1) When washing the hands upon rising in the morning ( Negel Vasser) the cup should be held in the right hand and filled with water (or if it was already filled from the night before, it should initially be picked up with the right hand), then transferred to the left hand and the water poured on the right hand first. (Shulchan Aruch Orach Chaim Siman 4:10)

According to some Poskim, this applies to all washings of Netilas Yadayim throughout the day, and not just to Negel Vasser. (See Shu"t Be'er Moshe Vol. 2 Siman 3:3)



2) A left handed person follows the above mentioned order as well and washes the right hand first, as the primary reason the right hand is washed first is Al Pi Kabala, as we want the Ko'ach of the right hand (Chesed) to overpower the Ko'ach of the left hand (Din).(See Mishna Berura Siman 4:22 and Kaf HaChaim Siman 4:35)

[Regarding tying the left shoe first that you mentioned in the halachos of 11 Av 5770 ] should I assume that fastening a velcro strip on a shoe is treated like tying its laces? Also, would a zipper work the same way?

Answer:



There is actually a debate amongst the poskim if velcro is like tying or not.

Rav Menashe Klein Shlita in Shu"t Mishne Halachos Vol. 13 Siman 3 rules that it is best to be stringent and fasten the shoe that should be tied first even if the fastening is not being "tied" with laces.

1) After using the restroom, a right handed person should not use his right hand to clean himself. (Shulchan Aruch Siman 3:10)

One reason for this is that the right hand is used to tie the Tefilin onto the left hand, and thus should not be used for such an unclean task. Also, the right hand is used for eating, writing and pointing to Torah and other holy tasks. (See Talmud Brachos 62a, Aruch HaShulchan Siman 3:7 and Mishna Berura Siman 3:17)

Even when using the left hand, the middle finger should not be used as the strap of the Tefilin is wrapped around that finger. (Mishna Berura ibid. quoting the Shla HaKadosh)

A left handed person, who uses his left hand to tie the Tefilin onto his right hand, should use his right hand to clean himself and not use the middle finger. (Regarding an ambidextrous person, see Biur Halacha Siman 3 Dibur Hamaschil Yemin)

2) According to some Poskim, today's days when we have toilet paper, it isn't necessary to follow the above guidelines, and they maintain that it is better to use the stronger hand rather than risk soiling the hands by using the weaker hand. (See Shu"t Tzitz Eliezer Vol. 7 Siman 2:2. However, the Kaf HaChaim Siman 3:22 maintains that this is in effect today as well. Rav Chaim Kanievsky shlita also rules that it applies today as well.)

According to some Poskim, the above applies to women as well, even though they do not wear Tefilin, as there are other Kabalistic reasons for this as well. (See Ben Ish Chai Parshas VaYeitzei Siman 14 and Kaf HaChaim Siman 3:23. Other Poskim, including the Chida and the Har Tzvi, are lenient and rule that women need not be concerned with this and may use any hand)

[You wrote earlier that one who skips parts of pesukei D'Zimrah must say those things he skipped, after davening].

The Aruch Hashulchan rules that you should not repeat what you skipped during Pesukei Dezimra (saw it in the Aruch Hashulchan & heard [Rav...name of Prominent, accepted Posek shlita] tell someone this L'halacha).


Answer:



True, the Aruch HaShulchan Paskens like this, as does the Bach (Siman 52) and some other Poskim.

However, the following Poskim do indeed write that one needs to repeat everything they skipped if possible, and many contemporary Poskim pasken like this as well:

Chayei Adam Klal 19 Siman 5
Kitzur Shulchan Aruch Siman 14:7
Shulchan Aruch Harav Siman 52:1
Rav Chaim Kanievsky Shlita (Orchos Yosher page 95. Worth reading the entire paragraph)
Rav Simcha Bunim Cohen in his Sefer "Laws of Daily Living" (Page 304)

Although from the Mishna Berura it isn't clear how he paskens, the Chofetz Chaim does write clearly in his sefer Machane Yisroel (which he wrote for Jewish soldiers in the Russian army) Chapter 1:8 that it is worthwhile to say all the parts that you skipped. (Rav Chaim Kanievsky and others say that for those soldiers he was lenient and only wrote "it is worthwhile" while for regular yidden it is indeed a chiyuv to say all that was skipped.

Furthermore, I personally spoke to [aforementioned prominent accepted Posek shlita] regarding what you had told me you had heard from him.


He told me that he had never paskened not to make up the parts of pesukei D'Zimrah that was skipped. He said (as I told you) that it is a Machlokes haposkim with no clear Hach'ra'ah of how to pasken L'maaseh.

When I pressed him further for a psak halacha how I should be noheg L'Maaseh, he told me that if the skipped parts will be said with kavanah (which he clarified to mean equal to the kavanah that is usually present when you say it at the right time) it should be made up. But if it will be said very fast just "Abee" to make it up, it should not be davened like that.

Question: Do we really always get what we want?



What about when things don't work out?


Answer: That's why the next Posuk says: "Tzadik Hashem B'chol D'rochov, Hashem is righteous in all His ways"


We admit ourselves that Hashem knows what He is doing. And its all for our best whether we realize it or not!


That explains the juxtaposition of these 2 Pesukim.


I thought of this Pshat last year when I got [ name of a disease]. BH it went away fairly quickly...after only 3 weeks!

1) When cleaning the hands, the right hand should be washed first. (Mishna Berura Siman 2:7)

When showering or otherwise washing the entire body, the head should be washed first, as it is the king of all the limbs, and is then followed by the right hand, left hand, right foot left foot. (ibid. and Halichos Shlomo, Tefilah, Perek 2 footnote 30 in Dvar Halacha. See also Rambam Hilchos Dei'os Perek 4:16)

2) All of the aforementioned Halachos apply equally to righties and lefties. (See Mishna Berura Siman 2:6 and Siman 4:22. See also Shu"t Be'er Moshe Vol. 1 Siman 3:1)

Many Poskim are of the opinion that today's days it is not necessary to wash in any particular order. However, many Poskim do say that if possible to stick to this order it is still praiseworthy. (See Mogen Avraham Siman 2:4, Halichos Shlomo ibid.)

If throughout the day I constantly drink (sometimes sipping and sometimes a large amount) water and other liquids (minimum of several times per half hour), when do I (or should I) make a bracha acharona of borei nefashos?


Answer:



This is a very common, and complicated, situation which affects almost all people on a daily basis.

Here are a few basic guidelines with which to determine your personal status:

1) Borei Nefashos is only made if one eats a kzayis of food or a revi'is of beverage (except wine or grape juice, which needs a Al HaGefen), within a certain time span (between three and six minutes, depending on different Poskim)

2) Borei Nefashos should ideally be said in the place where you ate/drank immediately following the eating/drinking, but may be said in a different location as well, and up to 72 minutes after consuming food [though you have significantly less time after drinking. According to Rav Scheinberg Shlita you ony have 30 minutes after a drink, unless you have become thirsty again, in which case the first drink is no longer satisfying you, and then you cannot make a Borei Nefashos anymore, even if it's less than 30 minutes since you drank].

3) If one is not sure if he/she is required to make a Borei Nefashos, since it is M'Drabanan, it is best to not say it. (this applies to one who forgot if it was already said as well as to one who is uncertain if he ate/drank the minimum needed in the right amount of time to qualify for requiring the Bracha Achrona)

4) In the above case, where you aren't going to say Borei Nefashos, try one of the following things instead: 1) Eat another Kzayis of food/Revi'is of drink and then make Borei Nefashos on everything. 2) Ask someone else who is making a Borei Nefashos,to be Motzi you, and answer Amen 3) Think the words of the text in your mind without saying them, as this is acceptable according to the Chazon Ish based on the Rambam.

I hope these guidelines help you determine the right thing to do in your situation.

In his book on mourning practices, Gesher Hachaim, Rabbi Yechiel Michel Tukachinsky used the following parable to explain the Jewish view on life after death:

Twin brothers, fetuses in their mother's womb, enjoyed a carefree life. Their world was dark and warm and protected. These twins were alike in all aspects but one. One brother was a 'believer': he believed in an afterlife, in a future reality much different from their current, miniature universe.

The second brother, however, was a skeptic. All he knew was the familiar world of the womb. Anything besides what he could feel and sense was only an illusion. The skeptic tried to talk some sense into his brother. He warned him to be realistic, but to no avail. His naive brother insisted on believing in an extraordinary world that exists after life in the womb, a world so immense and fantastic that it transcends their wildest dreams.

The months passed, and the fatal moment arrived. Labor began. The fetuses became aware of tremendous contractions and shifting in their little world. The freethinker recognized that 'this is it.' His short but pleasant life was about to end. He felt the forces pressuring him to go down, but fought against them. He knew that outside the womb, a cruel death awaited, with no protective sack and no umbilical cord. Suddenly, he realized that his naive brother was giving in to the forces around them. His brother was sinking lower!

"Don't give up!" he cried, but his twin took no heed. "Where are you, my dear brother?" He shuddered as he heard the screams from outside the womb. His poor brother had met his cruel fate. How naive he had been, with his foolish belief in a bigger, better world!

Then the skeptic felt the uterine muscles pushing him out, against his will, into the abyss. He screamed out ...

"Mazal Tov!" called out the doctor. "Two healthy baby boys!"

