beyond Yad Soledes Bo, it can no longer cook most other items.

2) Irui Kli Rishon, pouring from a Kli Rishon: If the item from the Kli Rishon which was just on the fire or other heat source was poured directly into the kli Sheini, according to the Chazon Ish and other Poskim, it retains its status as a Kli Rishon even in the second utensil, as the stream of hot liquid from one utensil to the next is considered a "connection". (See Pri Megadim, Aishel Avraham Siman 318:33, Shu"t Minchas Yitzchak Vol. 4 Siman 46 and Shmiras Shabbos K'Hilchasa Perek 1 footnote 122. Many Poskim are stringent with this and thus for example when making a tea on Shabbos require the water that went from the urn into the first cup to be poured into a second cup as they consider the first cup a Kli Rishon.)

Irui Kli Sheini, pouring from a Kli Sheini: If the item from a Kli Sheini was poured into a Kli Shlishi, the prevalent ruling is to give it the status of Kli Shlishi. However, hot water above Yad Soledes Bo in a Kli Sheini should not be poured directly over items that require hot water in order to be consumed, such as a raw egg and tea leaves.(See Mishna Berura siman 318:35 and Shmiras Shabbos K'Hilchasa Perek 1:57)

My question is about standing at "Baruch Hash-m L'olom" at Maariv. My father always got up for this. I see a few others in shul who do as well. I believe I once saw in Sefer Tefillah b'tzibur - that there is a minhag to stand but not face mizrach. this shows that it is NOT in place of shemonah esreh. What are your commentts please?


Answer:




The Rama (Siman 236:2) says that it is a good mihag to stand when saying "Baruch Hashem L'Olam". The Mishna Berura However brings from many Achronim that it is best not to stand.


Many people, including your father, followed the Rama and many people follow the Mishna Berurah, that is why you say varying customs for this by different people.

Even if saying it standing, you should not keep your feet together or face the wall, so it shouldn't seem like you are davening Shemona Esrei

What is the Segula for getting married? Segula means, what is some means, some mysterious means of getting married?





Answer by HaRav Avigdor Miller Zatzal:





The most mysterious means of getting married is, to pray to Hakadosh Baruch Hu, that's also a Segula, it's a mystery how it works. Everybody has to pray to Hakadosh Baruch Hu before marriage, because it's something that's going to affect you and your generations. If you're going to marry a girl who doesn't want to have many children, and therefore you're going to have just a little family of maybe two. Some day you'll look around, you'll see - others have families of children and grandchildren and great grandchildren, and you see a Nachas, you see how many Frum Jews resulted from that little marriage years ago.

Remember that poor little marriage in a hall years ago, and look what happened, so many Bnei Torah, so many beautiful boys and girls all Frum. Isn't it a tragedy that because of a silly girl who got into her head, she didn't want to have more than two babies, so therefore you're deprived of all this greatness? You have to pray, Hakadosh Baruch Hu should send the right boy or send the right girl, and pray all you can. You have to pray all you can, and I want to add an advice, it wouldn't hurt, wouldn't harm to shed a tear or two while you're praying. Pray and shed a tear to Hakadosh Baruch Hu, He should send the right one. That's the best Segula of all.

However if you want additional Segulas, girls: If you have to see a boy, the first time or second time, whatever it is, don't make the mistake of fumbling, of spurning the occasion; go to a beauty parlor. I once said that to a Frum girl, and she said, do you mean to say that a real Ben Torah would look at such things? Isn't that silly, certainly a Ben Torah will look at such things. It's as unrealistic as could be; every girl has to prepare for the first encounter. You have to use everything you have, and even what you don't have. That's a Torahdika attitude, a woman has to utilize all the means that she can get, to win the right man. And again I'll add one more thing; and to keep the right man.

All her life, a wife has to make herself beautiful for her husband, not for the street. It's not only a waste of effort, but it's not a Mitzvah at all for a woman to go out pretty in the street. She's not supposed to be seen by other people when she is pretty. So in the street, as plain as possible, don't advertise your femininity on the street. Don't flaunt your femininity on the street. But at home, your husband has to see a beautiful wife at all times, even if you're an old woman. Don't think an old Talmid Chochom, an old Tzadik doesn't care for these things.

And what you hear is solid good advice, and you'll discover it when you're eighty five.

1)We learned that after the onset of Shabbos, nothing may be done to a food that is not totally cooked which will facilitate its cooking faster.

This includes even a food which is mostly cooked yet contains only one ingredient which is not fully cooked.

