SPECIAL DOUBLE
PORTION L'KAVOD SHABBOS KODESH
Halachos
for Erev Shabbos Kodesh
1)It is prohibited to contradict a
parent. (Shulchan Aruch Yoreh Deah Siman 240:2)
If a
parent has a verbal disagreement with another person, and the child
tells the other person "I concur with your view", it is considered
contradicting the parent and is prohibited. (Shach Yoreh Deah
240:2)
2)
According to some Poskim this prohibition is only in the presence of the
parent. Other Poskim, however, maintain that even not in the presence
of the parent it is prohibited. (See Shach and Taz ibid. and
Biur HaGra 240:3)
Halachos
for Shabbos Kodesh
1) If the issue at hand is
in a Torah discussion and the son has clear proofs against the opinion
of the parent, many Poskim allow the son to contradict the father, even
in his presence (respectfully of course) (See
Chazon Ish Even HaEzer Siman 47 Dibur HamaschilV'Lo Soser
Es D'Varav. See also Sefer Be'er Sheva to Sanhedrin 110)
Of
course, if the parent asks the child for their view, there is no
prohibition against giving it. (See Aruch HaShulchan 242:23)
2)
If a parent says something, it isn't respectful, and thus prohibited,
for a child to say "I agree, it seems that what you are saying is
right", as a parent doesn't need the [unsolicited] approval or consent
of a child to validate what they are saying. (Shulchan Aruch
Yoreh Deah Siman 240:2)

If a Yahrtzeit is on Shabbos, should the person daven
from the amud on shabbos?
Answer:
The accepted custom is
to daven Musaf on the Shabbos preceding the Yahrtzeit that
comes out in the following week. If the Yahrtzeit is actually on
Shabbos, the Minhag is to daven Musaf that Shabbos, but not Shacharis.
It is also important to get an Aliyah to the Torah. Since
these customs do vary from Shul to Shul and from community
to community it is best to discuss with the Rav and/or Gabbai of your
particular Shul.

1) When a child takes an
elderly father into his/her home to live with their family, there is no
obligation for the father to be seated at the head of the table, rather
the son (or son in law) can retain his seat at the head of the table as
head of the household and have the father sit on the side near him.
However,
when the food is served it is obligatory to serve the father [or
mother] first even though the son (or son in law) is the head of the
household. (Aruch HaShulchan Yoreh Deah 240:11)
2)
Some people have the custom when their father or father in law comes
for a visit (as opposed to the case above where the father will be
staying with them long term or permanently) that they indeed do
relinquish their seat at the head of the table and respectfully allow
the father to sit there and "lead" the meal.
This is a very praiseworthy custom for which many Gedolim followed.
It also sets a verygood example for the young children
to observe how their parents respect their own parents.

Is it preferable to cover ones eyes with his talis
[rather than his hands] when saying the first pasuk of shema?
Answer:
I have
not seen any sources to indicate that covering with the Tallis is any
better than the hand. In fact the language used in the Seforim is "Yado-
his hand". The reason to cover is to make sure not to look around and
see other things, so as long as it's covered it suffices. I don't see
why the Talis would be better.
After
seeing this Q& A, one of our readers emailed me the following:
I
have heard in the name of R' Chaim Kanievsky that even lefties should
use their right hand when covering their eyes. He reasons that since
using the right hand is "Al Pi Sod", then Sod says to use the right hand
(and not necessarily your more choshiver hand). In other cases, e.g.
Kiddush, lefties would use their left hand because it is their choshiver
hand. Based on this, (then even though the reason of making sure not to
look around is one reason,) Sod says to use your hand, not your tallis.

Last week, 1
of the halachos [in the halachos of Midvar Sheker Tirchak] was the issur
to offer a present as an
act of goodwill to someone who
will surely refuse it - a friend mentioned that the same would hold true
to sending an invitation to a simcha to someone you know will surely
not come. Is this so, and is this practice (which I believe is done all
the time) assur?
Answer:
Yes, it would apply to sending an invitation
to simcha, or to inviting someone for a shabbos meal, when you dont
really want them and know they wont come.