DOUBLE PORTION L'KAVOD SHABBOS KODESH


Halachos for Erev Shabbos Kodesh

1) When putting on an article of clothing, it is proper to hold both sides of the garment in the right hand and then put on the right side and then the left side. (Mishna Berura Siman 2:4. See Sha'ar HaTziyun Os 10 that this is based on kabalistic teachings which tell us that the "right" is the side of Rachamim, heavenly compassion and the "left" is the side of din, heavenly Judgment, and thus when we initially place the entire garment in the right hand, we bring compassion to the entire garment, even the left side. See also Kaf HaChaim Siman 2:7)

2) There is no differentiation between righties and lefties regarding this Halacha, as it has nothing to do with any hand, rather with a "side" of heavenly compassion which is the same for all people.



Halachos for Shabbos Kodesh

1) Some people (common in Chasidic circles) are stringent, based on the kabalistic reasons cited above, when buttoning their shirts, jackets or coats to make sure the buttons are on the left side and the button holes on the right side to ensure that the right side of the garment lays on top of the left side.

Women's clothing are usually manufactured this way, while men's clothing are usually manufactured the opposite way, and need to be custom made [or bought in Chasidic clothing stores] in order to adhere to this kabalistic custom. (See Shu"t Teshuvos V'Hanhagos Vol. 1 Siman 453. See also Orchos Rabbeinu page 227 that the Chazon Ish Zatzal and the Steipler Zatzal were very makpid on this.)

2)Here too, there is no difference between righties and lefties, and if one is stringent with this he should have the buttons on the left side even if he is a lefty.

Can one make the brocha for Shabbos lights over an electric light or lamp ?


Answer:


This is a huge Machlokes HaPoskim ranging back to when electricity was discovered!

Many Poskim (Shu"t Bais Yitzchok Yoreh Deah Siman 120, Rav Tzvi Pesach Frank in Shu"t Har Tzvi Orach Chaim Siman 143, Rav Moshe Feinstein, Rav Ovadia Yoseph and others),permit using an electric lamp in place of candles for Hadlokas Neiros on Shabbos, based on the fact that electric lights satisfy the 2 reasons that we light Shabbos candles in the first place: (1) Shalom Bayis (a house without lights isn't harmonious) and (2) Oneg Shabbos (a dark home isn't conducive to an enjoyable Shabbos).

Many Poskim even allow a Bracha on electric lights for Shabbos, while others say you may light it L'Kavod Shabbos but not make a Bracha on such a lighting.

Rav Shlomo Zalmen Auerbach Zatzal differentiated between a lamp that runs on electricity from the main power plant (which he held not to make a Bracha on) and a flashlight or lamp that runs on batteries (in which case he held you may make a Bracha, as the battery is like the "oil" of a candle, whereas by regular electricity it is being added by the city every second, and isn't really here when you make the Bracha)

Obviously this should only be relied upon in emergency situations when candles or oil isn't available, or in special situations where they cannot be kindled (in hospitals, hotels etc.)

Also, when relying on this, one must have in mind when turning on the electric light that it is for the sake of Neiros Shabbos.

Of course, A Rav should be consulted for Halacha L'Ma'aseh.

Reaching The Heavens!

In our modern generation, we are consumed with a desire to hold the entire World in the palm of our hand! In a flash, we know what is doing in China and what styles they are wearing in Paris. We pick up a phone and we are connected in an instant to a relative on the other side of the globe!

'De'iah' - knowledge is a form of control. When we learn something new, when we visit a new place, travel great distances, we feel as though we have conquered and achieved a certain measure of control.

Why are we conditioned this way?

There is a concept in physics, that no matter how many times a certain element is manipulated and re-formed into new creations, it can always be reversed back to its original state.

Chazal teach us that Adam Harishon, the first human being was as tall as the entire World! - "Misof Ha'olam ad Sofo"! His feet were on the ground and his head literally and figuratively, reached the heavens! He dabbled in lofty pursuits and lived with Hashem! However, after he sinned, Hashem cut him down to size and "minimized" him.

Subsequently and for all time, the Human race was destined to become smaller and weaker in physical and spiritual stature! However, our intrinsic characteristic which is part of our genetic makeup, is to reach from the Earth up to the Heavens above! This internal quality, is the reason that we feel so restricted when we are confined to a small space (Jail, etc.)

A chicken never feels restless in his small chicken coop! However, a Human being feels like he needs to 'see the World' and experience the entire World in the palm of his hand! We are merely exchanging the dimension of our already internal makeup! Instead of striving to reach the Heavens with lofty pursuits (and recognizing that in so doing, we are experiencing quite literally - the beauty of the entire World - Hashem!), we have simply fallen flat on our faces and have re-invented our intrinsic quality of "Misof Ha'olam ad Sofo", to reach from one side of the world to another - horizontally!

Take Shabbos as an example. For those who lack an appreciation of what Shabbos means and how it nourishes and enriches our lives, it is like a day spent in Jail! So many restrictions and limitations!! Like death itself! We want to 'travel', to turn on the radio, the tv, ......we wish to see "what's doing in the world"

But alas, we cannot!
This frustration stems from the fact that we are living our misof ha'olam ad sofo in the horizontal position! We have fallen on our faces!

Get up and reach the Heavens!! Live a Shabbos in the embrace of Hashem! Throw away the newspapers and televisions for a day (at least) and see how you can conquer the entire universe by living with the Creator of the Universe!!

1) When putting on shoes in the morning, the Shulchan Aruch (Orach Chaim Siman 2:4) teaches us the proper order as follows:

The right show should be put on first but not tied. The left shoe should then be put on and tied and then we go back to the right shoe and tie it.

If the shoe is a slip on shoe, then the right shoe is put on first followed by the left shoe. (Rama ibid.)

The reason for putting the right shoe on first is to show that the Torah always gives Chashivus, deference, to the right. Thus, a left handed person should also put on the right shoe first.

The reason that the left shoe is tied first, however, is because in matters of "tying" the Torah gives deference to the left, as Tefilin are tied on the left arm. (Mishna Berura ibid. S"K 5 and 6)

Thus, a left handed person who ties his Tefilin on the right arm should indeed tie the right shoe first and then proceed to put on and tie the left shoe. (Mishna Berura ibid.)

Regarding a left handed woman, who does not tie Tefilin on her arm, there is a dispute amongst the Poskim if she should tie the right shoe first like a left handed man or her left shoe first since the Tefilin comparison doesn't apply to her. Rav Chaim Kanievsky Shlita (in Sefer Derech Sicha Parshas V'Eschanan, page 517) rules that left handed women are like left handed men and they tie their right shoe first (See also Shu"t Avnei Yashfe Vol. 1 Siman 1 and Shu"t Rivevos Ephraim Vol. 1 Siman 5 and Vol. 7 Siman 18. See also Shu"t Shevet Hakehasi Vol. 1 Siman 6.)
2) When removing shoes, the left one should be taken off first. This applies to left handed people as well. (Shulchan Aruch Orach Chaim Siman 2:5 and Shu"t Be'er Moshe Vol. 2 Siman 3:1)

We are having an air conditioner problem in our shul. The solution is to brick up a very old door, which has not been used as a door for 20+ years and put an a/c unit there. Is it permissible to brick up this door?


Answer:

According to Rav Yehuda HaChasid in His famous Tzava'ah (will) Siman 20, one should not totally close up a door or a window. If it is left open a little bit or a small hole made in it, it isn't an issue.

See also Sefer Chasidim Siman 1146 and 461 that doing this will block the passageway of the Sheidim and cause them to find a different route which may result in harm befalling the inhabitants of the home.

There is an opinion in the Poskim ithat this does not apply to a Bais Medrash or Bais HaKneses, so if you cannot leave a small opening it is possible that you are Ok anyhow.


A Rav should be consulted for Halacha L'Ma'aseh.

The most difficult Nisayon (trial) of the Asara Nisyonos (the ten trials that Avraham Avinu was subject to) was Akeidas Yitzchak.



One of the hard parts of the Nisayon was when Avraham Aveinu was so willing and ready to do what Hashem wanted and then suddenly Hashem said "Al Tishlach Yadcha El Hanaar"... and asked him to NOT complete the slaughtering of Yitzchak and instead slaughter the ram...



There are certain times in our life when we are ready and willing to do a mitzvah and then Hashem says STOP, do something else instead.



For example: A person has the opportunity to do Kibud Av V'eim to its fullest and take care of their elderly parents when they are older and sick, and then Hashem decides that [their time is up and ] they should go to the Olam Ha'Emes, and it's hard because the children are so ready and willing to continue to care for the parent...but Hashem says STOP...

Sometimes we'll be Mevaker a Choleh and really have our heart into the mitzvah and then the Choleh is niftar (passes away)...it's so hard not to be able to do that mitzvah for them anymore...but Hashem says STOP, do something else instead...

It may be very hard but it's Ratzon HaShem (the will of G-d) and is what Hashem wants at that time.

And that's all that matters.

NEW TOPIC: HALACHOS OF RIGHT HANDED/LEFTHANDED PEOPLE


INTRODUCTION:


Most people in the world are "right handed", commonly referred to as "righties".



A small percentage of people, however, are "left handed", commonly referred to as "lefties". (According to Wikipedia, seven to ten percent of the adult population is left-handed).



There are people who are ambidextrous, meaning they can use both hands equally well.



