1) One should not eat in the street, in public, as doing so is an indication that one has no shame, and can even lead to being disqualified as a witness in a Jewish court of law. (See Shulchan Aruch Choshen Mishpat Siman 34:18, based on the Gemara (Kiddushin 40b) that says that one who eats in public is likened to a dog. See Q&A #161 for more on this topic)

2) One should not drink an entire [normal sized] cup of wine in one gulp, as doing so seems like a gluttonous way to drink
(Gargaran). Nor should it be drunk in too many sips, as that seems haughty, rather the proper way to drink it is in two gulps.

If the cup is very small (less than a Revi’is), then it may be finished in one gulp. If the cup is larger than normal, it may be finished in more than two gulps. (Shulchan Aruch and Ram"a Siman 170:8. See Mishna Berura S"K 20-22 for some other exclusions)

Some Poskim maintain that by Kiddush and Havdalah the above doesn’t apply, and the entire Becher of wine may be drunk in one gulp. (See Shu"t Mishne Halachos Vol. 8 Siman 33)

Soft drinks, juices, water or other drinks are not subject to the above Halacha, as it only pertains to wine.

Reader’s Question:

What does one do if one has for  example a bagel store and they have these huge coffee machines in terms of toiviling them?

Answer:

If the machines will not work properly if toiveled, many Poskim will allow their use without it.

However, in many cases the parts that have the coffee in them can be taken off and Toveled, or even the entire machine can be toveled, and still work properly if left to  dry completely for 24-48 hours after the Tevilah.

If there is no way to do this, a Rav should be consulted for a Psak Halacha.

1) It is proper to leave over a little bit of what was in your plate, and not totally finish everything down to the last crumb. (See Ben Ish Chai Parshas B'Har Siman 14 and Sefer Eitz Hasadeh Chapter 19:13 quoting Rav Chaim Kanievsky shlita that it is good to be stringent with this.)

2) One who took a bite out of a piece of bread[or other food items], should not put it back in middle of the table, as it is unappetizing to other people and they will not eat from it after it was bitten from. Rather he/she should make sure to finish the entire piece.(Mishna Berura 170:36)

Reader's Question:

The other day while at an appointment with my daughter's orthodontist, the orthodontist (Jewish but not observant or particularly knowledgeable about Torah and Mitzvos) proudly showed my daughter and myself a bird's nest right outside of his office window in a tree with a bird in it presumably sitting on its eggs.

If this is an opportunity to do the Mitzvah of Shaluach HaKahn, how do I do it?  Certainly even just shooing the mother off her eggs in front of the non-observant and non-Jewish staff will not make a good impression (to say the least), let alone taking or touching the eggs in front of them.

I could go back this Sunday, when the office is closed, and perform the Mitzvah without watchers - it is private property but not so private since there are several offices in the complex - I would have very low fear of being arrested (if the police saw me walking around the building, I would probably be questioned but not likely more than that).

Answer:

There are a few points that you need to determine before performing this Mitzva. whose property is it? As you may not go into someone else's property without permission  to do this mitzvah. Also, it isn't so simple that the nest may be on a private property at all, even if you received permission from the owner, as if it is on private property the birds have owners, as a person's property is Koneh them. (Unless he stipulates otherwise. There are exceptions to this, butthat's too lengthy a discussion for this forum)

Are the species of bird kosher? As they need to be kosher in order to be able to do the Mitzva.

If you go during the day, for most species of bird, it will be the father that you chase away and not the mother, and thus according to most opinions you will not be doing the Mitzva. Most species, the mother is there around sunset and later.

There are many other intricate details you need to know, so the best thing would be to ask a Rav for the best way to proceed.

DOUBLE ISSUE L'KAVOD SHABBOS KODESH

Halachos for Erev Shabbos Kodesh

1)It is imperative to eat with Derech Eretz, in a dignified way.

According to the Rambam
(Sefer HaMitzvos, Lo Ta'aseh 195) and other Poskim, eating in a non dignified manner may be a transgression of one or more biblical transgressions. (See Aruch HaShulchan Siman 157:1 and Elya Rabbah Siman 170:23 what he  quotes from the Shl"a)

2) One should not eat while standing.
(Rambam Hilchos Dayos 4:3. See also Ben Ish Chai Parshas B'Har Siman 11)

Halachos for Shabbos Kodesh

1) L'Chatchila, it is also best not to drink while standing. Though many people are not stringent with this, and they do have on whom to rely, the AriZal was very careful with this.
(Mishna Berura Siman 296:6. See also Shu"t Rav P'Alim Vol. 2 Siman 45)

2) Some Poskim maintain that only Talmidei Chachamim (Torah scholars) need to be stringent not to drink while standing, but other people need not be stringent with this. (See Shulchan Aruch Harav Siman 296:15. Though, from his language it seems that even non Talmidei Chachamim should try and emulate the Talmidei Chachamim in this matter when possible)

Do I recall that toiveling is not applicable to  items made by Jews in Eretz Yisrael?

Answer:

Utensils made by Jews anywhere, not just Eretz Yisroel, do not require Toveling. Even utensils made by non Jews, in a Jewish owned factory, according to most Poskim, do not require toiveling.