A common example of this is a Cholent or other food that contains within it chicken bones [or certain meat bones], which many people enjoy eating and/or sucking out the marrow.

Although the majority of the Cholent is already cooked, it takes a much longer time for the bones to become fully cooked to the point that they and/or their marrow are sufficiently soft for consumption.

According to some Poskim (including Rav Shlomo Zalmen Auerbach Zatzal in Shu"t Minchas Shlomo Vol. 1 Siman 6) as long as the bones are not fully cooked the entire Cholent is considered "not fully cooked" and it is subject to the prohibitions of Bishul.

This Psak is followed by people in Eretz Yisroel where it is considered more common to eat bones.

2)Other Poskim, however, are more lenient and don't consider bones edible, even though there are people who eat them, and thus would consider the Cholent "fully cooked" as long as all the other ingredients are cooked, even though the bones are not yet sufficiently soft. (See Igros Moshe Orach Chaim Vol. 4 Siman 76 and 77 where he is lenient for Americans but says that those in Eretz Yisroel or anywhere else where the majority of people consider bones a food need to be stringent and follow Rav Shlomo Zalmen's Psak. Rav Nisim Karelitz Shlita also rules similarly, that for individuals that eat the bones it is considered a food and for individuals who don't eat bones it is not considered a food; he doesn't differentiate based on the majority in the country rather based on each individual.)

For Halacha L'ma'aseh, of course, each individual should follow the Psak of their own Rav.

Not that I consider myself worthy but the latest current events have got me thinking......when one is chosen to die Al Kidush Hashem and has time to prepare themselves what should they do, say etc?


Answer:




More important than preparing to die Al Kiddush Hashem, is "living" Al Kiddush Hashem.



We are all here on this earth to be Mekadesh Shem Shamayim each and every day through our actions.



You are a Jew. A child of Hashem. People look at you and observe your every move. make sure your every move reflects the will of Hashem.



Dress appropriately.



Talk appropriately.



Daven appropriately.



Act appropriately. etc.



One who lives Al Kiddush Hashem, will always be ready to die Al Kiddush Hashem no matter when/if that time comes in their life.

The Great Miracle of the Volcano Shutdown

A universal crisis, millions of people stranded, billions of dollars lost, and one volcanic eruption in Iceland causes chaos across the European continent. Within all this tumult, one Jew merits a smile of loveliness from the Creator of the World, as if whispering to him - my son, the whole world was not created except for you כל העולם לא נברא אלא בשבילי.

The story begins with a young Yeshiva student, an 18 year old Yerushalmi, that came down with a fulminate hepatic failure and was mortally ill.

With little hope of receiving a liver transplant in Israel, Rav Firer sought to send the boy on an emergency flight to Brussels, the world center of liver transplants. The only problem however, is that Brussels under no circumstances transplants non-EU patients in order to save the scanty supply of livers for Europeans. Nevertheless, it was decided to send him to Brussels despite the full knowledge of negligible chance of receiving a liver.

The young Yeshiva student had no choice but to include his name to the long waiting list for a liver transplant. In the meantime, he tried to maintain his learning despite the illness, consciously aware that it will takes weeks, months, and even years till he will be able to be given a new liver. Many patients were on the waiting list, and his name was somewhere on the bottom... And when his turn does finally arrive, it must completely match his blood type and other medical criteria. If it's not a perfect match, he will need to continue waiting ... for a miracle.

However, רבות מחשבות בלב איש ועצת ה' היא תקום Many thoughts in a man's heart; nevertheless the counsel of HaShem shall stand.HaShem had a different plan for this young Yeshiva student and HaShem's loyal servants produced avalanches of hot ash, rock and gas on Europe, causing Europe to completely shut down its skies into a no-fly zone. No one can leave and no one can enter; a self-imposed siege in the euro zone skies. It is during this time that a young religious Yerushalmi man in the capital of Belgium is sitting in the yeshiva learning Torah.

During the course of the shut down airspace above Europe, a person dies in the hospital in the capital of Belgium, a person whom agreed to donate his liver to anyone that might need it. Astonishingly, a liver that is perfectly parametric for our young Yeshiva student.

Health authority of Belgium began searching the liver transplant waiting list but 'unfortunately', not even one patient was able to fly into Belgium for the very needed healthy liver transplant due to a volcanic eruption in Iceland.

As they advanced further on the waiting list, they reached the young Yeshiva student. However it was not offered to the boy due to his lack of citizenship. As the clock closed in on the deadline for time in which the the liver's lifespan for transplanting, the precious healthy liver cannot be wasted and must be swiftly replaced with a diseased liver, no one else was able to arrive in Belgium for the transplant except this young Yerushalmi.