What does this have to do with Halacha?



Plenty.



There are many Mitzvos which must be done with the hands, and the question arises which hand to use? Is it always the right hand? Is it always the strong hand? Does it even make a difference?



We will now embark on a study of this topic and hopefully come away with some clarity in this often misunderstood subject.



Maran HaGaon Rav Chaim Kanievsky Shlita published a small Sefer titled "Ish Iter- The left handed person" which briefly covers these Halachos. I am using that Sefer as my starting point and guide for these Halachos and hope to B'Ezras Hashem expand upon what is written there in more detail. Anything I write without any additional source is taken directly from Rav Chaim's Sefer.



As an introduction, before we begin to cover the actual Halachos, we will enumerate the 8 categories into which Rav Chaim Kanievsky Shlita divides all the Halachos of Mitzvos needing a certain hand or direction.



Hopefully by understanding the logic behind these 8 categories we will be better able to grasp why each Halacha we will learn has been determined to be that way by the Poskim.



1- Certain Mitzvos require a person's stronger hand. These Mitzvos are determined by each individual's strength and not based on the majority of people.



2- Certain Mitzvos must be done "to the right" of Hashem. These Mitzvos are of course done with the left hand by all people regardless of their particular stronger hand.



3- Certain Mitzvos are done to a certain side due to the position of a person's heart, windpipe, ear etc. Here too, there will be no difference between righties and lefties.



4- Certain Mitzvos require the more "Chashuv, respected" hand. As we shall see, these Mitzvos are subject to a debate amongst the Poskim if "Chashuv" is determined by each individual or if it is determined by the majority of the world.



5- Certain Mitzvos require the right hand because the Torah specifically writes "Use the Right hand". Seemingly, these Mitzvos must be fulfilled via the right hand for all people. We shall see if there are differing opinions to this.



6- Certain Mitzvos are done not necessarily with a certain hand per se , rather "to the right side" based on the concept of " Kol Pinos Sh'Ata Poneh YihYu Derech Yemin, Whatever you do, do it to the right side". We shall see if lefties perhaps do these things to the left.



7- Certain Mitzvos are fulfilled only while standing opposite another person. We shall see if the Mitzvah is done with the hand that is opposite the right side of the other person or not.



8- Certain things need to at times be held in a certain hand to allow the other hand to remain free for another task. We shall see how this affects left and right handed people.

Is there a source for knocking before entering one's house?


Answer:

Yes, this is stated in a Mishna in Maseches Derech Eretz Rabbah Perek 5 and brought in Talmud Pesachim 112a and in Nidah 16b that Hashem despises those who [habitually, according to the commentary of the Ya'avetz] enter any home (even their own) suddenly, without knocking.

R' Yochanan said in the name of R' Shimon Bar Yochai, "From the beginning of creation no one thanked Hashem until Leah, when she had her 4th child and she called him Yehudah which means thanks, said Hapam Odeh Es Hashem." (Talmud Brachos 7b)


The Torah says after she had Yehuda that she stopped giving birth (at least for a while), I heard an explanation that giving thanks is as if you're saying to Hashem thank you very much, I can take it from here I don't need anything more.

So Hashem stops giving more.

Rather one should give thanks but then say I still need you. That's the reason we say Sim Sholom after Modim, that after we give thanks we continue asking Hashem for peace, life, kindness etc.

Whoever mourns the destruction of Jerusalem will merit seeing its rejoicing. Talmud Bava Basra 60b

1) On Tisha B'Av it is customary to limit one's pleasures as much as possible. Some people have the custom to sleep with a stone under their pillow, to make their sleep uncomfortable.
(See Toras Moshe from the Chasam Sofer Bereishis 28:11 where he writes that the day that Yaakov Avinu slept on the stone was Tisha B'Av)


Many people simply sleep with one less pillow than they are accustomed to. Each person can do whatever it is they feel would minimize their personal comfort, and thus satisfy the spirit of Aveilus.



From nightfall of Tisha B'Av until Chatzos (midday, around 1:00 pm ) we do not sit on chairs that are higher than 3 Tefochim (between 9 and 12 inches depending on whose measurements you follow, though the Chazon Ish and Steipler were not makpid on the exact measurement in this case, and just sat on a low stool). Some have the custom to sit directly on the floor.

Though sitting on regular chairs is permitted after Chatzos, the other prohibitions of Tisha B'Av (eating, washing etc.) are prohibited all day until nightfall of the 10th of Av.

Tefilin are not donned at Shacharis on Tisha B'Av; rather they are worn at Mincha.


The special Bracha of "Nacheim" which asks Hashem to comfort us from our state of mourning is inserted into the Bracha of "V'LiRushalayim Ircha" in the Shemona Esrei of Mincha. It should be said with deep Kavanah (concentration)


2) Kiddush Levana is recited after Maariv on Motzaei Tisha B'Av, but should only be recited after breaking the fast. Women do not say Kiddush Levana (ever). It is best to say Kiddush Levana with a large Minyan (B'Rov Am Hadras Melech), but B'dieved it may be recited with just another person there or even alone if no one is around.

All the Halachos of the nine days (meat, wine, music, cutting hair etc.) are in effect until after midday of the tenth of Av. One who abstains from the above for the entire day (even past midday) is blessed.

It is proper to refrain from marital relations on the night of the tenth of Av, unless that is the night of Tevilah.

If one says Tehilim daily, is one permitted to recite the daily tehilim portion on Tisha B'av?


Answer:

No, it is best not to say Tehilim on Tisha B'Av (unless it's being recited for a sick person).

If one says a chapter daily, he should say an extra one either the day before or the day after Tisha B'Av to make up for the one skipped on Tisha B'Av. (See Mogen Avrohom Siman 554:6 and Shu"t Rivevos Ephraim Vol. 3 Siman 433 quoting Maran Rav Moshe Feinstein Zatzal)

A STORY OF TRUE FRIENDSHIP by Rav Noach Weinberg Zatzal



At the time of the Roman Empire, two Jewish boys had grown up together in Israel and become very close friends. After awhile, they moved far apart - one living under Roman control, and the other living under Syrian control. Yet they remained very close friends.


One time, when the fellow from Rome was visiting in Syria, someone falsely accused him of being a spy. So they brought him to the Syrian Emperor, and he was sentenced to death.


As he was being led out to be executed, they asked if he had any last requests.


"Please, let me go back to Rome to settle my affairs and say goodbye to my family. Then I'll come back and you can execute me."


The Emperor laughed. "Are you crazy? What guarantee do I have that you'll come back?"


The Jew said, "I have a friend here in Syria who will stand in for me. He'll be my guarantor. If I don't come back, you can kill him instead."


The Emperor was intrigued. "This I've got to see. Okay, bring your friend."

The Syrian Jew was called in. Sure enough, he agreed to take his friend's place in prison, and be killed instead if the friend did not return.


The Emperor was so startled by this arrangement that he agreed to let the Roman Jew go. "I'll give you 60 days. If you're not back by the dawn of the 60th day, your friend is dead."


The Roman Jew raced back to say goodbye and put his affairs in order. After a hectic time and a lot of tears, he started back in plenty of time before the 60 days were up. But those were the days of sailing galleys, and sometimes you could sit for days waiting for the right wind to come. As luck would have it, there was no wind for several days, the sailboat was delayed, and by the time the Roman Jew arrived in Syria, dawn of the 60th day was breaking.


As agreed, the jailors took the Syrian Jew out for execution.


In those days, an execution was a gala affair. Early in the morning the crowds began to gather. Finally, as they were just about to perform the execution, the Roman Jew came running in. "Wait! I'm back. Don't kill him!"


But the Syrian Jew protested: "You can't kill him. He came too late. I'm the guarantor. You've got to kill me instead!"


Each friend was equally adamant. "Kill me!" "No, kill me instead!" The executioner didn't know what to do. The crowd was in an uproar!


Finally, the Emperor was called. In wonder and amazement, he turned to the two of them and said, "I'll let both of you go free on one condition. That you make me your third friend!"



THE ULTIMATE THIRD FRIEND


The Jewish king Ahab, despite the fact that he was evil, was more successful in battle than any other king. Why? Because under Ahab, the Jewish people were united. Unity is the quality God wants most for His children. If we're united, we have the power of God behind us.


Conversely, when the Jewish people are fighting internally, we forfeit God's power.


Strife within the Jewish people is therefore the most insidious and debilitating enemy. It takes us from being the predominant force which can turn the world toward God, and reduces us to an impotent collection of self-absorbed individuals.


That's why the verse "Love your neighbor," concludes with "I am God." Because unity and friendship is so precious that even God wants to be part of it. He wants to be the third friend.


If we're united, the Almighty's with us. If we're divided, we're on our own.