Todays learning has been sponsored by a daily reader, S.M.S., in honor of  Dov Yehoshua ben HaRav Yaakov Shmuel for his tireless efforts on behalf of his family and community.  May Hashem continue to give him the strength and zchus to continue to perform mitzvos on behalf of Klal Yisroel.  With this small token, we hope to express our love and gratitude.

1)When sitting around the table at a meal, it is prohibited to begin eating before the head of the household or an important person (i.e. Talmid Chacham, Osek B’Tzorchei Tzibbur etc.) at the table eats first.

This applies even if all the people around the table have their own plates of food, still they should not begin eating before the important person.
(Mishna Berura 170:28)

This applies only to the main dishes, and not to salads and drinks, though waiting for these items as well, is considered an act of Derech Eretz.

2) One who does not wait, and eats first, is considered a "Gargaran"
(Shulchan Aruch Siman 170:12 based on the Mishna in Maseches Derech Eretz Rabbah Perek 7:1. I am not sure of the exact literal translation of this word, but it from the commentaries on the Mishna it seems to mean something to the effect of  a disrespectful, immodest, haughty person; definitely not something to want to be.)

Reader’s Question:

Is it permissible to take vitamins on Shabbos? E.g. calcium for bone health?  What about taking a baby aspirin on Shabbos - prophylactically- to prevent head aches, strokes, and for heart strength, etc.

Answer:

If the vitamins are being taken as a supplement for food, they are permitted. If it is being taken to fortify  the body or to combat certain medical symptoms. However, Rav Moshe Feinstein Zatzal (Orach Chaim Vol. 3 Siman 54) and other Poskim are stringent, while the Tzitz Eliezer (Vol. 14 Siman 50) and others are lenient.

A Rav should be consulted for Psak Halacha.

Preventative medicine may also be permitted in certain instances. A Rav should be consulted for  each specific situation.

1)It is a Mitzvah to say words of Torah during every meal, as a meal that lacks Torah is considered as if it was a meal (sacrifice) offered to Avoda Zarah (idol worship).

Even people who cannot have lengthy Torah discussions at their meals, should at least say a short Halacha or even a Mizmor of Tehillim (Preferably, psalm 23) to satisfy this obligation, and avoid the punishments detailed in the Seforim for partaking of a meal that is totally lacking of any Torah. (Mishna Berura 170:1. See also Aruch HaShulchan 170:1)

Birchas HaMazon does not suffice to satisfy the requirement for Torah.(ibid.)

2) One should not talk while eating, even a simple "Gezuntheit" to a sneeze or even words of Torah, as it is a choking hazard to talk while eating.

Obviously, this is only while chewing, and doesn't apply between bites. (Mishna Berura ibid. See also Aruch HaShulchan 170:2 who has a more lenient approach, as does the Ben Ish Chai Parshas Behar Siman 5. However most contemporary Poskim are stringent with this Halacha, and it is indeed advisable to be cautious and not talk with food in the mouth.)

Reader's Question:

Can you tell me what is the generally accepted practice regarding ovens.  What if a person only has one oven?

Answer:

Having only one oven for both milk and meat presents a whole slew of complex halachic problems. I will try to give you a brief summary of some guidelines, but a Rav MUST be consulted for your particular situation. These guidelines are for ovens only, and not for microwave ovens, which may have additional problems.

1) meat and dairy foods  may never be in the same oven at the same time when  touching each other. Also, they may never be in the same oven, even separately, if gravy or any other substance of one can reach or drip on to the other.

2) Even if the above problems are avoided, there still remains the problem of the Ray-ach, or aroma of the foods mixing with one another.

3) Even when the above problems are avoided and the oven is not used at the same time for milk and meat, there still exists certain problems when usingthe oven for one, immediately after using it for the other. The steam of a liquid containing food has the halachic status of that food. Therefore there may be a problem of the steam of the food that was just cooked in the oven now entering the other food that is now cooking. Obviously, this particular concern doesn't apply to pots/pans that are [adequately]covered .

Some Poskim are lenient about this, as our ovens are vented, and all steam leaves the oven. However, Rav Moshe Feinstein Zatzal and other Poskim arent so convinced that the vent does a proper job of removing all steam, and thus may render a milk dish into Basar B'Chalav. Another leniency that Rav Moshe Zatzal and others consider is that the steam which may or may not enter the new food, is Batul B'Shishim, as the food in the oven contains more than sixty times the volume of the steam, and also the steam is only a rabbinic prohibition. Thus in certain instances  Poskim will be lenient with this.

4) When using an oven for the second food item, the oven must be clean and  no residue of the first item may be left in the oven lest it heat up and present a real problem.

Again, the above is only a short synopsis of a very complicated halachic situation. It is ideal to have two separate ovens. If not possible, a Rav MUST be consulted about the proper usage of one oven for both food types.