With the clear Divine Intervention, this budding talmid chacham received the liver and is now recovering from surgery.

The enormity of this miracle was even greater after the successful liver transplant. The doctors said that the young yeshiva student's liver was very deteriorated and diseased and it was a matter of days his liver would stop functioning completely. The doctors unanimously believe that if this young man had to continue waiting for the liver transplant, he would have been long dead.

DOUBLE PORTION L'KAVOD SHABBOS KODESH



Halachos for Erev Shabbos Kodesh

1)Although we learned that a cooked item may not be placed directly on a fire or another heat source due to "Yesh Tzli V'Afiya Achar Bishul, a cooked item can still become roasted or baked", this holds true only when the proximity of the food to the heat source is close enough where it can actually get roasted.

2)However, if the cooked food is placed on top of a pot that is on the fire, on top of a hot water urn or on a blech not directly over the heat source, it is permitted. (See Biur Halacha Siman 318:15 where he asks on the Shulchan Aruch who, unlike the Rama, seemingly here allows the food to be placed directly by the fire after having prohibited this in 318:5. See Chazon Ish Siman 37:14 where he attempts to answer this contradiction. See also Kaf HaChaim 318:78



Halachos for Shabbos Kodesh

1)A food item that was cooked, roasted and baked, according to some Poskim, since it has already been through every kind of heating process it no longer is subject to the prohibition of Bishul and maybe heated up via all three methods. (Opinion of the Pri Megadim, quoted in Biur Halacha Siman 318:5 Dibur Hamaschil Yesh Mi SheOmer)

2) Some Poskim, however, maintain that the last process that the food underwent is what counts and thus if its final preparation was via baking, it is considered a baked item and is once again subject to the prohibition of cooking. (Biur Halacha ibid. seems to lean towards this Psak, and it is best to be stringent with this.)

1)As we learned, even items that are already baked or roasted may still not be placed in a Kli Rishon (or even a Kli Sheini where the item in question is considered Kalei HaBishul) to be further cooked as the cooking process further enhances the item more so than the baking or roasting process.

A few more common examples of this include:

Artificial sweeteners (such as saccharine, NutraSweet, Splenda and the like both in tablet form and in powdered form) if they are uncooked [in liquid], even if they undergo processing involving heat, may not be added to hot tea or other hot drinks unless the hot drink is already in a Kli Shlishi. (We will discuss Kli Shlishi more at length in the near future B’Ezras Hashem)

Likewise, other instant powders such as cocoa, soup mix etc. may not be added to hot water unless it’s already in a Kli Shlishi.

The exception to this rule is if every ingredient contained in the powder in question has already been through a "cooking" process, not just a baking or roasting process.

2) Just as we do not cook items that have only been baked or roasted, we also do not bake or roast items that have only been cooked.

Therefore, fully cooked items may not be placed directly on the fire or other heat source even if there is no liquid at all in the item, lest they get baked or roasted and thus be a transgression of Bishul. (See Mishna Berura Siman 318:41)

I work in a school where the water fountain is right outside the bathroom.

The actual toilets are in stalls. The stalls are probably 8 feet away from the fountain but the entrance to the bathroom is not.

Is this a problem considering one is not supposed to saya Bracha / think divrie kedusha within 8 feet of such tumah? or am i mistaken which is very possible.


Answer:




If there is a smell, you need to be 8 feet away from the smell in order to make any Bracha and ou would need to fill a cup of water, and walk away to make the Bracha and drink it.
As long as no smell is emanating from the bathroom, you may make a Bracha immediately outside of the bathroom.

Chizuk For Today:






The Pasuk in last week’s Parsha begins with Hashem’s directive to Avraham Avinu; "Lech Lecha Me’artzecha.." Hashem says to Avraham, leave your house and your comfort zone and travel to the place where I shall direct you .

Rabbeinu Bechaya writes that the word(s) "Lech L’cha" is derived from the term (shoresh) "Lichluch", which means ’dirt’.

Says Rabbeinu Bechaya, what this implies, is that Hashem was warning Avraham to take leave of his evil surroundings, lest he become affected and influenced by the ’filth’, ’dirt’ and immorality of his environment.

The question here is quite obvious! The Medrash Rabba teaches us that Avraham was called "Avraham Ha ’ivri", because he would consistently stand on the oppossite side (from the term ’Eiver’) and against the popular tide of immorality and baseness exhibited by the people of his time.



This being the case, why did Hashem feel the need to direct Avraham away from his home for fear that he might become affected by his surroundings?

