1) L'Chatchilah, care must be taken not to cook or fry meat dishes and dairy dishes at the same time on one stove top.

Furthermore, when cooking or frying a food of one class, it is proper to ensure that no pots or utensils of the other class are near the stove at all, even if they are empty of food, as if they are too close to the food that's cooking, they may get a splash of the hot food and jeopardize the kosher status of the empty pot or utensil.  

2) If one has no choice, and needs to use the stove for cooking meat on one range and dairy on another, at the same time, care must be taken to separate the two pots as far from one another as possible.

Especially when  the pots are being uncovered totally or partially, when a spice or ingredient is being added to one of the pots or when one of the foods is being mixed, care must be taken to do it slowly and gently to ensure nothing splashes over to the pot of the other food class. (See Rama Yoreh Deah Siman 92:8 and 118:11. See also Shach Siman 118:36)

If two pots of opposite food classes touched one another while cooking, as long as the outside of each pot was dry, both of them, and their contents, remain Kosher. (Rama ibid.)

Are we allowed to make ice cubes on shabbos?
 
    

Answer:

 

A few Poskim allow the making of ice cubes on Shabbos in all instances. Other Poskim only allow this in cases of necessity (such as when you're having guests). Some Poskim do not allow the making of ice cubes on Shabbos for any reason. (Either because of Nolad or because of Boneh)
 
The prevalent custom is to be stringent and not  make ice cubes unless in cases of necessity, but ideally it is best to always prepare them before Shabbos.
 
Keep in mind that even if making ice cubes from water  is allowed, it doesnt necessarily mean that making ices from liquids other than water is permitted. (See The Shabbos Kitchen by Rav Simcha Bunim Cohen Shlita, page 177 in the footnote what he quotes from Rav Moshe Feinstein Zatzal regarding this)

1) When using one stovetop for both food classes (which is OK, M'Ikar Hadin as we learned yesterday), the following guidelines must be followed:

 

·         The entire surface of the stovetop must be treated as anon kosher utensil and no food may be placed directly onto this surface.

 

·         If any food fell onto this surface while cooking or frying, it becomes prohibited to eat.

 

·         When cleaning any part of the stovetop it may not be done  together with or on top of any other kosher utensils, and separate cleaning gear are required to clean any part of the stovetop.

 

·         No utensils (e.g. a stirring spoon) that aren't totally dry on the bottom may be placed on a stovetop that is used for both food classes. (See Rama Yoreh Deah Siman 92:8 and Chochmas Adam 45:19. See also Shu"t Sh'eilas Ya'avetz Vol. 1 Siman 113)

 
 

2) It is a good idea to have a receptacle on the stovetop on which to rest any utensils being used in the cooking process, to avoid placing them directly on the stove.
 
 If a wet utensil was placed there by mistake, it may require Koshering and a Rav should be consulted. (See Shu"t Teshuvos V'Hanhagos Vol. 2 Siman 387)
 

Care must be taken at all times to keep this shared stovetop clean, especially after using it for frying food, where it is usual for splashing to happen all over the stovetop. (See Kaf HaChaim Yoreh Deah Siman 97:29. See also Taz Yoreh Deah 97:4)

Reader's Question:

 

What is the Halacha regarding writing Pesukim from Tanach on a picture or piece of calligraphy. Can one write the whole Passuk or only excerpts?
    

Answer:

 

It is quite common to see framed works of Tehilim, Shir Hashirim  as well as  Eishes Chayil  (which is from Mishlei)etc. and this art is found in the finest of Jewish homes, so it is obviously an acceptable practice.
 
If possible, it's actually probably better  to write the  entire Pasuk, rather than half a pasuk , as there is a prohibition to write half Pesukim (See Talmud Megila 22a), which may possibly apply to art as well.
 
Rav Moshe Feinstein Zatzal in Igros Moshe Yoreh Deah Vol.  2 Siman 134 and 135 does seem to have an issue with placing  Pesukim, Tefilos etc. on calendars, announcements etc. in a way that it will be discarded or otherwise not treated with respect, but I do not think it would apply to a piece of art that will be displayed and not treated disrespectfully.
 
If, however, the name of Hashem is being written, it may be more  problematic.
 
For Halacha L'Ma'aseh a Rav should be consulted.

1) It is proper, if possible, for Stovetops [both gas and electric ranges] that are used for cooking, frying and warming up food to be designated for one class of food, and to have a separate cooking element for the opposite class of food. (See Chochmas Adam 74:4 and Shu"t Ksav Sofer Yoreh Deah Siman 54 where he writes that G-d fearing individuals should be stringent with this)

Another option is to have separate grates to use when cooking the opposite food class on the same range.