1)When one person is making the Hamotzi for others (as is common in many households, on Shabbos and Yom Tov) it is best for the one that makes the Bracha to eat a piece of the Challah/bread before distributing pieces to the rest of the people at the table, as to avoid an interruption between his Bracha and his eating. (Psak of the  Mishna Berura 167:79, although the Rama and others Pasken like Tosefos and the Mordechai that he may slice all the pieces, give them out and then eat, as  they hold doing so is not a Hefsek)

However, there is no need for him to swallow his piece before distributing the rest, as he may L'Chatchilah give out the Challah while still chewing. (See Sefer Toras Shabbos Siman 274:4)

2) When distributing the Challah, a man should give his wife first and then the rest of the participants according to chashivus (importance, e.g. Talmid Chacham, Kohen etc.), or age.

QUESTION & ANSWER CORNER:

Although the answers I give to questions are taken directly from the Sifrei HaPoskim, and aren't my own, they are  still for study purposes only, NOT for Psak Halacha.

Questions can be emailed to Halacha For Today

Reader's Question:

I have a question about not making a Bracha L'vatala (Blessing with Hashem's name in vain)

What happens if I start a bracha and cannot finish it for some reason?

What if I have said "Baruch"…

or "Baruch Atah…"

or Baruch Atah HaShem…"

or if I have gone further with up to three more words… what should I do?

And what if I have just made a bracha on a piece of fruit, the only fruit around, and as I am about to bite into it, I see bugs on it that I hadn't noticed before?

Answer:

If you just said "Baruch" or "Baruch Ata": Just stop.

If you said  Baruch Atah HaShem" finish with the words "Lamdeini Chukecha" (as that is a Posuk in Tehillim,"Baruch Ata Hashem Lamdeini Chukecha"

If you started to say "Elokeinu" finish with "Elokei Yisroel Avinu M'Olam V'Ad Olam", also a Posuk.

If you finished the word "Elokeinu" or more, say "Baruch Sheim Kevod Malchuso L'Olam Va'aed". This is also said any time the name of Hashem is said in vain.

Regarding the bugs, if you can't take a little bite of a part of the fruit that has no bugs, do not eat it , and say "Baruch Sheim…"

Bonus Q&A L'Kavod Lag B'Omer:

Reader's Question:

What is the source for the custom of using a bow and arrow on Lag B'omer [as many Rebbes do, and many children as well]?

Answer:

The Talmud (Kesuvos 77b and Yerushalmi Brachos Perk 9:1) states that during the lifetime of Rav Shimon Bar Yochai, no rainbow (called Keshes in Hebrew, and which is a "bad" sign for the Jews) was seen in the sky. The bow of "bow and arrow" is also called "Keshes", so the minhag to use a Keshes is to commemorate the greatness of Rav Shimon Bar Yochai who prevented the Keshes.

1)It is a Mitzvah for there to be salt on the table before beginning to eat.

The reason for this is that the table is likened to the Mizbeach (altar) in the Bais HaMikdash, and the food we eat is likened to the Korbanos (ritual sacrifices) that were offered on the Mizbeach. All Korbanos required salt, hence the table requires salt. Having salt on the table also protects from misfortune. (Ram"a 167:5 and see Mishna Berura)

Furthermore, it's a Mitzvah to dip the bread of Hamotzi into salt before eating. (Not as some people mistakenly do and "Sprinkle" the salt on the read).
Some have the custom to dip it three times. (Mishna Berura 167:33)

2) If no salt is available, according to some Poskim, it should be dipped into sugar. (As the Korbanos were allowed to be salted with sugar. See Shu"t Halachos Ketanos Siman 218, Shu"t Divrei Chaim Yoreh Deah Siman 25. The Chasam Sofer also had this custom when no salt was available. However, the Kaf HaChaim 167:37 maintains that sugar is not an acceptable substitute)

If sugar is also unavailable, it is best to dip the bread into a salty food item (fish, spread or dip) that is on the table, as to give the bread the taste of the salt. (See Shu"t Teshuvos V'Hanhagos Vol. 4 Siman 50. See also Shulchan Aruch HaRav 167:8)

Reader's Question:

You wrote: "If one is invited to a wedding at a time when they are observing Sefira, while the one making the wedding observes the "other half" of Sefira and is thus permitted to make a wedding, he/she may attend the wedding, listen to the music and even participate in the dancing. (See Igros Moshe Orach Chaim Vol. 2 Siman 95)"

I have heard that even though it is permitted to attend the wedding, dancing is only permitted when the Chosson and Kallah are in the simcha hall and not during the time photographs are being taken.

In that case, is it also correct that one should not listen to the live music during the time when the Chosson and Kallah are not in the simcha hall?

Answer:

Although I havent seen that [written in the Sifrei HaPoskim], it does indeed make sense to only allow dancing when it will be Mesameach the Choson/Kallah, which is when they are in the room.

However, there is no need for you to leave the room while the music is playing, even if they arent in the room, as you are permitted to be at that wedding, no matter what is taking place at that time in the room.

Today’s Learning Has been Dedicated by A Daily Reader, Dr. M.W., L’Zchus Refuah Shelaima for his Nephew, Yosaif ben Naomi.  Please Have in Mind when learning Today’s Halachos that they Be in the merit of his complete and speedy recovery.

1)When breaking/cutting the piece of bread on which Hamotzi was recited, it is best not to cut a piece that is smaller than a Kzayis, as doing so seems like a "Tzar Ayin- a less than generous person".