The answer can be stated simply. The fact of the matter is, one doesn’t need to soak his hands in filth in order to become contaminated by it. Indeed, it is a proven fact, that if you simply hang around dirt and dust, you will become coated with it by simple virtue of your close proximity to it!

The Medrash explains the Pasuk in Mishlei (Perek 13), where Shlomo Hamelech writes; "One who seeks out wise people, will become wise, whereas, he who seeks the counsel of fools, will become a fool himself"



The Medrash compares this with an individual who leaves a fragrance store imbued with the wonderful aroma from within, versus someone who will stink as a result of exiting a foul smelling place.

The implication is clear; one who simply positions himself close to the source of wisdom or foolishness, will become influenced by it!

Furthermore, the Rambam writes in Hilchos Deos, Perek Vav, Halacha Alef, that the way of a person, is to be influenced by his surroundings. The Rambam mentions this as a Halacha!

In other words, in the Rambam’s view, this statement is an irrefutable fact and a simple reality. Namely, (the fact) that a person cannot resist the nature of being pulled after his surroundings!



If this was true for our great Patriarch Avraham Avinu who needed to leave his home for fear of negative influences (and notwithstanding his efforts to resist), how much more so where it concerns ourselves!!!

We must be forever vigilant to ensure that we stay away from bad friends, neighbors etc. lest we become influenced by them.

1)As we have been discussing placing baked croutons into hot soup, I have received numerous emails from readers asking about the status of the "yellow soup croutons" that we all love to add to our soup.

Most of the yellow soup croutons are deep fried and not baked (in fact according to the label they are made from wheat flour and oil and there is no coloring added to them; their dark yellow color is a result of deep frying!)

According to most Poskim, deep frying has the status of cooking as there is no difference if an item is cooked in water or oil, they are both liquids. (See Shmiras Shabbos K'Hilchasa Perek 1 footnote 183, quoting Psak of the Shulchan Aruch HaRav and Rav Shlomo Zalmen Auerbach Zatzal)

Thus, croutons that are deep fried can be treated as a cooked item and not a baked item and may be added to hot soup, even in a Kli Rishon

2) Although some Poskim are not sure if deep frying is considered cooking, the prevalent ruling amongst contemporary Poskim is indeed to treat it as cooking. (See Pri Megadim Siman; Mishbetzos Zahav 318:7)

If one is unsure if a particular crouton is baked or deep fried, it should be treated as a baked item until it can be verified otherwise.

If one is fleishig can he eat parve products made with milky equipment?


Answer:



If the parve food cooked in the dairy pot is not a davar Charif (sharp food such as an onion, garlic etc.) it may be eaten even though you are fleishig.

If the food, however, is a davar Charif it becomes milchig according to all opinions if the pot was used within the past 24 hours, and according to some opinions even if the pot was not used in tha past 24 hours, therefore it is best not to eat the food while you are fleishig. (Based on Pri Megadim brought in Darchei Teshuva Siman 89:42 and Yad Yehuda 89:5)

A Contract With Rav Shteinman
The friends and family of Meir Volk, z'tl recently gathered together to mark the 'sheloshim' (thirtieth day) since his untimely death. His family and friends were joined by the avreichim of the kollel of the Gadol Hador and Rosh Yeshivah, R Aron Leib Shteinman, shlita, for a seudas mitzvah. Friends and avreichim of the kollel had learned the entire Mishnayos for the benefit of R' Meir's soul.

After the siyum was completed, the discussion at the seudah centered around the unique agreement which R' Shteinman had signed with R' Meir shortly before the latter's death. R' Meir had agreed to donate a significant amount of money to R' Shteinman's kollel in exchange for a signed agreement of partnership in R' Shteinman's portion of Olam Haba. R' Shteinman was hesitant at first to sign this agreement, but ultimately agreed to sign a contract sharing his portion of Olam Haba which he would receive in the zechus of the kollel.

R' Avraham Pecter, who is in charge of financing the kollel, and had arranged the contract, later discovered how valuable the contract had been to R' Meir. After R' Meir's death, R' Pecter met R' Meir's friends and associates from Chutz Leeretz, who described the value and esteem with which R' Meir had viewed the contract. One of his close friends said in a hesped that the day after the contract was signed, R' Meir called and told him about it. He had said, "I made the greatest deal of my life. I can die in peace because I'm confident that I have a share in Olam Haba." At that point, no one was aware of how soon these words would come true.