Whoever mourns the destruction of Jerusalem will merit seeing its rejoicing. Talmud Bava Basra 60b

1) Smoking cigarettes/Cigars is prohibited on Tisha B'Av. Some authorities allow it after Chatzos (midday) if done secretly. (Many contemporary Poskim prohibit smoking altogether, even the rest of the year. See Q&A # 542 here )


Even one who will not be fasting on Tisha B'Av (for halachically acceptable medical reasons) should still partake of the Seudah HaMafsekes (the final meal on the eve of the fast)(Halichos Shlomo Perek 15:2)


2) Non leather shoes that are very comfortable (such as cozy slippers, air sneakers, crocs, etc.), although M'Ikar Hadin they may be worn on Tisha B'Av, there is valid Halachic room for stringency to avoid wearing them. The Chazon Ish and other Gedolei Yisroel would not wear any shoes on Tisha B'Av and spent the day
in socks or with very thin footwear only so that they would "feel the floor". (See Halichos Shlomo Perek 15:4. Rav Moshe Sternbuch shlita and Rav Nisim Karelitz shlita also rule as such and say that a Yerei Shomayim should avoid shoes that are worn all year round for comfort, even if they aren't leather)


Even those who are more lenient on Yom Kippur and wear comfortable non leather shoes, should be more stringent on Tisha B'Av as we try to minimize comforts on Tisha B'Av as much as possible. (Halichos Shlomo Perek 15 footnote 5 quoting the Sha'arei Teshuva Siman 554:11 and footnotes Orchos Halacha there 19-21)

Answer:

If it isnt an expensive gift it may be given (to a spouse, or to anyone else) during the 9 days, except for on Tisha B'Av itself, where it is prohibited to give gifts. ( See Mishna Berura Siman 554:41 and Shu"t Mikdash Yisroel Siman 83)

QUESTION:

Who needs the Bais Hamikdash if there is Olam Habah?

ANSWER: (by Rav Avigdor Miller Zatzal):






And the answer is. Who needs Olam Hazeh if there is Olam Habah? The answer is, Olam Hazeh is the place where you have opportunity. You know, when Reb Elazar Hagadol was about to pass away, the Talmidim came to him. They said, Rabainu Lamdainu Orchos Chaim, teach us the ways of life. He told them a few things. The first thing he told them is, Hizaharu B'chvod Chaveraichem, be careful with the honor of your fellow Jew. That's the number one! You hear? A man, just before he is dying, and he is giving instructions to his Talmidim. Number one on the list, Hizaharu B'chvod Chaveraichem. Be careful with your friends, your wife and your husband, with your neighbors, with your Chaveirim, Hizaharu. That's so important.

Now we know why we have friends and neighbors, why you are married. It's all to test you. Hakadosh Baruch Hu wants us to utilize the opportunity. Not everybody is easy to deal with, and even the best people, sometimes are not so easy to deal with them. And we have to always keep in mind, that's our perfection. That's your Sh'laimus, if you know how to deal with people. Be careful with the honor of your fellow Jew, and of your husband, and of your wife, and of others. Don't talk against them. Your mother in law, your daughter in law, your Mechutonim, Hizaharu, be careful with everybody's Kavod. That's the number one requirement of a Jew, and that's why we are in this world. So why did Hashem make our fellow man? To test us. Why did He make some people stubborn? Some people Akshanim, Balei Gaivoh? To test us. You can get along with them? That's your Sh'laimus, everything in the world is to make you better.

Now, The Bais Hamikdash was one of the most glorious opportunities to become better. If you can walk in the Bais Hamikdash in the olden days, and you can see how Kohanim B'avodosam, how the Kohanim served Hashem, you would actually feel that Hakadosh Baruch Hu lives in this house. You know what a feeling that is? Hakadosh Baruch Hu is Shocain Babayis Hazeh, that's Emunah, to gain a feeling which is true. Hashem dwells among the Bnei Yisroel, Ha'Shocain B'toch Bnei Yisroel. If you have a building where Hashem lives, that's His address where you bring offerings to Him. The Emuna Chushis, the real feeling of seeing Hashem's home, that you get by seeing the Karbanos, and the way the Karbanos are served with Yirah, with great fear by the Kohanim. The greatest kind of respect in every little detail, and it had an impression on those that saw it that lasted forever. You went away from the Bais Hamikdash, and their minds were changed forever.

And so we gain Emunah from the Bais Hamikdash. And now we mourn, we weep for that lost opportunity. So now what do you do? Now you have to do other things, whatever you can to gain Emunah. And therefore when we talk about the loss of the Bais Hamikdash, it's a loss of opportunity to become great. Today there are other opportunities. Yes! Learn Torah, learn Mesillas Yesharim, learn Chovas Halvavos, absolutely, there are ways of becoming great today too. And therefore when people utilize these ways, Hashem says, I'll give you credit as if you had a Bais Hamikdash, and if you utilize it properly, to make the preparation that you are supposed to prepare in this world for your career in the world to come.

For the next few days, we will hold off on beginning our next new topic and instead focus on some Halachos of Tisha B'Av. Though a lot of what we will learn has been covered before (and can be found in the archives written 2 years ago) I have added some new content as well.


These Halachos of the next few days may be studied on Tisha B'Av itself.





1) There are five main things that bring a person enjoyment, and are therefore prohibited on Tisha B'Av:

#1) Eating /Drinking (this includes brushing teeth and rinsing the mouth with water)

#2) Washing one's body [or hands or face] for pleasure, even in cold water (Washing the hands upon waking and after using the bathroom is permitted, but only until the knuckles of the hands should be washed)

#3) Smearing soap, oil, lotion, cream etc. for pleasure. (If necessary for medical reasons, it isn't prohibited. Likewise, deodorant may used to prevent or eliminate odors)

#4) Wearing leather shoes (Even if only part of the shoe is leather)

#5) Marital relations (It is best to be stringent and avoid sharing a bed or even touching one's spouse on Tisha B'Av)

2) On Tisha B'Av it is forbidden to learn Torah since learning Torah brings happiness, as the Posuk states Pekudei Hashem Yesharim, Mesamchei Lev (Tehillim 19) and on Tisha B'Av all Jews assume the status of mourners, and thus are prohibited from doing activities that bring happiness.


It is, however, permitted to learn certain sad topics that remind us of our bitter Galus (e.g. Certain parts of Sefer Yirmiyah, Midrash Eicha, the Agaddah in the fifth Perek of Gittin (Starting from 56b) or the Yerushalmi at the end of Taanis that deals with the Churban etc. See Shulchan Aruch Yoreh Deah Siman 384:4)

Even when learning these permitted topics, they should not be learned B'Iyun, with too much depth, rather just enough to understand and internalize what is being learned. (Mishna Berura Siman 554:5)



The prohibition to learn begins on Erev Tisha B'Av after Chatzos. However, one may learn the permitted topics B'Iyun on Erev Tisha B'Av, as only on Tisha B'Av itself do we limit the depth allowed.(See Halichos Shlomo Perek 15:1)

My wife has cleaning help once a week. The day that is her turn falls out on Tisha B'Av. If she doesn't work this day, it will be extremely hard on my wife not to have this help until the following week. Is it permitted for the cleaning help to work on Tisha B'Av?


Answer:


Yes, a non Jew may work in a Jewish home on Tisha B'Av, as long as it is inside the home (cleaning, painting, electrical work etc.) and not work being done outdoors (painting the exterior of the home, gardening, mowing the lawn etc.) which is prohibited. (See Mishna Berura Siman 554:45 and 46)

The Funeral Director

Last Thursday, I was informed of the death of a woman who I did not know.
She was relatively young, only 64 years old.
She left behind three sons and grandchildren.
It was a stifling, steamy hot humid day; the temperature was hovering over ninety degrees.
The funeral was held in Far Rockaway.
I drove out from New Jersey to officiate at the funeral of a woman I never knew.

At the conclusion of the funeral, I asked the funeral director- who was Jewish, and was also driving the hearse containing the nifterres (the deceased)-if he (as they usually do) has a knife for the kriah (ripping of the garments).
He handed me the knife, I helped the mourners with the kriah and returned the knife to the funeral director.
We continued to the cemetery in Elmont, New York for the burial.

As we arrived at the cemetery we proceeded to carry the coffin to the grave and we commenced the burial.
Everyone took turns with the shovels and we all assisted each other in the burial of the nifterres.

The day was stifling hot and most of the men removed their jackets as their brows were filled with sweat and their pants became dirtied as the hot dust swirled around.

The sons and the sisters of the nifterres were overcome with grief.
All of us were exhausted and spent. We were drained both emotionally and physically.

We felt the heat of the sun and the pain and grief of the mourners.
It was an emotionally laden experience.

As the levaya came to a conclusion, we proceeded back to our cars.
As I sat down in my car I was drained and weary from the events of the day.
Every funeral is painful; every levaya is filled with grief.
However, perhaps because of the heat and because of the relative young age of the nifterres- I was tired and wasted.

Suddenly, I look up and see the funeral director standing at my car window.
As I look at him he says, "Did you give me back my knife? It's the only one I have and I cannot find it."
I felt terrible at the thought of not returning his knife and began to search my pockets.
I said to the fellow, "I cannot find the knife, I am so sorry. I will replace it for you".

About ten minutes later after everyone had retuned to their cars and we were about to exit the cemetery, I realized that I better get the address of the funeral director to send him a new knife.

As I approached his car, I apologized for losing his knife. He said in what appeared to me to be in complete seriousness, "Don't worry, I have a whole list of problems with you!"

I was stunned.
I had just met this man about two hours ago. Our interactions seemed to me to be limited to my borrowing his knife. Was there something I had said or done during the funeral which had offended him? My mind was racing in its attempt to figure out what I did to offend this man that he now has a 'list' of things which he has a 'problem' with.