It is also best not to cut a piece that is bigger than a usual piece, as doing so seems like a "Ra’avson- a gluttonous person" (
See Mishna Berura  167:8 and 9. See also Shu"t Igros Moshe Orach Chaim Vol. 5 Siman 16 for a more in depth discussion about this)

However, if the big piece that is cut will not be eaten from, rather smaller pieces will be broken off from it throughout the meal, it is permitted. (Mishna Berura 167:9)

2) On Shabbos it is a Mitzvah to cut a large enough piece that will last for the entire meal, as doing so shows our love for the Mitzvah of Seudas Shabbos, and we don’t say that it looks gluttonous .(Mishna Berura 167:12)

Some Poskim maintain that the above is true by any Seudas Mitzvah, not just Shabbos. (See Ketzos HaShulchan Siman 37:13)

Is it permitted to fall asleep while listening to music?

Based on the Yerushalmi Megilah 3:2 and other sources, many Poskim  indeed maintain that it is best not to fall asleep and/or wake up while listening to music.

  DOUBLE ISSUE L'KAVOD SHABBOS KODESH

Halachos for Erev Shabbos Kodesh

1)
On Shabbos and Yom Tov, when we are required to recite the Bracha on two complete loaves, the Halacha of tearing a piece of the bread before the Bracha does not apply.

However, a small cut should be etched into the Challah, as an indicator where to start cutting upon the completion of the Bracha.

If one did in fact tear a small piece on Shabbos or Yom Tov, as is done in the weekdays, B'dieved  it is still considered complete "Lechem Mishna" (see Mishna Berura 167:10 and 11 and  274:5)

2) The Halacha of cutting a small piece of the bread only applies to bread, Challah, bagels, rolls etc., and not to Matza or thin bread (pita) which takes no time after the Bracha to break/cut off a piece.
(Shulchan Aruch HaRav ibid. ,Biur Halacha 167:1 Dibur HaMaschil V'Tzarich. The Kaf HaChaim 167:18 goes so far as to suggest that it is better to take a Matza or thin bread that doesn't require this cutting, as then you will have a real complete bread (Shalem). However, the Chayei Moshe quotes the Toras Chaim to Sanhedrin 102a who maintains that even thin bread requires a "cut", and this cut is more important than having a real Shalem.)

Halachos for Shabbos Kodesh

1) When giving out the Challah to those seated around the table, the bread should not be placed into their hands, rather it should be placed in front of them, as placing it directly in their hands is a "Siman Ra- bad omen" of mourning. One should be careful with this even when giving bread to his/her small children. (Mishna Berura 167:90, Ben Ish Chai Parshas Emor Siman 18

When giving bread to a mourner, it is indeed placed into his/her hands. However, on Shabbos it should be placed in front of him/her , as signs of mourning are not displayed on Shabbos in front of other people. (Mishna Berura 167:89)

2) Bread should never be thrown across the table in a disrespectful way, especially the Challah at the Shabbos Seudah with which a Mitzvah was performed. (Mishna Berura 167:88.  However, some people actually have the minhag to "throw" the Challah to each person at the table. This was the Minhag of the Chasam Sofer and the Divrei Chaim of Sanz. See Shu"t Hisorerus Teshuva Vol. 1 Siman 178. Even those whose custom it is to throw it, should do so in a respectful manner )

Reader's Question #1:

Would writing the day of the omer be the same problem [of being considered that you counted already] in cases where saying it is?

Answer:

No, writing it, does not constitute a "counting"

Reader's Question #2:

Lag B'Omer. We celebrate it as a day the talmidim of Rabi Akiva stopped dying. What is the mekor (source) for this?

Answer:

The Tur Siman 493:3 states that the Talmidim of Rav Akiva stopped dying on Lag B'Omer.

This is brought in earlier Rishonim as well, such as the Meiri to Yevamos 62b and Sefer HaManhig and others.

Interestingly, the MaHaril writes that they died on all the days between Pesach and Shavuos, except on the days that we do not say Tachnun ,7 days of pesach, 2 days of Rosh Chodesh Iyar, Rosh Chodesh Sivan, the 7 Shabbosim in Sefira, 17 days in all, therefore they only died on 32 of the 49 days. As a commemoration of this, we designate the "33rd" day as the day that the dying stopped and we celebrate that day, but not that it totally stopped on Lag B'Omer.

1)Before making the Bracha of Hamotzi on bread  it is proper to make a small tear in the bread (small enough that when you lift the torn piece, the rest of the piece will still be lifted along with it) so that it will be easier to rip off the piece immediately after the Bracha, and thus prevent any extra pausing between reciting the Bracha and eating the bread.

However, the piece should not be entirely broken off before the Bracha, as it is proper to make a Bracha on a complete piece of bread.

2) Even if the bread being eaten is not a "complete" loaf (e.g. a slice of bread)  the above still applies, as it is  proper to recite the Bracha on as large a piece of bread as possible. (Mishna Berura 167:5 and Shulchan Aruch HaRav 167:3)

Reader's Question:

Would you be allowed to bring an ipod that has shiurim (Torah lectures) on it into a bathroom? While it's playing i'm assuming not but what if you pause it or it's in a pocketbook?