At the seudas mitzvah, a young bachur approached R' Avraham Pecter, and introduced himself as the shaliach of one of the gevirim present at the seudah. He told R' Pecter that the gevir was interested in donating a full month of support for the kollel in exchange for a similar contract of partnership with R' Shteinman. Rav Pecter agreed to meet with the gevir, and together, they visited R' Shteinman to procure his agreement. During the meeting, the Rosh Yeshivah spoke about the significance and value of supporting Torah. He also praised the high level of the avreichim in his kollel. He agreed to sign a contract of partnership with the gevir for his share of Olam Haba he will receive for his kollel.

R' Shteinman then told over an awesome story which invoked fear and trembling in all who heard it. R' Shteinman prefaced the story by saying that he felt it was necessary for them to hear it order to understand that this agreement of partnership was not an imaginary deal. He said that after his death, R' Meir appeared in a dream, and revealed that this contract of partnership was the only thing which saved him from the bais din shel maaleh The Rosh Yeshivah didn't mention to whom Rav Meir had appeared in a dream, but it was understood that he was referring to himself.

This story provided chizuk to all who heard it of the chashivus and zechus of those who learn Torah and those who support them. Torah learning is so valued and appreciated in the beis din shel maaleh that it has the koach to save a Jewish neshama from descending to the depths, and instead, acquire a chelek in Olam Haba.

1)We discussed the concept of "Ain Bishul Achar Bishul, a cooked item cannot be re-cooked".

Besides for Bishul, cooking [in liquid], there are other methods for uncooked foods to be prepared, namely baking and roasting (which heat the foods via heat alone without utilizing liquids).

There is a discussion amongst the Rishonim if the rule of "Ain Bishul Achar Bishul" applies to these methods as well.

In other words, would it be permitted to cook a roasted item or to roast a cooked item? Would it be permitted to cook a baked item or to bake a cooked item?

The Shulchan Aruch (Orach Chaim Siman 318:5) quotes both opinions

The Rama (ibid.) rules that it is best to be stringent and not place baked items into hot liquid that is beyond Yad Soledes Bo, even in a Kli Sheini. This is the prevalent ruling that is followed L'Chatchilah.

2) Thus, a piece of Challah or baked croutons should not be placed into a bowl of hot soup unless the soup is already in a Kli Shlishi (even though usually we say there is already no Bishul in a Kli Sheini, for certain items, such as bread, which are Kalei HaBishul we maintain that even in a Kli Sheini it will be Bishul. We shall discuss Kalei HaBishul more at length in the near future B'Ezras Hashem), and surely the soup should not be poured directly from a Kli Rishon (Irui Kli Rishon) onto the Challah or baked croutons. (See Mishna Berura Siman 318:45)

We will discuss some more common, practical examples tomorrow B'Ezras Hashem.

Is one allowed to drink pure orange juice without a hechsher (Kosher Certification)?



Answer:




Although it is best not to eat or drink any processed product that does not have a Hechsher, according to many Kashrus agencies, 100% pure Orange Juice made in the USA doesnt require a Hechsher, due to the fact that if it wasn't 100% pure orange juice, it would not be able to be called "juice" according to USDA standards.

It is still best to seek out a brand with a Hechsher and not rely on this, as it is hard to know which machines it was packaged in etc.

1)When hot liquid, such as soup, is removed from the pot (Kli Rishon) via a ladle and dished into a bowl, inevitably some liquid will remain on the ladle.

If enough time elapses, those droplets will cool off totally, in which case the ladle must be dried off before being reinserted into the pot lest the prohibition of Bishul be transgressed as the cold droplets become cooked once again.

The same applies to the pot cover containing droplets of liquid which fall back onto the pot when the cover is replaced.

Some Poskim rule that if the ladle or cover is shaken off very well to the point that very little liquid remains attached to it is considered dried off. (Psak of Maran HaRav Yosef Shalom Elyashiv Shlita quoted in Sefer MeOr HaShabbos Vol. 1 Siman 4 footnote 29, and HaRav Shmuel Wosner Shlita in Shu"t Shevet Haleivi Vol. 7 Siman 42. Rav Shlomo Zalmen Auerbach Zatzal is said to have ruled this way as well, though in his own home he was stringent.)

Other Poskim are stringent and require the ladle or cover to be totally dried off with no wetness left on it at all before it may be put back into the hot soup. (The Chazon Ish was stringent with this. See Shu"t Minchas Yitzchak Vol. 9 Siman 30 and 31.)