1) One may
not pretend that he will do something for the benefit of
another person when in fact he planned to do that thinganyway
for his/her own benefit.
2)
Some examples of this:
A
storeowner who was planning on opening new merchandise to display may
not tell a customer "I wasn't gong to open this, but I will do it for
you"
One
should not set a lunch meeting with a prospective client to have them
believe that they are interested in their business when they know from
the beginning that they will afterwards call to cancel, due to no real
interest in meeting.
Likewise,
a client should not say to the prospective business associate, "We
should meet for lunch" when he knows that the answer will be no, and is
only saying it to feign interest. (See Rashi to Chulin ibid.)
One
should not present an expensive gift to someone with the knowledge that
they will not accept, and thus is only presenting it so that person
should exhibit good will towards them for attempting to give the gift

NEW TOPIC ***NEW TOPIC***NEW
TOPIC
1) We will now begin discussing the Halachos of Kibud Av
V'Eim, honoring one's father and mother.
The Aseres HaDibros, the Ten Commandments
given to us by Hashem on Har Sinai are divided into two parts, the
first five are commandments between man and Hashem (Bein Adam L'Makom)
and the last five are commandments between man and fellow man (Bein Adam
L'Chaveiro)
Kibud Av V'Eim ,the fifth of the Aseres
HaDibros, is listed amongst the commandments that are between man and
Hashem even though it is seemingly a commandment that is only between
man and man.
The reason for this is that honoring
one's parents is akin to honoring Hashem.
There are 3
partners in every human being, the father, the mother and Hashem. If one
honors any of the three it is as if all three have been honored, and if
one dishonors any of the three it's as if all three have been
dishonored. (See Talmud Kidushin 30b and Psikta Rabasi 21. See
also Rambam Hilchos Mamrim Perek 6:1)
2) One who doesn't live a Torah-true life
and isn't scrupulous in keeping the Mitzvos not only is he/she
dishonoring and angering Hashem, but also causes shame upon their
parents to such a degree that there is no greater shame in the world. (Kitzur
Shulchan Aruch Siman 143:21)
One who honors his parents properly will
merit special heavenly protection to prevent him from transgressing
other sins. (Tana D'Vei Eliyahu Raba Perek 26)
The importance of this mitzvah cannot be
overstated, and there are many different aspects of it which are not
well known to most people, and we hope that after we conclude our
treatment of this topic we will all be a little more versed in the many
details and thus be able to improve our adherence to this exalted
Mitzvah.

Lag B'Omer. We celebrate it as a day
the talmidim of Rabi Akiva stopped dying. What is the mekor (source)
for this?
Answer:
The Tur Siman 493:3 states
that the Talmidim of Rav Akiva stopped dying on Lag B'Omer.
This
is brought in earlier Rishonim as well, such as the Me'iri to Yevamos
62b and Sefer HaManhig and others.
Interestingly, the MaHaril
writes that they died on all the days between Pesach and Shavuos, except
on the days that we do not say Tachnun ,7 days of pesach, 2 days of
Rosh Chodesh Iyar, Rosh Chodesh Sivan, the 7 Shabbosim in Sefira, 17
days in all, therefore they only died on 32 of the 49 days. As a
commemoration of this, we designate the "33rd" day as the day that the
dying stopped and we celebrate that day, but not that it totally stopped
on Lag B'Omer.

1)Kibud Av V’Eim, honoring ones parents, is broken
down into a few categories.
The two
primary categories are "Kavod, respect" and Yirah,
fear or awe" for parents, and it is extremely important to be careful to
properly respect ones parents and treat them with awe.
According
to many Rishonim, the Mitzvah of "Kibud" and the Mitzvah of "Yirah" are
two distinct Mitzvos.
"Kibud" is
generally accomplished by "doing" things for them, as we will B’Ezras
Hashem detail in the coming days.
"Yirah" is
generally displayed by "not doing" certain things and by generally
having certain feelings and thoughts regarding ones parents, and this
too we will elaborate on in the coming days B’Ezras Hashem.
2) What
constitutes "Awe"?
The
Rambam (Sefer HaMitzvos Mitzvah 211) writes "One must
fear their parents the way one fears someone, like a king, who is able
to mete out punishment. One must act with his/her parents the way one
acts when in the presence of one who is feared..."

I have a physical
disability. I normally daven either at home or at my office, do I
fulfill the Mitzvah?
Answer:
First of all,
may Hashem grant you the strength to persevere and the fortitude to
overcome your challenges. Mashiach is on the way, and with his arrival,
all disabilities will be cured iy"H!
Yes, of course you fulfill the Mitzvah of Tefilah, as in
your particular situation it is too difficult or impossible to alwas
make it to Shul. The best thing for you to do is to try and daven
Shemona Esrei at the same time as your shul does, so you will also have
"Tefilah B’Tzibbur" in that manner.
Another alternative is to daven K’Vasikin (when
possible) as in many instances it’s more ideal to daven then at home
than later on with a Tzibbur.

I recently davened at a minyan where
the shliach tzibur checked the tzitzit on his tallis, thereby delaying
the start of mincha a few monemts past the scheduled time. Was this

Answer:
Although it is important for the Public Talis

expense of the waiting Tzibbur. Rather, the Shatz should try and do it a
moment or two before the scheduled time.

Halachos for Erev Shabbos Kodesh
1) The Talmud (Bava Metzia 23b) teaches
us that there are three other instances where lying is permitted, and
refers to them as "Maseches, Puria and Ushpiza"
Maseches:
If someone asks you if you are versed in a certain
tractate of Talmud [for the purposes of testing you], even if you are,
you may humbly say no. (See Rashi to Gemara ibid. Dibur
Hamaschil B'Maseches. See also Drisha to Choshen Mishpat
Siman 262)
If
someone is learning a certain topic and is questioned as to which topic
they are learning, they may lie and say they are learning something else
in order to avoid having to answer questions on the real topic they are
learning.(Sefer Toras Chaim Bava Metzia ibid.)
2)
However, if the questioner is asking a Halacha question for purposes of
Halacha L'Ma'aseh he must answer the question if he knows.
(Tosefos Bava Metzia ibid. Dibur Hamaschil B'Maseches)
Halachos for Shabbos
Kodesh
Puria:
1) According to Rashi Puria
means, if one is asked if they had marital relations, which if answered
truthfully would be lacking in Tznius, modesty, he/she must lie.
Likewise, a woman who is
asked if she pregnant with a child, may lie to protect her privacy.
2) According to one
interpretation in Tosefos it means, If one didn't attend the Bais
Medrash due to being impure (Tumas Keri) and needing to immerse in a
Mikvah, he may lie and say he was ill or another valid excuse if asked
about his absence.

Why do we
say Migdal during [Birchas haMazon on ]Shabbos and Yom Tov as
opposed to saying Magdil the rest of the week?
Answer:
One reason given is based on the Gemara (Shabbos 115a) that
teaches us that we do not read from Kesuvim on Shabbos. The Posuk
"Magdil Yeshu'os Malko V'Oseh Chesed L'Mshicho" is from Tehilim Perek
18:51, which is Kesuvim, so on Shabbos we change it to an almost
identical Posuk "Migdol Yeshuos Malko" which is in Neviim, Shmuel II
Perek 22:51. (Interestingly, both of these verses are Posuk 51
in their respective Perakim.)
The Vilna Gaon was said to
have maintained that this minhag developed by mistake, based on a
misunderstanding. The Posuk was written as "Migdol" and the letters "Shin"
and "Bais"
were written next to it as a source code meaning "Shmuel Bais",
However, over time people misinterpreted the "Shin Bais" as meaning
"Shabbos" and thus began saying "Migdol" on Shabbos only and "Magdil"
during the week.

questioner from being an "unwanted guest" at the host, and thus cause
him an unwanted monetary loss. (Rashi Bava Metzia 24a Dibur Hamaschil B'Ushpiza. However,
according some Poskim do not rule this way and do not accept this
interpretation of "Ushpiza" as this is prohibited due to Lashon Hara.See Chofetz Chaim
Klal 9:3 and Dibros Moshe from Rav Moshe Feinstein Bava Metzia ibid.)
The Rambam and others interpret "Ushpiza" as
follows: If one was a guest at someone's home and he is asked where he
stayed he may lie and say he stayed a different person's house in order
to prevent "unwanted guests" from taking advantage of thereal
host.
2) It is permissible to lie in order to
save another Jew from embarrassment, but if possible it should be done
in a way that doesn't seem like a lie is being said. (Sefer
Chasidim 642)

I was
learning that a renter must put up mezuzas in his apartment, but without
a bracha. Why is that?
Answer:
According to many Poskim, a renter should not recite a
Bracha on the Mezuzah until after living in the home for 30 days (as
until then he isnt considered Kavua), but after 30 days everyone agrees
that the renter must recite the Bracha.
Some Poskim maintain that even renters recite the bracha
immediately.
Some differentiate between a long term rental and a short
term rental (such as a summer bungalow) (See Igros Moshe Yoreh Deah Vol.
1 Siman 179).

1) Often, appeals are made in Shul for
various Tzedaka organizations, whereby pledges are called out loud. Some
people call out large sums of money, even though they have no intention
of giving that large a sum, in order to encourage others in the Shul to
match or beat that sum.
Although
their intentions are noble, doing so is prohibited and considered
lying. (Shu"t Minchas Yitzchak Vol. 3 Siman 97)

Is it
required to eat meat at a seudas mitzvah (e.g. seduah after a bris)? The
seudah was during shalosh seduos and i didnt eat meat because i wanted
dairy for melavah malkah. I was told what I did was wrong and that we
are chayav to eat meat during this instance because it shows simcha. Is
this true and what is the source?
Answer:
It is a Mitzvah to serve meat at a Seudas Mitvah, as
there is no Simcha without meat .
A Bris is a Seudas Mitzvah, and indeed should
ideally be a meat meal.
That being said, many people today have the custom to
serve dairy at a Bris, either becasue of financial reasons as meat meals
are more expensive or due to practical reasons as most people today
would rather not have fleishig for breakfast. Many Poskim rely on these
reasons and indeed do allow a dairy Bris.

1) If one does something that his/her
mother asked them to do, and afterward his/her fatheris
upset that it was done and asks "who told you to do this?", he/she
should lie rather than say thatthe mother asked that it

Chasidim Siman 336. He also writes there that ifindeed
you tell your father that your mother asked you to do it andhe
gets angry at her, it is as if you yourself got angry at your mother.)

Can someone light their first Shabbos candle
from a shabbos candle that is already burning?
Answer:
The Poskim do allow using a lit shabbos candle to ignite
another candle.
However, it's best not to pick up the lit candle and
light the unlit candle, rather take the unlit candle and bring it to the
flame of the lit candle.
A lit
shabbos candle, however, may not be used to ignite a match or another

While
recently saying Kiddush Levana I found it interesting that everyone was
davening facing towards the moon ( opposite of Mizrach in our Shul ) .
Is there any Mekor for this ( facing
towards the moon ) or should we be Davening towards Mizrach like all
other Tefilos ?
Answer:
Although it isn't brought in Shulchan Aruch to
face Mizrach when saying Kiddush Levana, I did hear from a Talmid of Rav
Moshe Feinstein Zatzal that he was indeed makpid to stand facing
east while reciting Kiddush Levanah.
It is best not to specifically face the moon, especially while reciting
the Bracha, lest it appear as if we are praying to the moon Chas
V'Shalom.

It is permissible [and according to some Poskim,

I recently
came home to find a flier from a local missionary organization at my
front door. Before discarding it, I noticed that while the articles have
quotes from their "New Testament", they also
contain several quotes from actual Torah sources (in English, of
course). How should I discard of this- is it considered shaimos?
Answer:
They are not considered Sheimos and may be discarded,
as even a Sefer
Torah that was written by a heretic may (and must) be burned,
as it has zero Kedusha.

1)The prohibition to lie applies equally
to men and women. Children as well should be
trained to speak truthfully. (See Talmud Sukkah 46)
2)There
is no difference if the lies that are spoken are directed at a man,
woman or child, or even a non Jew, they are still forbidden.
(See Sefer Chasidim Siman 426)
Thus,
one should not promise a reward to child for good behavior and then not
follow through with the promise as doing so is lying as well as
teaching the child that one doesn't need to keep their promised word. (See
Talmud Sukkah ibid. See also Sefer Ahavas Chesed from the Chofetz Chaim

involved)

I am told
that the names of the Hebrew months have significance. For instance, Nissan is for the month that is
destined to have nissim (miracles) ,Iyar
is the mnemonic for Ani Hashem Rofecha. My question is: What are the meanings for the
remaining ten months?
Answer:
The names of the months are not Hebrew. The Torah doesnt
mention them, rather only calls them by their numbers. The Ramban
(Shmos 12:2) discusses the origins of these names and they are
babylonian etc.

The prohibition of lying applies not only to speaking untruths with the
mouth, but also to writing untruths in letters, newspapers etc.
(See

Likewise,

INTRODUCTION:
The Torah is referred
to as "Toras Emes, A True Torah". (Tehillim 119:142)
The seal of Hashem is
"Emes, truth" (Talmud Yoma 69b)
The highest accolade
one can bestow upon a Jew is that he/she is an Ish Emes, a man or woman
of truth.
Lying is one of the
most disgraceful sins. So much so that the Torah doesn't simply say not
to do it, rather the Posuk (Shmos 23:7) tells us to
distance ourselves from untruth, Midvar Sheker Tirchak, an admonition
not found by any other prohibition in the Torah.
The Talmud tells us
that Hashem despises one who [habitually] lies. (Pesachim 113b)
Being untruthful is not
the Torah way and is halachically unacceptable. However,
not everything that is seemingly "a lie" is considered Sheker, and not
everything is seemingly "the truth" is considered Emes.
We shall now begin to
discuss some of the Halachos that pertain to the prohibition of lying
and B'Ezras Hashem get some clarity in this topic.
1)
It is a biblical prohibition to speak untruths. (See Chofetz
Chaim Pesicha to Mitzvos Asei 13. See Smag Mitzvos Asei,
Mitzvah 107, Smak Mitzvah 227, Sefer Chasidim Siman 1060,
Sefer HaChinuch Mitzva 74, Mesilas Yesharim Perek 11)
2)
One who is careful to speak truthfully is emulating Hashem and is
acting in accordance of the positive commandment (in Devarim 28:9) of
"V'Halachta B'Drachav, you shall follow [Hashem's] ways" (See
Chofetz Chaim Pesicha to Mitzvas Asei 14)

What's the deal with davening in
the car? for example today, I was on the way back from work (highway),
cutting it close to shkia (sunset), and was stuck in traffic, and it was
pouring outside. can one pull over to side of street and stay seated
and daven in car? If so, does this heter only apply if it were raining
outside, but if it wasnt raining, would one have to get out of the car
to stand up properly for the amida? what if it wasnt safe to do so (i.e.
bad neighborhood, highway)?
Answer:
Davening while driving a
car is absolutely prohibited according to the Poskim, as it is
impossible to concentrate on the road and on davening at the same time.
If you pull over to the side of the road it is ok to daven.
Preferably you should go outside and stand for Shemona Esrei. If that
isn't possible, as you indicated it was pouring rain or if it is a
dangerous neighborhood, then you may indeed daven sitting down in your
car.
All of the above is provided that you are running against the clock
and will not be able to daven normally when you get to your
destination safely.

SPECIAL DOUBLE PORTION
L'KAVOD SHABBOS KODESH
Halachos for Erev
Shabbos Kodesh
1)Even
if only part of a utensil was used in a non kosher way, the entire
utensil requires koshering. (Shulchan Aruch Yoreh Deah Siman
121:6. See also Shach and Taz there as well as the Biur HaGra Os 18. See
also Mogen Avraham Siman a451:24 and Mishna Berura S"K 70 regarding if
only part was koshered and the utensil was used)
2)
The utensil that is being koshered need not be in the boiling water for
more than a mere few seconds. (See Tur and Taz Orach Chaim
Siman 452)
In
fact it is best if the utensil is not left in the water for an extended
period of time. (See Mogen Avraham Siman 452:2 and 3, Shulchan
Aruch HaRav Siman 452:17, Mishna Berura S"K 13 and Sha'ar HaTziyun Os
28)
Even
if the utensil is left in the boiling water for a little longer than
ideal, particular care should be taken that it is removed before the
water ceases to boil.
This is particularly important in regards to Chometz
utensils being koshered for pesach use.(See Shibolei HaLeket
Siman 207, Rokeach Siman 250 and Sefer HaMachria Siman 69 quoting the
opinion of Rashi)
Halachos
for Shabbos Kodesh
1)
It is customary to rinse all the surfaces of the utensils in cold water
immediately after they are koshered. (Shulchan Aruch Orach
Chaim Siman 452:7 and Yoreh Deah Siman 121:1. See also Biur HaGra end of
Siman 452)
If
this was not done, it does not invalidate the koshering according to
most Poskim. (See Mishna Berura Siman 452:34, Kaf HaChaim
452:75 and Chayei Adam Klal 125:37. See also Shu"t Shevet Haleivi Vol. 6
Siman 115 where rules that surely B'dieved it is permitted, not
like the Darchei Teshuva Yoreh Deah 121:45 who is a Da'as
Yachid that prohibits such a utensil)
2)
Once a utensil is koshered it may be used for meat, dairy or parve use
at the discretion of the owner, as it is halachically considered like a
brand new, unused, utensil. (Though, for Ashkenazic Jews
utensils should not be switched back and forth at will without having a
halachically acceptable reason to do so, as we discussed previously)
This brings us to the
conclusion of Part 1 of our foray into some of the Halachos of Kashrus
in the Kitchen and beyond.

Kashrus related Halachos at a later date.

If someone did not have kavana during the first
bracha of Shemona Esrei he should only scan [the words, as you wrote in
your Halachos OF Tefila] or is he allowed to say over the first
bracha starting by Elokei Avrohom ?
Answer:
If you realized that you didn't have
Kavannah before you said Hashem's name in the Chasimah of the Bracha,
you can repeat the Bracha again from "Elokei Avraham".
Rav Shlomo Zalman Auerbach maintains
that if you didn't have kavannah for only part of the Bracha, you
should repeat only the parts that you didnt have Kavannah for, and not
from the beginning of the Bracha. He also says that one may repeat any
part of Shemona Esrei that was said without Kavannah, even though
Brachos with Hashem's name will be repeated.
If the Bracha of Avos was finished,
it is best to scan it, and not repeat it, unless you are someone that
usually has Kavannah, and in that case you should start again from the
beginning.
Another thing that can be done, is to
wait until Chazaras haShatz, and have in mind to be Yotzei with the
Chazzan's Birchas Avos, and then continue "Ata Gibor" on your own.
However, the Poskim are hesitant to allow this particular method (for a
host of reasons).
Our holy sages, the Chazal tell us

אלא הלכות -
one who studies [at least two] Halachos daily is assured a portion in
Olam Haba - the world to come. (:מגילה כ"ח )

1) The
utensils being koshered should be dry before being inserted into the
pot of boiling water. (See Mogen Avraham Siman 452:9)
2)
L'Chatchilah, the entire utensil should be submerged in the boiling
water at one time. (See Taz Orach Chaim 452:5, Shulchan Aruch
HaRav 452:26 and Kitzur Shulchan Aruch Siman 117:16)
However,
if only half [or part] of the utensil was submerged and the other half
[or rest] of it was submerged afterwards, it is acceptable as long as
every single part of the utensil, including the handles, covers etc. was
submerged in the boiling water. (Shulchan Aruch Orach Chaim
Siman 451:14, 452:12 and Mishna Berura S"K 45 and 68. See also Shu"t
Minchas Yitzchak Vol. 5 Siman 81)

own, they are still for study purposes only, NOT for Psak Halacha.
On Shabbos, is one allowed to construct temporary structures
with legos or Magnetic toys such as magnetic balls and sticks?
Answer:
Legos, or
similar toys, whose pieces are temporarily put together, and do not
involve screws or other similar fasteners that can be permanent, may be
played with on shabbos according to most contemporary poskim (including
Rav Chaim Pinchas scheinberg, Tzitz
Eliezer and others)