Answer:

Yes, since there is no actual Torah texts in it, it has no Kedusha and it may be brought in to the bathroom. Similarly, tapes, CD's, tape recorders etc. may be brought in. It is better if it is turned off or paused.

Today's learning is sponsored by a daily reader, M.S., as a Zechus L'Refuah Sheleima for Hensha bas Esther, may she shep nachas from her family and continue to live with Simchas Hachaim.
and for Tinok ben Nechama Adina, may his parents have the zechus to see him to  his bris, L'torah, L'chupah U'L'maasim Tovim

May Ahuva Nessa bas Miriam Elka and Miriam Malka bas Chana Rochel be zocheh to grow B'derech Hashem, find their zivugim and build a Bayis Ne'eman B'yisroel B'sha'ah Tova U'B'karov.

1)When reciting the Bracha of "Hamotzi", the bread should be held with both hands, and when Hashem's name is uttered, the bread should be lifted up.

If the Bracha was made while the bread was on the table, and not being held at all, B'dieved it is OK. (Mishna Berura 167:22)

2) It is proper to hold the bread with all 10 fingers touching the bread.

The reason for this is that there are 10 Mitzvos that are associated with the process of making bread (During the plowing of the field: 1) an ox and a donkey may not be used together, during the planting phase: 2)one may not plant 2 different species together, During the reaping phase: 3) Leket, 4)Shikcha and 5)Peah,6) the ox that is used may not be muzzled while working, After the baking phase:7)Teruma to the Kohen, 8) Ma'aser Rishon to the  Levi, 9) Ma'aser Sheini and 10) Challah to the Kohen)

It is for this reason that there are 10 words in the Bracha of Hamotzi and 10 words in each of the Pesukim that  refer to the bread of mankind (See Shulchan Aruch Siman 167:4 and Mishna Berura 167:23 ad 24)

Some people have a Minhag on Shabbos not to place their fingers directly on the Chalos, rather to place their hands on the Challah cover. However, the prevalent minhag according to most Poskim is to place all 10 fingers on the Chalos, even on Shabbos. (See Mishna Berura 271:41, Shu"t Be'er Moshe Vol. 6 Siman 134 and Sefer Minhag Yisroel Torah Siman 271).

Reader's Question:

Is there an inyan in the Torah whether halachically or hashkafically to celebrate ones Birthday  and also to give out brochos. I see a lot off people doing this and I was wondering if there was a source for this in the Torah. In general what is an appropriate approach to a Birthday

Answer:

The Sefarim do say that on a person's birthday his Mazal is very strong and it is an opportune time to pray  and say Tehilim and work on improving oneself. Many people have the custom to give Tzedaka on their birthday.

The Midrash
(Sechel Tov, Bereishis 40:20)   does make mention of a person's birthday being a special day of Simcha.

Birthday parties, if done in an appropriate  and kosher fashion as a way to express Shevach and Hoda'ah to Hashem for granting you another year of life, are a good way to celebrate with family and friends and to receive and give Brachos to one another. However, if it will simply be a "party" devoid of spirituality, and perhaps lead to Leitzanus or Chas V'Shalom sinful behavior, it should be avoided.

Obviously, the "birthday" that should be celebrated is the hebrew date, and not the secular date on which you were born.

The ben Ish Chai (Parshas R'ei Vol. 1 Siman 17) writes that celebrating ones birthday is an acceptable minhag and is a "Siman Yafeh" and is done in his home each year.

See also the Pri Megadim (MishPetzos Zahav Siman 444:9) where he mentions a minhag to make a 70th birthday feast.

Today's learning has been dedicated by a daily reader, Rochel Bas Chana (may she be healthy and well until 120), L'Zecher Nishmas her father, Avraham ben R' Aharon HaLevi, Z"L whose Yahrteit is today, 11 Iyar. Please have in mind when learning the Halachos that it be a merit for his Neshama to have an Aliya.

1)When eating "fruits of the ground (i.e. vegetables)" the Bracha recited is "Baruch Ata Hashem Elokeinu Melech HaOlam Borei Pri HaAdama- Blessed are You Hashem, Master of the world, Creator of the fruits of the ground"

However, when eating bread (which should really suffice with the Bracha of Ha'Adama) a special Bracha of "Baruch Ata Hashem...Hamotzi Lechem Min HaAretz- Blessed are You Hashem...who brings forth bread from the ground" is recited.

This is due to the importance of wheat/bread as the Posuk (Tehillim 104:15) states that bread is unique in that it satiates mankind more than any other food. (See Shulchan Aruch HaRav 167:1)

2) When reciting the Bracha of "Hamotzi" care should be taken to pause slightly between the word "Lechem" and the word "Min" , otherwise the 2 "Mem" sounds will be swallowed into each other and it will sound like "LecheMin" (Mishna Berura 167:21. Besides for the Halachic reasons for this (which apply to any two such words in Tefilah/Brachos) there are kabalistic reasons as well to be careful with this in the Bracha of Hamotzi. The Chida writes that one who is scrupulous in this will be protected from harm befalling him/her during that meal. See Elya Rabba 167:4)

Reader's Question:

Regarding a Davar Charif, what is the status of a lemon? When you go to a hotel lounge, for example, and order a diet soda, they usually stick a half lemon in the cup to know which one is diet. Hence, they most probably are using a traef knife to cut it-does that invalidate the drink? Is it a problem? Should you ask for diet soda without a lemon wedge?