2) Even the Poskim that are lenient, are only lenient in the above case where the cold liquid in the ladle or cover was previously cooked, but in a case where the liquid was never cooked (such as pouring hot water from an urn into a glass that was just washed and has on it droplets of cold water) the droplets must be totally dried before the hot water can be added. (See Igros Moshe Orach Chaim Vol. 1 end of Siman 93)

Is it prohibited to read a newspaper on Shabbos?



Answer:




Of course you are referring to Kosher newspapers, and not newspapers that contain in them content, graphics and photos that may not be present in a jewish home or read even in the weekday....

Certain parts of the paper are 100% prohibited to read on Shabbos. These include business related ads (even if you don't plan to purchase the advertised product or service), financial columns, cooking columns etc. (see Igros Moshe Orach Chaim Vol. 5 Siman 22:3 that business newspapers should not be read and are Muktzeh)


Torah content, biographies etc. may be read.

Sad Stories, obituaries etc. should not be read. (Mishna Berura Siman 307:3)


In general, if one can read a newspaper and avoid any prohibited content, it's OK. But if one will be unable to avoid glancing at business ads etc. it is best to avoid reading newspapers altogether on Shabos. (See Mishna Berura Siman 307:63 and Shemiras Shabbos K'hilchasah Perek 29:46 )

Dear Brother,



Allow me to introduce myself. My name is Yankel and I've been sitting in the row right behind you in shul for close to 16 years.

With the help of Hakadosh Baruch Hu, I have a beautiful family and a successful business.I have everything I want and need.



Normally I would tell you this in person when I'd see you in shul during davening, or maybe when there is even more time to schmooze, during chazaras hashatz or krias haTorah.



However, recently that changed.

The past few months we've seen tragedy as never before. An entire family wiped out and recurring terrorist attacks.



The ugly specter of anti-Semitism rising worldwide as never before. Patients lying in the hospital suffering from debilitating illnesses.



The loss of so many close friends due to illness and fatal car accidents. The number of young almanos and yesomim is growing by the day.



The number of families who can no longer stay afloat in these financially turbulent times is mind-boggling.



There are so many similar situations that each one of us knows personally.

The strength in Klal Yisroel lies in the love and responsibility each member feels for the others. With this in mind, I am beseeching you - no, begging you - to join me in a unique project to help counter these horrible tragedies that our nation is facing.



We are just beginning a new year, one which we will pray will be filled with yeshuos and good health for all of us.

One way to invoke Hashem's mercy is to follow the advice of the Tosafos Yom Tov: to focus on silence during davening as a way to bring Hashem's brachos upon us.



I am mekabel upon myself (bli neder) to refrain from talking during davening, with the sincere prayer that this kabbalah will bring greater brachos into my life and the lives of those who are an integral part of my life: all of you.



Please, please join me with whatever kabbalah you can make - for all the tefillos, just one, or even during chazaras haShatz or krias haTorah.



It will lend an aura of greater kedushah to our shuls and batei medrash. It would be a tremendous zechus for a yeshuah for all those in need if you would agree to join me in this powerful source of brachah.



Don't look down during davening. Look up. Look around you and see who needs your tefillos for health, for livelihood or for peace.



Daven for them, and b'ezras Hashem all of our tefillos will be answered l'tovah.



Let us storm the Heavens ... with our silence.

1) A cold cooked food item, such as meat or chicken, which is sitting in a bed of gravy which has congealed due to being in the refrigerator, is a subject of debate amongst the Poskim if it may be reheated on Shabbos.

Although the gravy is not liquid at the onset of being reheated, it will indeed return to its liquid form as it gets heated and thus result in cold liquid being heated.

Some Poskim rule that since at the time it was placed on the heat source it was not a liquid, we apply "Ain Bishul Achar Bishul" and it is permitted. (See Mogen Avraham Siman 318: 40 and Mishna Berura Siman 318:100. However, it must be pointed out, that if there is a lot of gravy in the pot, it may possibly be prohibited even according to these Poskim due to the prohibition of Molid, unless in cases of extreme necessity, where we can be lenient. See Mishna Berura 318:105-107)

Other Poskim maintain that it is prohibited as they rule that although the gravy at the onset of the cooking was congealed, still as soon as it becomes liquefied it is once again considered a cold liquid and once again subject to the prohibition of Bishul similar to any other cold liquid. (See Levush Siman 318:15 and Taz S"K 20)

2) Salt or sugar, which are cooked, should not be placed into pot of boiling liquid (Kli Rishon) nor should boiling liquid from a pot (Kli Rishon) be poured directly onto salt or sugar even if they were previously cooked.