I looked at him and said with total supplication, "I am so sorry, please tell me what I have done to offend you?"
His face broke into a broad smile as he said,

"Oh, I 'm just kidding around. You have done nothing to offend me and don't worry; I found my knife, you gave it back to me.
I like to joke around with people.
By the way here is my card and I am licensed in New Jersey as well".

I smiled meekly as I took his card and returned to my car.
As I sat down, I realized I was shaking.

"What's wrong with this picture?" I asked myself.
We have just completed burying a 64 year old mother of three.
It is about 100 degrees outside.
We are all exhausted and our clothes and shoes are filled with the dust of the earth after burying a Jewish mother, and this man informs me that, "I like to joke around with people"!

I also like to 'joke around'.
However, as Shlomo HaMelech taught in Koheles 3:4:
(There is...) "A time to weep and a time to laugh; a time of wailing and a time of dancing."
This was not a time 'to laugh'!

After thinking about this on the drive home, I realized that because this man is always involved in death and burial he has become hardened and no longer is touched by the tragedy of death which to him is a regular part of life.
Death has become the norm in his life.

As I drove on, I thought of the fact that we are now in the midst of the Three Weeks (and now the Nine Days) - the time of national mourning for the Beis HaMikdash.

How do I find it possible to 'joke around' today?
How can I crack a smile and a laugh when I'm supposed to be in the midst of mourning for the destruction of both Batei Mikdash?
Am I not exhibiting the exact same callous and caviler behavior which I found so distasteful in the funeral director?
How can I smile and 'kid around' when at this time of the year, thousands and thousands of Jews were being killed and ultimately the Beis HaMikdash was destroyed?

Have I become as casual and cavalier in my reactions to death as the funeral director?

As I drove on I stopped feeling so smug about myself and so scornful of the funeral director and I started feeling more and more ashamed of myself for my lack of feeling.
Have I become unmoved because of the fact that I have lived every day of my life without a Beis HaMikdash?
Is my skin no longer responsive to the pain of the nation?
As I drove, I felt sadder and sadder; not so much for the nation but, rather, for me.

I was saddened by the realization that the Churban (destruction) has become routine in my life; something standard and unexceptional and most troubling, almost natural.

As the realization hit home, I pulled over to the shoulder of the highway and I cried.
I cried not for the Beis HaMikdash; and not for the destruction of Yerushalayim.

I cried for me, and for the realization that I too had become a funeral director.

DOUBLE PORTION L'KAVOD SHABBOS KODESH

Halachos for Erev Shabbos Kodesh

1) If one has the Mitzvah of Bikur Cholim to perform and also the Mitzvah of Nichum Aveilim (comforting a mourner), and he has the time to accomplish both, the Bikur Cholim should be done first, as tending to the needs of the sick person and davening for him/her will "give life" to them. (See Shach Yoreh Deah Siman 335 S"K 11)

If, however, only one of the two can be performed, Nichum Aveilim takes precedence, as it is considered a kindness with both the living and the deceased. (See Rama Yoreh Deah Siman 335:10 and Rambam Hilchos Avel Perek 14:7. See commentary of Radvaz to the Rambam there where he seems to argue and maintains that Bikur Cholim should always take precedence, as abstaining from Bikur Cholim is tantamount to "spilling blood")

2) If any one individual's visit will have a special significance to the sick person (e.g. an extremely close friend or a dignitary or if the visitor brings with him food or medicine that will surely serve to improve the sick person's situation.) then Bikur Cholim will take precedence in this instance over Nichum Aveilim, even if there is no time to accomplish both. (Aruch HaShulchan Yoreh Deah Siman 335:12)



Halachos for Shabbos Kodesh

1) Bikur Cholim is best done in person, as many of the aspects of Bikur Cholim can only be accomplished when one is physically in the presence of the Choleh.

However, if one cannot visit a sick person, there is still good reason to call them on the telephone to do Bikur Cholim, as certain aspects can still be accomplished from afar. (See Igros Moshe Yoreh Deah Vol. 1 Siman 223 and Shu"t Minchas Yitzchak Vol. 2 Siman 84)

2) The Mitzvah of Bikur Cholim applies even to sick people who are ill with a sickness that can be contagious. Of course the visitor should maintain some distance to avoid getting affected. (See Shu"t Rama Siman 20. See also Chofetz Chaim in Ahavas Chesed Bikur Cholim Perek 3 end of footnote Dibur Hamaschil Isa B'Nedarim that the zechus of the Mitzvah of Bikur Cholim will protect him from becoming ill.)

If, however, the disease is highly contagious to the point that it is almost certain that any visitors will get affected (as is sometimes the case R"L that patients need to be isolated in a sterile room) there is no obligation to go and visit, as the Torah does not require one to put himself in clear danger to fulfill the Mitzvah. (See Mishna Berura Siman 329:19 where he writes that one shouldnt be overly cautious either.)

Of course, other aspects of Bikur Cholim that do not require physical contact (such as davening for them, calling them on the phone etc.) still apply.

Does the prohibition of eating meat during the nine days apply in the same way to a child who is 5 years old? If not, is it nontheless better for children not to eat meat at this time?


Answer:

A child who reached the age of chinuch of understanding what the churban Bais hamikdash is (around 7 years old) may not eat meat or drink wine during the 9 days. a child under 3 years of age may eat meat.

A child older than 3 but not yet of chinuch age, according to many Poskim may eat meat, while according to other Poskim (including the Mishna Berura Siman 551: 70) may not eat meat if he is healthy.

Chizuk For Today:




When Bil'am's was on his way to Midyan and his Donkey saw the Malach in the middle of the road he stopped. This happened three times and each time Bil'am hit the donkey.

When the Malach finally revealed himself to Bil'am he criticized him for hitting his donkey. Why was this warranted? If a donkey stops while you are riding doesn't common procedure call for you to hit it to induce it to continue on.

The holy Kedushas Levi , Rav levi Yitzchok of Berditchev, answers that we all know that everything that happens in this world is caused by Hashem.

Certainly Bil'am , a prophet, knew that and believed it. If our eyes are wide open we can see many signs from Hashem and know if he is pleased with our actions.

Before Hashem gave Bil'am lukewarm permission to go to curse Am Yisroel he warned him that even though he has permission to go nevertheless Hashem will be running the show and only His will, will prevail.

This should have put Bil'am on high alert to take note of any unusual occurrences and signs from Heaven. When his donkey mysteriously stopped three times, which was something very unusual, Bil'am should have taken it as a sign from Hashem not to go.

Even after that, Bil'am stubbornly refused to interpret this obvious sign as Hashem's way of telling him that he should not continue on his doomed mission.

Therefore the Malach criticized him.

Hashem often sends us signs and knocks on our door to "Awaken us" .

WE MUST OPEN OUR EYES AND SEE THE SIGNS!!!

Our holy sages, the Chazal tell us

Whoever mourns the destruction of Jerusalem will merit seeing its rejoicing. Talmud Bava Basra 60b




1) If there are two people in a city who are on their death beds, one of them is a righteous or average person (Tzadik, or a Beinoni) and the other one is an evil person (Rasha) and they both require someone to say Vidui with them before passing away, the Rasha takes precedence.

The reason for this is that the Rasha definitely transgressed sins for which there is no atonement besides death, and thus surely requires the Vidui in order for his death to facilitate atonement, while the Tzadik or Beinoni may have received Kapara via yesurim (physical or other earthly afflictions) or other methods while alive, and did not necessarily transgress any sins for which only death can atone. (See Hagahos Chochmas Shlomo from Rav Shlomo Kluger Zatzal to Yoreh Deah Siman 338:1)

2) Although there is no Mitzvah of Bikur Cholim to visit non Jewish sick people, it is still the accepted custom to visit them to avoid animosity (Mipnei Darchei Shalom) (Shulchan Aruch Yoreh Deah Siman 335:9)

I wanted to know if a woman who gave birth 3 weeks before 9 of Av, and nursing has to fast on Tisha B'Av?


Answer:

A nursing mother [as well as a pregnant woman] must fast on Tisha B'Av. (Shulchan Aruch Siman 554:5)

If doing so will harm the child, a Rav must be consulted.

For the first seven days after giving birth, a woman may not fast.

From day 7 until day 30 after the child is born (as is your case), a Rav must be consulted as depending on her strength she may or may not be told to fast, and may be told to fast for part of the fast etc.

Rav Shlomo Zalmen Auerbach Zatzal



A group of Kollel Avreichim approached Rav Shlomo Zalman Auerbach Zatzal with a sincere request: "We yearn to rise to great heights in Avodas Hashem, to become close to the Ribbono Shel Olam and to perform His Mitzvos on the highest level. However, we don't know where to begin - in which Mitzvos should we be extra careful and stringent?"



Rav Shlomo Zalman responded: "Why look for stringencies? There is no need for that. The main thing is to accept upon yourself to fulfill the Halacha on a Lechatchila level."



The Avreichim agreed to take that upon themselves, but were not satisfied. They continued to request Rav Shlomo Zalman's guidance as to how they can be extra careful in matters of Halacha and create a close relationship with the Ribbono Shel Olam.



Since it meant so much to them, Rav Shlomo Zalman acceded to their request and gave them the following advice: "All the Chumros and Hidurim are not worth a single minor Hidur in matters of Kedusha and Tzeniyus.