Answer:

Lemons are indeed treated in halacha as a Davar Charif. (There can be exceptions for mild lemons. See Shach Os 20 to Yoreh Deah 96:4).  You should indeed avoid the lemons  in hotel lounges, where non kosher food is served.

Today, we begin, B'Ezras Hashem, Hilchos Seuda, Halachos that pertain to eating a meal.

1)One who owns animals or birds may not begin his/her own meal before feeding the animals/birds.
(Making sure that they already were fed, or having someone else go and feed them, is also acceptable)

However, it is permitted to drink before giving the animals to eat or drink.  (See Mishna Berura Siman 167:40. See Shu"t Har Tzvi Siman 90 for the reasoning behind this.)

According to some opinions, this is a biblical requirement. (See Biur Halacha 167:6 Dibur HaMaschil Umikal Makom in the name of the Mogen Avraham.)

This directive includes feeding fish in a fish tank that you own. (Shu"t Sh'eilas Ya'avetz Vol. 1 Siman 17, Shu"t Mishneh Halachos Vol. 6 Siman 216)

This only applies to animals that one owns, and not to any other animals that may be in his/her home or property. (See MaHaril Diskin Parshas Noach)

2) If one has small children that cannot feed themselves, they take precedence over the animals and he/she must feed them first. (See Sefer Peleh Yoetz: Ba'al Chai and Shu"t Igros Moshe Orach Chaim Vol. 2 end of Siman 52)

If one has guests, feeding the guests takes precedence over feeding the animals, as the Mitzvah of Hachnosas Orchim is such a great and important Mitzvah that Avraham Avinu gave it precedence to greeting the Shechina! (Sefer Pardes Yosef Parshas Chayei Sara 24:19)

Reader's Question:

Is one (adults) permitted to play board games on Shabbos-where it doesn't involve any m'lacha. If yes, is it better not to?

Answer:

Any games that make noise (rattles, bells,  etc.) may not be used on Shabbos, and may even be Muktzah.

Any games that usually entail writing (scrabble, boggle, magna doodle etc.) may not be used, even if no writing is done.

Similarly, any games that involve clay, playdough etc. may not be used on Shabbos.

Any games that require assembling, via screws, bolts or nails, may not be used on Shabbos.

Many Poskim forbid making puzzles on Shabbos, while others are lenient in certain instances.

These are the basic guidelines, though each individual game must be determined to be acceptable before playing on Shabbos.

Regarding if it's better not to, a Rav should be consulted for each individual situation.

When water becomes available, the hands need to be re-washed. (Mishna Berura Siman 160:64)

2) M'Ikar Hadin
(according to the letter of the law) hot water may be used for Netilas Yadayim. However, L'Chatchila it is best to wait until the water cools enough that you won't be worried about burning yourself, and thus may not wash properly. (Mishna Berura 160:27)

Reader's Question:

Does Hamotzi end after the bracha is said or after the kazayos of bread is eaten?  If the process is not complete until the bread is eaten - then why are we allowed to stop after the bracha to sprinkle salt or honey on the bread.

Wouldn't we need to pre-sprinkle the bread even before netilas yedayim to avoid interupting the process?

Answer:

As far as the hefsek after washing is concerned, Hamotzi is over as soon as the Bracha is recited. That being said, it is important to eat the bread immediately after saying the bracha of Hamotzi. BUT, it isn't a Hefsek to dip in the salt or honey as that is a part of eating the bread.

Incidentally, you write "sprinkle the salt". The proper way for the salt to be applied to the bread is to "dip" the bread into the salt [three times, according to some], and not to "sprinkle" it.

Yosef ben Itte Rivka

These are the three boys in Japan, of which one of them's verdict/sentence is being passed today. Please Daven for them.

Halachos for Erev Shabbos Kodesh

1)Immersing the hands in a body of water which is acceptable for Tevila of the body, is considered an acceptable alternative to washing the hands for "Al Netilas Yadayim" with a  utensil [when no utensil  is available].

Therefore, one may dip his/her hands into a Kosher Mikvah [of standing rain water], a stream or in the ocean in lieu of "washing" the hands.
(Mishna Berura Siman 159:88)

2) One may "wash" their hands by immersing them in a pile of snow, as long as the pile is large enough to cover both hands adequately. (Mishna Berura Siman 160:58)

If the water was transferred to a utensil, it is no longer acceptable to immerse the hands in it, as only in the state where it is Kosher for Mikvah immersion is it Kosher for immersing the hands. (See Mishna Berura to Siman 159:8)

If the water that one is dipping into is suitable for Netilas Yadayim, the Bracha made is "Al Netilas Yadayim". If the water would not be suitable to  wash with, the Bracha made is "Al Tevilas Yadayim" (Mogen Avraham 159:31)

Halachos for Shabbos Kodesh

1) When washing the hands for Al Netilas Yadayim  it is commendable to use a lot of water, as Chazal tell us that one who washes with an abundance of water will be blessed with an abundance of blessings from heaven.