The reason for this is that as soon as the hot water makes contact with the salt or sugar it liquefies it, and thus it will be reheating a cold liquid and that is prohibited. In a Kli Sheni it is permitted.(Mishna Berura Siman 318:71 writes that it is best to be stringent with this. Even though with congealed gravy he rules leniently, he holds that sugar or salt turns to liquid immediately upon making contact with the hot water and thus is considered a liquid while the gravy takes longer to liquefy and thus is less of a reason to consider it liquid)

If you are certain that less than a Kzayis remains in your stomache, you do not bentch. If you are not sure, you also do not bentch.

Question: Why should a person thank Hashem for his eyes, Baruch Ata Hashem Pokeach Ivrim, if animals can also see?

Plenty of people cannot see. Walk in the streets and see this man tapping his way with a cane, and ask him that question, what will he answer?

We have to thank Hashem for the animal's eyes, too. But whatever there is in the world, is given for the purpose of making us aware of Hashem. And not only thank Hashem for the fact that we have eyes to use, but the eye itself is a testimony.

You know; that Rasha himself, Darwin, Yemach Shemo, himself said, that when I come to the subject of the eye, I feel somewhat faint to think that such a contrivance could happen by itself. He felt somewhat faint, he should faint, he's in Gihenom fainting right now.

The eyes are a wonderful thing, Nisay Nissim what an eye is, you have to talk about the eye, at length - to appreciate it. Wonder of wonders. It's a camera taking pictures every second, color pictures, and it functions perfectly not only for close nearby pictures, but it can focus on far away pictures in the same minute. When I look at you, now the camera, I have to adjust it for far away, but immediately the eye adjusts for far away pictures, then I turn back to you, close pictures. Wonderful.

You're sitting in a car speeding down the road, you look at the speedometer right here, and then you look at the mountains miles ahead; you couldn't do that with a camera.

The wonders of the eye would occupy volumes and volumes to explain.
And the eye itself testifies to the endless wisdom of its great designer. And therefore when we thank Hashem, Pokeach Ivrim, not only for the happiness of the eye, not only for the joy of sight, we appreciate a life of color and motion.

Great pity, a great sadness to lose sight. Opportunity that sight gives us to gain understanding, to see people we love, to be able to guard ourselves against danger, when you have to cross the street, pitfalls. Eyes are not only useful for us in every sense but the eyes bring us the greatest benefit of all, the awareness of the great Designer who brought such a most complicated contrivance into existence.

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH

1)We learned yesterday that a food which loses its "cooked" status upon becoming cold ,according to many Rishonim is no longer considered a cooked food and thus isn't covered by "Ain Bishul Achar Bishul", and it may not be re-cooked on Shabbos.


What is considered "becoming cold"?

If it cooled off totally, of course it is once again considered uncooked and is subject to the prohibition of Bishul. (See Rama toward the end of Siman 318:15)

If, however, it has not totally cooled and is still warm, according to the Rama (ibid.) even if it has cooled to below Yad Soledes Bo it is still permissible to place it on a covered heat source as we say "Ain Bishul Achar Bishul". Ashkenazim generally follow this ruling.

The exception to this rule, even according to the Rama, is if the "cooled down" item in question is no longer considered warm by most people seeking to eat/drink it hot , such as a glass of tea that has significantly cooled to the point that one seeking a hot drink would pass on this particular one and consider it totally cold, then it is prohibited to reheat. (See Shulchan Aruch HaRav Siman 318:9 and Chazon Ish Orach Chaim Siman 37:13 Dibur Hamaschil V'Kasav HaRama. See also Igros Moshe Orach Chaim Vol.4 Siman 74:Bishul; 2)



2)According to the Shulchan Aruch (Siman 318:4), however, once it has cooled below Yad Soledes Bo it is no longer considered cooked and no longer covered by "Ain Bishul Achar Bishul" and may not be reheated to above Yad Soledes Bo lest the prohibition of Bishul be transgressed. Sephardim generally follow this ruling. (See Mishna Berura Siman 318:24 and Biur Halacha Dibur Hamaschil Im Nitztanen)



Halachos for Shabbos Kodesh

1) A food item that is mostly dry but contains within it some liquid is a subject of discussion amongst the Poskim whether we see it as a dry food and thus are allowed to warm it up on a permissible heat source on Shabbos or if we prohibit it due to the liquid portion of the food. (See Igros Moshe Orach Chaim Vol. 4 Siman 74: Bishul; 7)

The prevalent ruling regarding this is that if there is enough liquid in the pot/pan that stands alone and isn't actually on the dry food, we treat it as a liquid and prohibit reheating it.