In matters of Kedusha and Tzeniyus, every small Hidur is immeasurable, it raises up, sanctifies, and brings a person close to his Creator, as Chazal say: 'Wherever you find safeguards against ervah, you find Kedusha.' For someone whose Neshama is thirsty for Ruchniyus, the place to begin and the area that is most important is Kedusha and Tzeniyus."

1) A Jew about who it is well known that he is an idol worshipper, Mechalel Shabbos publicly or a government informer [regarding other Jews], even if he does these things L'Teiavon, for his own pleasure, and not in a rebellious way, has lost his status as a Jew [as long as he doesn't do Teshuva] and no kindness, including Bikur Cholim, should be afforded him. (Chofetz Chaim in Sefer Ahavas Chesed Dinei Mitzvas Halva'ah Perek 3:3)

However, if it isn't proven and is only rumored that one is in violation of one of the aforementioned sins, he retains his status as a full fledged Jew (until proven otherwise) and he must be visited when he is sick. (ibid.)

2) A Jew who is not religious and does not follow the laws of the Torah , but is living as such due to lack of proper Jewish education (referred to in Halacha as Tinok Shenishba, i.e. a child that was captured and raised by non Jews, and thus had no way of receiving a proper Jewish education) retains his status as a kosher Jew and must be visited when sick.

Most non religious Jews today fall under the aforementioned category and as such should be treated as our brothers and sisters , with warmth and compassion ,and gently influenced to see the beauty of Yiddishkeit and helped in their journey back to Torah true Judaism and closeness to our Father in heaven.

The main thing, of course, is to ensure that no Chilul Hashem results from any of our actions towards our non religious brethren, or any time. (See Chazon Ish Yoreh Deah Siman 2:16)

Why should one wait to say kiddish levana [on Motzei Tisha B'Av ] until after eating - is this halachic or out of concern for the fasters?

Answer:


This is brought down in the Shulchan Aruch as Halacha. The main reason for this law, is that Kiddush Levana needs to be recited with Simcha. One who is on an empty stomache for 24 hours and still in the Tisha B'Av mode cannot be doing it with Simcha, until after he has eaten and gets into the post Tisha B'Av mode of Geulah.

1) A Jew who intentionally denies and does not keep one [or more] of the Mitzvos of the Torah, but does so for his/her own pleasure or convenience and not for the purpose of rebelling against Hashem or angering Him (known in Halachic terms as a Mumar L'TeiaVon), is still considered a Jew as long as he/she believes in the thirteen fundamental principles of Judaism (The Yud Gimel Ikrim written by the Rambam which can be found in its extensive version in his Pirush HaMishnayos of the 10th Perek of Sanhedrin and in an abridged version in most siddurim following the morning prayers).

Thus, if the aforementioned Jew is sick it is a Mitzvah to visit him and all the Halachos of Bikur Cholim apply to him. (See Shulchan Aruch Yoreh Deah Siman 251:1 and Rama Sif 2 that it is optional and not mandatory. However, see Biur HaGra there who rules that it is mandatory.)

2) However, if one intentionally denies even one Mitzvah in the Torah and does so with rebellious intentions (known in Halachic terms as Mumar L'Hachis), he is not considered a Jew and it is prohibited to visit him when he is sick or otherwise save his life. (Shulchan Aruch ibid. Sif 2; See Shach there Os 3 who rules that it is also prohibited to feed and financially support such a person)

If the person who is sick denies [at least one Mitzvah of] the Torah, but we aren't sure if he does so rebelliously or out of lust, convenience or another personal pleasure, we can assume it's the latter and we indeed should visit him. (See Pischei Teshuva Yoreh Deah Siman 251:1)

When I looked through the archive of the halachos of the 3 weeks/ 9 days, it mentioned that some things prohibited on Tisha b'Av are not allowed to resume until chatzot the day after Tisha b'Av. What is the reason for delaying and not allowing activites to resume after tisha b'Av ends?

Answer:

Although the Bais haMikdash was set ablaze on the 9th of Av, it continued to burn, and indeed most of it was consumed, on the 10th of Av.

In fact, the Talmud Taanis 29a tells us that Rav Yochanan stated that had he been alive during the time of the Churban he would have instituted the fast day on the 10th of Av instead of the 9th.

Many tragedies have befallen the Jewish people over the years on the 10th of Av as well, therefore this day is marked as a day of mourning as well until Chatzos.

Rav Avigdor Miller Zatzal



A story is told of a mother whose life was threatened during childbirth; her unborn child's life was threatened as well.



The Doctor said that he couldn't save both; it will have to be either the Mother or the baby.



The Mother decided that she would give up her life for her baby.



And so it was, the Doctor saved the baby and the Mother passed away. The baby was a boy and years passed and it was the day of his Bar-Mitzvah. His father took him to the Kever of his mother so that he could daven.



It was emotional for his father but the child was unemotional and passive. He didn't cry and he wanted to leave quickly so that he could get on with the Bar-Mitzvah celebrations.



After they left, his father turned to him and said," How could you not cry, this was your Mother and she gave up her life for you!"



If we don't' make an effort to concentrate on the loss of the Bais HaMikdash we are as unemotional as this son!

Hashem destroyed his Bais HaMikdash in order to spare us! He took out His wrath on wood and stone rather than annihilate the Jewish people! How can we not cry over it?

Rav Avigdor Miller Zatzal suggests to sit on the floor 1 time a day (in private) for just 1 minute and say "Im Eshkachech Yerushalayim Tishkach Yemini" or even just to say it at any time during the day with Kavanah and bring ourselves to really feel the churban, even a drop.

1) There is no minimum age for Bikur Cholim, and if children are ill it is a Mitzvah for adults to visit them and all aspects of fulfilling the Mitzvah apply. (Shulchan Aruch Yoreh Deah Siman 335:2. See also Rashi Nedarim 39b Dibur Hamaschil V'Afilu Gadol Aitzel Katan.)

Likewise, it is a Mitzvah for someone of stature to visit a sick person of lesser stature (e.g. A Talmid Chacham visiting a less learned person), as when it comes to doing the Mitzvah of Bikur Cholim one should not be concerned with his own Kavod, honor and say that it is beneath his dignity, as even the Gadol HaDor (Torah leader of the generation) is obligated to visit the smallest statured Jew when he is sick. (This is learned from the fact that Hashem Himself performed Bikur Cholim when Avraham Avinu was ill. See Shita Mekubetzes to Nedarim 39b and Prisha on the Tur Yoreh Deah Siman 335 Os 5. See also Chofetz Chaim in Ahavas Chesed Vol. 3 Perek 2. We do not apply the concept of "Zaken V'Aino LeFi Kevodo" as we find by Hashovas Aveida that a Talmid Chacham need not return a lost object if by doing so his honor will be diminished. For the reasoning and more on this topic see Shita Mekubetzes ibid., Sefer Shalmei Nedarim to Nedarim 39b and Pachad Yitzchak, Igros, pages 57-60)

2) The Mitzvah of Bikur Cholim applies even to an infant who is ill even though he has no clue that he is being visited as well as to a Choleh who is unconscious or otherwise not aware of his/her surroundings, as the Mitzvah is to see the situation of the Choleh and determine if he needs anything, and this is possible even if the Choleh does not know he is being visited. (See Tur Yoreh Deah Siman 335:1)

I've noticed that when people say [the words] 'V'kara zeh el zeh V'amar' during kedusha, they bow [to the left and to the right] like by 'Oseh shalom' in Shemona Esrei. My brother told me it's nonsense. is it, or is there a source?

Answer:

Although I also see people do this, there is no mention of this in the Shulchan Aruch or other Poskim that I am aware of. It may have a source according to Kabalah , but I am not aware of it.

QUESTION:

What can one do to avoid the Pritzus, immorality of the streets in the summer?

ANSWER (By Rav Avigdor Miller Zatzal):


First of all, most important, since you have to go to the street, you have to train yourself, not too difficult, to keep your eyes on the sidewalk. Very important, and it's possible. It's only when a mans eyes wander, then he is vulnerable to the environment. Get into the habit of just looking at the sidewalk. Of course when you have to cross the street, look both sides carefully, go across the street and back to the sidewalk. You can train your eyes. Lo Tosuru Acharai Aineichem, don't go spying after your eyes. If the eyes are wandering around, naturally they will find things.

In addition, The Rambam says, in a mind full of Torah, it means we are interested in learning Torah, this foolishness won't enter. Of course, it's not so easy to do, but when a person has some spiritual interest, the thinking in Ruchnius, in Avodas Hashem, and why shouldn't you? When you are walking in the street. Why shouldn't you think about Avodas Hashem? And therefore it drives foolish ideas out of the head. If the mind is a vacuum, so Narishkite, foolish things come into the head.

When you walk in the street, why can't you think about Niflaos Haborai? Why can't you sing to Hashem in the streets? Walk and sing to Hashem. Baruch Hashem I'm well, I am not on crutches, I'm not in a wheelchair, I don't even need a cane. Baruch Hashem, Hamachin Mitzadai Gover, I can walk. Baruch Hashem, I have my 2 own kidneys, and they're producing urine everyday properly. I don't need any artificial kidneys. People who have sound hearts, should thank Hakadosh Baruch Hu, they didn't have any bypasses. The heart is beating everyday naturally, functioning perfectly. There is so much to sing to Hakadosh Baruch Hu. You have Torah to think about? Think about Torah. Get into the habit that your mind should be full of singing to Hakadosh Baruch Hu, and thinking in the Niflaos Hashem, and thinking in Divrei Torah too. Repeat your Gemarra lesson while you're walking in the streets.