However, one should not do this  for the sake of receiving heavenly reward, as we are supposed to perform Mitzvos properly for the sake of Hashem's honor and not in order to get reward.

2) One who is scrupulous in performing Netilas Yadayim properly , yet doesn't find that they are being blessed with wealth, should know that their own actions (or inactions) in other areas of serving Hashem are depriving them of this extra blessing. (Mishna Berura 159:38. See also Kaf HaChaim 159:81)

If it bothers them to have a "messy" room then its OK, as this is Oneg Shabbos. If he/she is preparing it for  the next use, which will be after Shabbos, then its forbidden.

We will be resuming Hilchos Netilas Yadayim, where we left off before Pesach.

1)Netilas Yadayim must be washed using a "Keli- a Utensil", as Chazal have likened it to the washing that the Kohanim used to do in the Bais HaMikdash before the Avodah, which had to be done with a utensil. (See Shut Tzitz Eliezer Vol. 8 Siman 7:8 and Shu"t Igros Moshe Yoreh Deah Vol. 1 Siman 120:8 where they expound upon this at great length)

Just as one must exert effort and travel a certain amount to find water (See Shulchan Aruch Siman 163 and archives Halachos for March 13), so too must one exert the same efforts to find a utensil with which to wash.  (See Tzitz Eliezer ibid.)

2) All utensils are acceptable for washing for Netilas Yadayim, even those utensils that aren't considered utensils for matters pertaining to Tumah and Tahara. (Mishna Berura 159:3)

There is no difference if the utensil is glass, wood, clay, or any other material. (Mishna Berura 159:2)

According to some Poskim, disposable cups are not acceptable for Netilas Yadayim. However, according to many Poskim, if they are hard plastic or any other type that is commonly used at Shabbos, Yom Tov or other important meals, they are permitted. (See Sefer Sharei HaBracha Chapter 2:3, where he writes that the same rules that apply for the cup  for Kiddush apply here as well.)

Reader's Question:

In the shul I daven at, a number of years ago they started saying Tehillim after mincha because the situation in Eretz Yisroel was very grave. They have continued this practice and are still doing it, even though I don't think the situation there is any worse than it always is. My point is that if it was good to say extra Tehillim every day, Chazal would have instituted it.

I feel that by saying Tehillim in a non-emergency situation we are saying that we are so frum and have such great kavanot that we can't get them all in during the regular mincha, we need to say more. The truth is that almost everybody hardly says it at all, or mumbles through it.

I asked the rabbi if we should discontinue the practice but he didn't agree. I'm not even sure we're allowed to stop any more, maybe it's like a neder or something! What do you think? Are we allowed to stop? Is it OK to add on to mincha? I think the whole thing is very wrong and should be discontinued immediately.

Answer:

There is nothing halachically wrong with saying Tehilim after davening. In fact, many Tzadikim and even many simple people in years past used to say a chapter or two of Tehilim after each Tefilah.

Many Kehilos still have this Minhag today where they say a chapter or two each day B'Tzibbur.

If you find that you cannot do this, you arent obligated to join them in the recital, but there is definitely nothing wrong, as Klal Yisroel needs all the Tefilos they can get.

In fact, the reason that the situation in Eretz Yisroel  or for Yidden around the world isn't so bad now, may possibly be due to the amount of Tehillim being said in Shuls around the world each day!

Chazal tell us that it is easier to daven to prevent a calamity or a sickness than to daven for it to go away once it strikes R"L.

Our holy sages, the Chazal tell us
תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות

1) The utensil that is used for Netilas Yadayim must be intact, not cracked, chipped, broken or have a hole. (See Mishna Berura 159:7)

A pitcher that has a spout through which the water is usually poured out , if the spout is the same height as the rest of the pitcher, it may be used and poured onto the hands via the spout. If the spout is higher than the pitcher, the water should be poured onto the hands via the side of the pitcher and not via the spout.
( See Mishna Berura 159:24. See also Chazon Ish Orach Chaim Siman 21:7 and Shu"t Ohr L'Tzion 46:1 for a more stringent view)

2) The utensil must be able to stand on its own accord. Therefore if the base of the glass broke off it is no longer suitable for Netilas Yadayim.

However, if the utensil was initially manufactured as such that it cannot stand on its own, such as cone shaped cups, it is considered an acceptable utensil and may be used for Netilas Yadayim. (See She'arim Metzuyanim B'Halacha to Kitzur Shulchan Aruch Siman 40:3 )

How do you dispose of Stale Matza?

Answer:

Stale Matza, or any Matza[or bread] that can no longer be eaten, may be discarded. The best thing to do with any leftover bread (including Matza) is to feed them to the birds or ducks and the like, so as not to waste Hashem's bread.

However, if it is no longer edible, it may Halachically be disgarded.

1)It is permitted to move into a newly rented apartment during Sefira.
Although not halachically prohibited, there are those that refrain from moving into a newly built/bought home that they own, as this leads to extra Simcha.  However, those who are not stringent in this have on whom to rely.

2) If some significant items (such as furniture) are moved into the home prior to Sefira, then according to everyone there is no issue of moving into the home during Sefira, as the initial Simcha of the new home has passed. (
See Shu"t Yechaveh Da'as Vol. 3 Siman 30 and Sefer Hilchos Chag B'Chag, Pesach, page 58 in the name of Rav Yosef Shalom Elyashiv shlita and Rav Chaim Kanievsky shlita)

One who moves into a new home, may celebrate a "Chanukas Habayis" during Sefira. It is best to speak words of Torah at this celebration to render it a Seudas Mitzvah. Singing is also allowed, but no music. (Psak of Rav Ovadia Yoseph Shlita)

You wrote [regarding the proper procedure for Netilas Yadayim] that you first wash twice on the right hand, then fill up the water  again and then wash the left hand.

I only see people washing by first filling up the cup and then using that water for your hands (and not refilling in the middle). Is that okay?

Answer:

Yes, as long as there is enough water left in the cup for an acceptable washing (two times on the  hand) there is no need to refill the cup again for the left hand

1) Some people have the custom not to wear new clothing during Sefira. This custom, too, has no real source in Halacha, and most likely developed from a misapplied comparison to the prohibition of wearing new clothing during the 3 weeks. (See Shu"t Yabia Omer Vol. 3 Siman 26)

If one does indeed have this custom in his/her family for many generations, they should abide by it. However, if this isn’t the custom in your family, new clothing may be worn. (See Sefer Bain Pesach L’Shavuos Chapter 16 footnote 1 near the end what he quotes from the Yosef Ometz Siman 845 and 848 to explain why certain communities had this custom, and why it doesn’t apply to everyone)

2) Even those whose custom it is not to wear new clothing during Sefira may purchase new clothing in Sefira.

Additionally those who avoid wearing new clothing only avoid significant articles of clothing
(such as a suit or dress and the like) but not other articles (such as socks, undergarments, shirts etc.).

Also, dressing children in new clothing, is treated more leniently even by those who themselves avoid new clothing. (See Shu"t Vayevarech Dovid Siman 59. See also Leket Yosher page 98 regarding shoes)

Reader’s Question:

You wrote in a previous Q&A as follows: "regarding the utensils, if they havent been toveled, you may not eat off of them. You must either use paper dishes, or lift the food (if it’s kosher of course) off the plate and eat it from your hands."]

I was under the impression that with Tevilas Kelim, while the chiyuv remains in place obviously, this wouldn’t affect the food eaten off of them. I was under the impression that this was often the case with restaurants, etc. Is this not true?

Answer:

Rav Moshe Feinstein Zatzal (Igros Moshe Yoreh Deah Vol. s Siman 22) maintained that food that does not  need a utensil, and the utensil is only being used  to be civilized (such as a solid food) may be eaten off a non toveled plate in cases of necessity. However, foods that require the utensil (such as drinks, soup, pasta etc.)  may not be eaten off these utensils ever.

Rav Feinstein also maintains that there is no difference between a private home or a public restaurant, hotel etc. when it comes to these Halachos.

There are Poskim (See Darchei Teshuva Yoreh Deah Siman 120:70)  that differentiate and are more lenient in a restaurant etc., however most contemporary Poskim do not rely on that leniency. For Halacha L’maaseh please consult your Rav.

1) There is a discussion amongst the Poskim regarding if one may recite the Bracha of "SheHechiyanu V'Kiyimanu LaZman Hazeh" during Sefira, or is it like during the three weeks (when we mourn the Churban) when this Bracha is not said.

The Mishna Berura
(493:2) maintains that if one finds him/herself in a situation that calls for the recital of SheHechiyanu, they may indeed make the Bracha. (Some Poskim deduce from the Mishna Berura's language that he held that one should try not to find him/herself in such a situation, if possible. Other Poskim argue and maintain that it can be recited L'Chatchilah, as the mourning of Sefira is not as stringent as the mourning over the Bais HaMikdash that we do in the 3 weeks before Tisha B'Av.)

2) Although there is no real Halachic source in the Gemara, Shulchan Aruch or in the  early Poskim to prohibit the recital of SheHechiaynu, some people do in fact have the custom not to recite it based on kabalistic reasons.

One who indeed has this minhag should continue keeping to it. As with everything, a Rav should be consulted for Halacha l'Ma'aseh. (See Sefer Likutei Maharich for further sources about this.)

Reader's Question:

Is one permitted to take piano lessons during sefira, where they won't be learning songs, but just theory?  Can they press down keys, but not play songs?

Answer:

The Poskim debate whether one may learn how to play a musical instrument during Sefirah. Rav Moshe Feinstein Zatzal (Igros Moshe Orach Chaim  Vol. 3 Siman 87) seems to maintain that if one is doing this for Parnasa reasons it would be OK, but if one is doing this for pleasure and thus get Simcha out of it, it is prohibited.

Many contemporary Poskim
(She'arim Metzuyanim B'Halacha on Kitzur Shulchan Aruch 122:2. Rav Shmuel Felder  shlita in Kuntres Shiurei Halacha quoting Rav Elyashiv shlita, and others) are lenient in this matter especially if you will lose out by not taking those lessons now.

If just learning theory and making sounds, but not actually playing songs, it would probably be permitted according to everyone, as that is not music.

A Rav should be consulted for Halacha L'Maaseh..