If, however, there is only a minimum amount of liquid which only covers the actual food, but no free standing liquid remains in the pot/pan besides that, we treat the entire thing as a dry item and it may be reheated on a permissible heat source on Shabbos.

2) Thus, a pan of chicken or meat soaking in gravy may not be reheated as is, unless the chicken or meat is transferred sans the gravy into a different dry pan. (Do not, however, remove the gravy from this original pan as doing so will be a problem of Borer)

Whereas a piece of potato Kugel which has a little bit oil on it is considered a dry food and may be reheated. (Psak of Rav Shlomo Zalmen Auerbach Zatzal quoted in Sefer Meor HaShabbos Vol. 1 letters 1 and 2. Rav Shmuel Wosner Shlita also rules this way)

During Shiva, makeup is prohibited. After the Shiva, even before the Shloshim has been reached, it is permitted.

HaRav Avrohom Kalmanowitz, Z'tl, once asked why Noach had to suffer at the hands of the lion, who smote him for not having been properly "served" his food.



After all, was not Noach taking care of all of these creatures as best he could?!



HaRav Kalmanowitz answers that Hashem was providing Noach--and each and every one of us--with an essential lesson.



Noach was ALWAYS TO REMEMBER that by Hashem's grace he had survived when so many had perished, and Noach was ALWAYS TO REMEMBER that he had survived for a great purpose--to take care of those who had also survived, and who needed his help.



The lesson to us is fundamental: We are all survivors of the Holocaust (whether it be first, second or third generation--does it make a difference?)--and we must ALWAYS REMEMBER that we have survived for a purpose.



Moreover, we must help those who have also survived, but may not be as capable as we are--teach them the Torah's ways, assist them with Chessed, and see to it that they too continue to survive and reach their own purpose in life.



It is quite likely that more of our people perished in the Holocaust than those who perished in the Flood. This makes our role all the more responsible...and our task all the greater.

1)Food that has been totally cooked is no longer subject to the prohibition of cooking. This concept is referred to in Halacha with the terminology of "Ain Bishul Achar Bishul, a cooked item can no longer be cooked".

However, with regard to this concept there is a differentiation between dry foods and liquid foods or foods that contain liquid.
A totally dry cooked item (such as potato Kugel or chicken cutlet) may be placed on top of an urn, crock pot or another non-direct heat source on Shabbos even if it will be heated above Yad Soledes Bo. (Shulchan Aruch Siman 318:4)
The reason for this is that this second heating does not cause any new chemical changes in the food as it was previously cooked (and even when it turned cold, it did not revert back to being an uncooked food, rather it was a cooked food that became cold) and this new heating action just makes the cooked food warm.
2)However, a food which loses its "cooked" status upon becoming cold (such as water, soup, gravy or any other liquid or liquid containing food, in which case the liquid reverts back to being an uncooked liquid), according to many Rishonim is no longer considered a cooked food and thus isn’t covered by "Ain Bishul Achar Bishul", and it may not be re-cooked on Shabbos.
Some Rishonim maintain that even with regard to liquid foods we apply the concept of "Ain Bishul Achar Bishul". (See Bais Yosef Siman 318)
Most Poskim, however, rule stringently and prohibit reheating any previously cooked liquid containing foods which have become cold. (Shulchan Aruch Siman 318:4. Tomorrow, B’Ezras Hashem, we shall discuss what temperature is considered "cold" in regard to this Halacha.)

Please tell me what kind of brush for hair can be used on Shabbos.



Answer:



To use a brush on Shabbos, the following three conditions must be met:

1) It needs to have soft bristles so that pulling out hair is not guaranteed to happen.
2) It must be used gently, without force.
3) It should be a designated brush for Shabbos use and not the same brush used in the weekday

We are told that one of the 10 nisyonos (trials) of Avraham Avinu happened in this week’s sidrah, "Lech Lecha Me’artzecha...".


The question is asked: how is this a nisayon?

Immediately after the commandment, Avraham Avinu gets a havtacha (guarantee) from Hashem, that he will become a great nation and multiply.



This sounds like an offer he can’t refuse!


Explains the Sfas Emes: The nisayon here was, how was Avraham Avinu going to respond; that despite the havtacha, was Avraham Avinu going to act lishma (for the sake of Hashem), because it was what Hashem told him, or for the sake of the havtacha.


We see that, B"H, Avraham Avinu was successful and he passed this test with flying colors, just like the others.


B’Ezras Hashem, we should always be emulating this middah(character trait) of acting purely lishma, despite the brachos and rewards that may accompany our good deeds!

תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות
