ברוך דיין האמת

We regret to inform you of the passing of Asher ben Taji, father of one of our daily readers, M.B.

Please have in mind when learning the halachos that they be L'Ilui Nishmaso, as a merit for his soul to have an Aliya in Gan Eden. May Hashem comfort M.B. and his family amongst the mourners of Tzion and Yerushalayim and may we all merit the speedy arrival of Mashiach Tzidkeinu and Techiyas Hameisim B'Karov!

1) Men and women are equally obligated in the commandment to honor and fear their parents.

However, a married woman whose obligations are to her husband is exempt from honoring her parents [when doing so will be in direct conflict to her husband's needs and wishes]. (Shulchan Aruch Yoreh Deah Siman 240:17 and commentary of the Shach.)

Many Rishonim (including the Sefer Chareidim Perek 12:3 ) rule that one is biblically obligated to honor parents in law (The Shulchan Aruch also rules this way and we will see more about this in detail in a few days iy"H).

According to these Rishonim, the question arises as to why then a wife must acquiesce to the wishes of her husband and not to her parents, if both the husband and the wife are obligated to honor her parents.(See Chayei Adam Klal 67:17 where he asks this and remains without an answer. See footnote to Sefer Chareidim ibid. where he deals with this question at length)

2) If a woman gets divorced her obligations to her parents are once again in full effect. (Shulchan Aruch ibid.)

QUESTION & ANSWER CORNER

Reader Submitted Questions of interest on topics related to Halachos we covered, as well as other interesting topic and Answers. Taken from the Q & A pages on the Halacha For Today website.

Although the answers I give to questions are taken directly from the Sifrei HaPoskim, and aren't my own, they are still for study purposes only, NOT for Psak Halacha.

Questions can be emailed to HalachaForToday@Yahoo.com

Reader's Question:

What is the halacha about a woman saying a kaddish quietly to herself in shul?

Answer:

Many Poskim allow for women to recite the kaddish quietly in the women's section at the same time that it is being recited by men in the men's section.

See Igros Moshe Orach Chaim Vol. 5 Siman 12:2 where Rav Moshe Feinstein Zatzal clearly writes that this was the minhag of old that women mourners came to shul to recite kaddish.

More recently, HaRav Ovadiah Yosef shlita also ruled that women may recite kaddish, if there are no men mourners, as long as a minyan of men are present and he writes that this ruling was based on such a psak by Poskim of the former generations such as the Shvus Yaakov, Chavas Yair and the Shu"t Teshuva M'Ahava, as long as it isnt done in the actual Shul but in her home or in the Ezras Nashim.
Our holy sages, the Chazal tell us
תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות
- one who studies [at least two] Halachos daily is assured a portion in Olam Haba - the world to come. (Talmud Niddah 73a)