And in general there are so many things for people to think about, good things. But when the mind is empty, and the eyes are wandering, naturally your eyes will bring in all kinds of garbage into your head.

1) A man may visit a woman that is sick and a woman may visit a man that is sick, as long as they aren't alone in a way that they will Chas V'Shalom transgress the prohibition of Yichud. (See Aruch HaShulchan Yoreh Deah Siman 335:4. Click Here for Halachos of Yichud.)

A man may, in most instances, assist a sick woman, even to lend her a hand to help her get up, lay down and similar assistance. (Aruch HaShulchan Yoreh Deah Siman 335:5. See also Birchei Yosef Yoreh Deah Siman 335:10 why this is different than a man assisting his wife who is not well when she is a Niddah, where it is prohibited.)

However, if the woman is sick with abdominal issues and needs assistance using the restroom or cleaning herself after using the restroom, a man may not assist her as doing so is improper and Pritzus (decadent behavior) and will lead to indecent thoughts or even Chas V'Shalom to the Yetzer Hara overpowering him to act immorally. (Shulchan Aruch Yoreh Deah Siman 335:10 and Shach and Taz there. See also Maseches Semachos Perek 12 Halacha 10 and commentary of Nachlas Yaakov.)

2) A woman, however, may assist a sick man even with abdominal issues, as the Yetzer Hara of a woman to act immorally is weaker than a man's.

Furthermore, if the man is sick his Yetzer Hara for immorality is weaker, and thus even if the woman would want to act improperly she cannot do so with him in a weakened state. (Shulchan Aruch ibid. See also Darchei Moshe Yoreh Deah 335 where he proves this from the Shulchan Aruch Yoreh Deah Siman 352:3. See also Birchei Yosef ibid. that for a man to have improper thoughts is worse in a sense than for a woman, as it may lead to Hashchosas Zera L'vatalah which is a terrible prohibition only applicable to men)

After z'man krias shema what am I not allowed to say?

Can I still say birchos krias shema after zman krias shema until zman tefilla? What about the bracha Go'al Yisroel?

Until when may that be said?

Are the zmanim halachos different for men and women?



Answer:

If zman Krias Shema passed, one should still recite Krias Shema with Birchos Krias Shema (Including Ga'al Yisroel), as long as it is still before Chatzos (halachic midday).

After Chatzos, the third Parsha of Krias Shema must be said, as the mitzvah of mentioning Yetzias Mitzraim is applicable all day. The rest of Krias Shema should also ideally be said in order to accept Hashem's reign. Birchos Krias Shema are not said after Chatzos.

Women are exempt from Krias Shema. However they should say the first Posuk. Many women do in fact have the Minhag to say the entire Krias Shema (and many Poskim do encourage them to do so).

The Eishel Avraham and other Poskim say that even women who have accepted upon themselves to say the entire Krias Shema, are not obligated in saying it before Zman Krias Shema.

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH

Halachos for Erev Shabbos Kodesh

1) It is prohibited to take payment for fulfilling Bikur Cholim [for a short visit whilst standing], as doing so is disrespecting the Mitzvah. (See Talmud Nedarim 39a and Shita MeKubetzes there)

Even if one [sits down and]stays for a little longer time than necessary to fulfill the Mitzvah, it is still prohibited to take payment, as we are concerned that he will end up taking payment for a subsequent short visit, which is prohibited.(See Ritva to Nedarim 39a)

2) However, if one sits down for a long visit with the sick person, he may indeed take payment as we consider it compensation for his time and efforts and not a payment for doing the Mitzvah, which could have been accomplished by standing at the bedside or sitting down for a short time. (See Rambam Hilchos Nedarim Perek 6:8 and Nimukei Yosef to Nedarim 39a)



Halachos for Shabbos Kodesh

1) If a sick person's relatives or friends, or even a total stranger, spent money for his medical expenses (doctor, hospital, medicines etc.) he/she must compensate them for their costs, even if he/she did not specifically request of them to spend this money on his/her behalf.

2) The reason for this is because it is the accepted and praiseworthy custom when someone R"L falls ill and is unable to care of themselves that his/her family and friends come to his/her aid and do whatever is necessary to facilitate healing. (See Shu"t HaRosh Klal 85:2. See also Yad Ramah to Sanhedrin 73a Dibur Hamaschil Tanya Minayin)

I've noticed that when people say [the words] 'V'kara zeh el zeh V'amar' during kedusha, they bow [to the left and to the right] like by 'Oseh Shalom' in Shemona Esrei.

My brother told me it's nonsense. Is it, or is there a source?



Answer:

Although I also see people do this, there is no mention of this in the Shulchan Aruch or other Poskim that I am aware of.

It may have a source according to Kabalah , but I am not aware of it.

We live in a world of nisyonos (struggles;trials and tribulations).


When one encounters difficulties, these are his tests.


If one finds it difficult to learn or to get up for davening or with fulfilling any of the other Mitzvos, this is the nature of Man.


The obligation is to "be strong like a lion" to break this nature.


Nisyonos are the sign of a Ben-Torah. Lack of nisyonos is an indication of spiritual bankruptcy and disconnection from ruchniyus. For example: Meshulachim (fund-raisers) go out from quite a large number of yeshivos collecting money in America. If people say that a certain yeshiva has no need for meshulachim, I do not think that it could be called a yeshiva. "This is the way of Torah," to toil and trouble oneself, this is the very being of ruchniyus. If it goes easy, without difficulties, it is not a yeshiva.

The maskilim (reform jews) once complained to Reb Chaim Ozer that according to the rules of Nature it is impossible to maintain Torah. Reb Chaim Ozer answered them, "Torah is never maintained according to the Laws of Nature." It is possible to run a business according to normal accounting practices. Torah, however, works on miracles contrary to Nature. Therefore, each Ben Torah must be prepared for problems and difficulties. If not today, then tomorrow.


Happy is the one who understands that it must be this way in order to develop properly. Then, when he goes out into the world and encounters difficulties, he will be prepared and they won't break him.

The Alter from Kelm said that the best soldier is tested on the battlefield. There we see his strength. So too, the real Ben-Torah is tested with nisyonos and obstacles. The yeshiva is the place to prepare for life. "Void of all transgression and clean from all sin, and attached to fear of You," (Shemoneh Esreh of Motzai Shabbos). This is the goal of everything. Through proper fulfillment of all the mitzvos a person earns true attachment to yiras Hashem (fear of God). From there he goes on to the next step of, "Grace us with Your wisdom, understanding, and intelligence."

1)On the Yom Tov of Sukkos, one who is tending to a sick person, even a Choleh Sh’Ein Bo Sakana, who is not in grave danger, is exempt from sitting in a Sukkah.
This is because he is engrossed in a Mitzvah, and is thus exempt from other Mitzvos at that time (Osek B’Mitzvah Patur Min HaMitzvah) (Shulchan Aruch Siman 640:3 and Mishna Berura S"K 7. See Bikurei Yaakov, Tosefes Bikurim Siman 640:22 for a different reasoning for this exemption)


Some opinions rule that this is only the case during the actual time that the Choleh needs his assistance, but not the entire time that he is at his bedside.(ibid.)

If two people are assisting the sick person and they aren’t both needed together, they should take turns and one should eat in the Sukkah while the other watches over the sick person and then switch places. (Mishna Berura Siman 640:10)

2) If the sick person is a Choleh Sh’Yesh Bo Sakana, and is in grave danger, the one assisting him is exempt from the Sukkah, according to everyone, the entire time he is at the bedside. (Mishna Berura Siman 640:11)

If the person attending to the sick person is getting paid for doing it, he is not halachically considered "Osek B’Mitzvah" and is not exempt from eating in the Sukkah. (Bikurei Yaakov ibid.)

What is the geder (the criteria) of what names one can insert in Refaeinu? Does the condition have to be one of sakana (danger), or can one even daven for a choleh with a flu, etc.?

Additionally, can one daven for someone who is off the derech (is not yet religious) in Refaeinu, as the Yehi Ratzon states "Refuas Hanefesh u’refuas Haguf," which would seem to indicate that one may/should daven for people who need a "spiritual" Refuah?



Answer:

Anyone who is sick enough to require Tefilos (which in some cases can include a severe flu) can be davened for in Refaenu. People who need spiritual healing can also be mentioned there, or in the Bracha of Teshuva (Hashiveinu).

The Chofetz Chaim points out that when a person believes lashon hara, his respect for the person about whom it was spoken has lowered. The Mitzvah of Ahavas Yisroel requires us to think well of other Jews, not to think less of them because of something that was said about them.

If someone is told Lashon Hara and responds by nodding in agreement, then he is guilty both of accepting Lashon Hara and of speaking Lashon Hara.

Amazingly, the Rambam states that the punishment of one who accepts lashon hara is greater than that of the speaker. Perhaps the reason is that if people would not accept Lashon Hara, then the evil report would be DOA (Dead On Arrival). It would be harmless, and perhaps the speaker, seeing that his words were ignored, would not repeat this evil practice. The fact that the listener accepts the report as fact encourages the speaker to spread more Lashon Hara in the future."

1)It is permitted to visit sick people on Shabbos. (Shulchan Aruch Orach Chaim Siman 287:1)

Chazal (Talmud Shabbos 12b) were originally hesitant to allow Bikur Cholim (and Nichum Aveilim) on Shabbos lest the visitor become pained and begin davening for the Choleh in a manner that is prohibited on Shabbos. (See Rashi Dibur Hamaschil B’Koshi)

Although Chazal did not in actuality ban it, it is still best to try and avoid visiting the sick on Shabbos, and surely one should not purposely schedule the visit for Shabbos if he can easily do it on another day of the week.

Of course, if one is too busy to visit the sick during the week, he should surely go do it on Shabbos. (Sha’arei Teshuva Siman 287:1. He writes there that if one is extremely weak hearted and will become extremely distraught when seeing the Choleh’s condition, he should indeed not go on Shabbos, a day of pleasure (Oneg) where we avoid unnecessary pain (Tza’ar))

2) If one visited the sick person already in the weekday, he may go visit again on Shabbos, and doing so is in fact a great Mitzvah, as there is no limit to how many times Bikur Cholim can be fulfilled. (See Biur Halacha Siman 287:1)

Is waiting half an hour between eating milchig (dairy) and fleishig( meat) a must?


Answer:

No.If you wash your mouth out well and/or eat some bread or other hard parve item in between it suffices. The hands should also be washed between the two.

There are times throughout our life’s work in Avodas Hashem that we feel great, high, and accomplished, and there are times that we feel down or feel like we’re not doing so great or are just feeling unholy.

I once read an article that described this feeling as the "Klippos/shell" of the next madreiga (spiritual level) that we will soon break through to be able to rise even higher and closer to Hashem.

I heard from the great Tzadik Rav Moshe Wolfson shlita , spiritual leader of Emunas Yisroel in Boro Park NY, that the feeling of closeness to Hashem and the exhiliration of reaching another and higher level will be even greater than the low feeling that was experienced prior!

1) If an ill person's condition worsens considerably to the point that [medically] it seems that he/she will not recover, it is proper and customary to add on a name, as when one's name changes his/her essence changes as well and thus the heavenly decree that was passed against them can change as well. (Rama Yoreh Deah Siman 335:10)

This is learned out from Avram Avinu and Sarai Imeinu whose destiny it was to die without children, yet after having their names changed to Avraham and Sarah (See Bereishis 17:5 and 15)were indeed able to have a child. (See Talmud Rosh Hashana 16b and Midrash Rabbah to Koheles Perek 5:4. See MaHarsha to Rosh Hashana 16b Dibur Hamaschil Arba Devarim for a detailed discussion about the real effects of a name change. See also Rambam Hilchos Teshuva Perek 2:4)

2) The new name is added in addition to the established name and does not replace the old name. (See Aruch HaShulchan Yoreh Deah Siman 335:12)

(Regarding how to choose a "good" new name to add, see Sefer Chasidim Siman 244 where he discusses using a Goral, a sort of Torah lottery to choose a proper name.
See also The Chida in Birchei Yosef to Yoreh Deah Siman 179:8 where he discusses "seeking advice" from the Torah itself by opening up to a random page and following the advice that the Posuk that is seen first dispenses.

Many people use this method for choosing names [as well as many other areas in life where divine guidance is sought], unless the name that it falls open to is that of an evil person.

Of course, it is of paramount importance when doing this to receive the blessing and follow the guidance of a wise Tzadik, as many things can be affected by a name change which require a lot of forethought and care)

If two people ate bread and one drank soda (not water) must and can he be mitztarif with the two for a zimun?


Answer:

L'Chatchilah the third person should eat bread or Mezonos, but if all he had was a drink or other non Mezonos food he can still be part of the Mezuman. (See Mishna Berura Siman 197:22)

Chizuk For Today:





Although there were exceptions, the basic script for each plague inflicted upon Egypt was: Hashem commands Moshe to bring about the plague, Egypt suffers, and when the situation becomes unbearable, Pharaoh begs Moshe to remove the plague while promising that he will allow Bnei Yisroel (the Jewish people) to leave Egypt. Moshe then davens (prays) to Hashem that the plague be removed, and it stops. Immediately thereafter, Pharaoh reneges on his half of the deal, and Bnei Yisroel are not allowed to leave. Then Moshe is told to bring about the next plague.

However, before Pharaoh changes his mind following the plague of tzfardea (frogs), the Torah adds that it was only after Pharaoh saw "Ki Hayta Harvacha" (8:11) (there was relief) that he decided to harden his heart and not allow Bnei Yisroel to leave.

What does it mean that there was relief from the frogs-the plague had already ended? And why only by tzfardea does the Torah mention that there was relief before Pharaoh changed his mind?

The Kli Yakar (1550-1619, Rav Shlomo Ephraim Lunshitz, Prague) explains that each time a plague was removed, Pharaoh's fear immediately disappeared as well. Pharaoh had only agreed to let the Jews leave because he was scared, and as soon as the cause of that fear disappeared, so too did Pharaoh's good will.

However, even after all of the frogs were killed, they did not simply disappear. There were millions and millions of dead, rotting frogs (8:10) throughout the country. And as long as Pharaoh was around them, he could not forget the suffering that would await him if he would renege on his agreement. But Pharaoh saw relief: Egypt was a big country, and even if the smell of the frogs affected this area, he could simply move to a different area where he would remain unaffected. Only after he saw that he could avoid the stench of the frogs could Pharaoh ignore the reality of the situation and convince himself that nothing need be done differently with the Jews. Once Pharaoh saw he had wiggle room, he immediately changed his mind.

Rav Chatzkel Levenstein (1885-1974, famed Mashgiach of the Mir Yeshiva in pre-WWII Europe, and later in the Ponovezh Yeshiva in Bnei Brak) was riding in a cab in Israel, when the cabbie said, "Rabbi-I must tell you a story." "Please," responded Rav Levenstein.

"After my friends and I finished up our army service, we traveled around the world. We were in the middle of a jungle somewhere, camping out for the night. We were sleeping soundly, when all of the sudden we heard someone screaming. We all woke up and saw one of our buddies with a Boa Constrictor wrapped around his body, literally squeezing the life out of him. Immediately, we tried pulling the thing off, but we could not get it to budge. We kept trying to rip the snake off of him, but to no avail, and by now he was on the floor turning blue. We just did not know what else to do. Despite being not religious, we were traditional, so seeing what was about to happen, one of the guys says, "Yigal-you're about to die. At least say Shma before you go!"

So Yigal, with the little breath he has left in him, manages to mutter, "Shma Yisroel Hashem Elokeinu Hashem...Echad," and as soon as he gets to the word Echad, the snake releases him and slithers off.

The cab driver then continues, "Rabbi-because of that incident, Yigal is today Chareidi (extremely observant). He covers his head, and his wife covers her hair, and they are shomer Shabbat and Kashrut and everything! The young boys go to cheder (Yeshiva for younger boys) all because of that one incident!

Very impressed by the story, Rav Levenstein says, "Wow, that's amazing. But...what about you?" To which the non-religious cabbie responds, "Rabbi-what do you mean? It didn't happen to me!"

The cab driver and his buddies feared for the life of their friend. Scary situations humble a person and allow for sincere introspection. But not long thereafter everything returns back to normal, and just as Pharaoh did, we begin to rationalize and rethink things: "Yeah well, I should change but it would just be too difficult. I had better rethink that decision." Hashem blesses us with times of inspiration, times when we see things ever so clearly, and it is up to us to utilize such moments to facilitate at least one small change before life goes on and we lose our motivation.

1)If a close relative of a sick person passes away he/she should not be informed of this sad news, even if it is regarding someone that he/she would otherwise be halachically obligated to rend their garments.

There is no obligation for someone else to rend the sick person's garment. (Shulchan Aruch Yoreh Deah Siman 337)

Even if he found out about the passing, there is no obligation to have him rend his garments. (See Shach Yoreh Deah 337:1 that by rending the garments it will increase the pain of the sad news.)

2) Nobody should cry or otherwise exhibit signs of sadness and despair in the presence of the Choleh, nor should any Hespedim (eulogies) be said in his/her presence. (Shulchan Aruch ibid.)

The ban on eulogies and despair in the Choleh's presence applies for any people that passed away not just for a relative of the sick person. (See Shach Yoreh Deah 337:2 for the reasoning)

All of the above is so that no unnecessary pain and heartache should be caused to the sick person.

Likewise, if the family is sitting Shiva in the home where the sick person is resting, care must be taken to keep all the people who come for Shiva visits quiet. (Shulchan Aruch ibid.)

Answer:

During the three weeks yes, during the nine days only if it is mending an existing piece of clothing that ripped, not if it is making it ready to wear for the first time

Chizuk For Today:





R' Yerucham Levovitz Zatzal, the well-known Mashgiach of the Mir Yeshiva in pre-war Europe, used to say that true Chesed means allowing the recipient to feel like they are doing something for you as well or at least making sure they don't' feel indebted to you.

For example, if someone goes to visit someone in the hospital and the patient or patient's family wants to pay for their parking, the natural reaction of the person doing the Chesed is to say no I am doing this Chesed 100% and that will take away.

True Chesed, However, would be to actually allow them to pay for the parking so that they don't feel like takers!