If this is too difficult, it is best to at least designate one of the flames on the range for the opposite food class. (Shu"t Ksav Sofer ibid. See also Shu"t Teshuvos V'Hanhagos Vol. 2 Siman 387)

2) M'Ikar Hadin (according to the letter of the law) if one wants (or needs) to use the stovetop for both meat and dairy, it is permissible as long as certain guidelines are followed, which we will outline tomorrow B'Ezras Hashem. (See Mishna Berura Siman 451:34 for the reasoning. See also Igros Moshe Yoreh Deah Vol. 1 Siman 59 and Yoreh Deah Vol. 1 Siman 40 and Orach Chaim Vol. 1 Siman 124)

Is there any issue with breaking large bills with money in a [Tzedaka] Pushka? For example to take four  $5 bills from the Pushka and replacing them with a $20 bill?
    

Answer:

 

I once heard from a respected Rav that although it isn't assur to do so, it is not respectful to use the Tzedaka as your "change machine". So, unless you take back a little less than you give (such as taking $19 in singles, for a $20 bill, so the Tzedaka gets some) it should not be done.

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH

 

Halachos for Erev Shabbos Kodesh

1) It is proper for every kosher kitchen to have separate towels for use with meat, dairy or pareve.

 They should be easily identifiable as to avoid using them with the opposite food type.

[It is common to use blue towels for dairy and red for meat, but of course any colors or other identifiable features are sufficient as long as they are recognized by all who will use the towels.]

The reason for this is that towels are not only used to wipe clean dishes; they are commonly used in ways that come in contact with the actual food, such as  to wipe greasy hands and food spills as well as to assist in removing hot pots and pans  from the stove and the oven.

2) If a towel of one food type was inadvertently used for handling the opposite food type, it can be laundered and continued to be used without a problem. (See Darchei Teshuva Yoreh Deah 121:66, Rama Orach Chaim Siman 442:11 and Shulchan Aruch Siman 453:6)

 

Halachos for Shabbos Kodesh

1) It is  proper to have separate dish racks, where dishes are placed to dry after being washed, in order to avoid inadvertently using dishes for the opposite food type.

If clean dishes of the opposite classes were dried together in one dish rack, however, even if they touched one another, there is no concern at all with their kashrus and they may continue to be used.

 

2) Having separate drying racks is especially important for the cup shaped drying receptacles that are used to dry the silverware, as they are more likely to have food particles in them, due to their shape.

Thus,  in this type of drying rack, where there may be  food and water sitting at the bottom, if silverware of both classes were sitting in that water together for more than 24 hours, it may indeed  be a problem, and a Rav should be consulted if this happens (This is due to the concept of Kavush K'Mevushal, anything soaking for 24 hours may be Halachically considered as cooked. See Darchei Teshuva Yoreh Deah 121:1)

Reader's Question:

 

Can one cook something that will be put in chicken, and make it in a pot that is used to make fish?
    

Answer:

 

Although we don't eat or cook fish and meat together, if no actual fish was in the pot, it is permissible to  use what was cooked in that pot with meat.
 
This may even be done L'Chatchila, and as long as the pot is cleaned thoroughly it may be used for both meat and fish on the same day. (See Taz Yoreh Deah Siman 95:3. Most contemporary Poskim rule this way, especially as there are some Poskim including Magen Avraham (quoted in Mishna Berura Siman 173:3) who maintain that today's days there is no Sakana  anymore with eating fish and meat together)
 
That being said, there is indeed a minhag amongst many Jews to retain separate pots for fish and meat, but remember that  it is a Chumrah based on a minority ruling(see Tur Yoreh Deah Siman  116:2)

1) It is imperative to have separate cleaning equipment (e.g. soaps, sponges, brushes, rubber gloves etc.) for washing meat, dairy and parve dishes.

Even if the soap dispenser is closed or covered, it is still praiseworthy to have two separate units, as it is quite probable that the tip of the dispenser is touched by a sponge with grease on it and that grease can then be transferred to a utensil of the opposite classification.

If one class of dishes was mistakenly washed with a sponge of the other class, in most cases the dishes do not become non Kosher, as the water is usually not hot enough. However, the utensil should immediately be re-rinsed with cold water and with the proper cleaning apparatus.

If the dish in question is glass, there is room for even more leniency. As always, whenever in doubt, a Rav must be consulted.

When only one sink is present in the Kitchen, extra care must be taken after each time dishes are washed, to rinse off the faucets and the handles lest any residue remain on them which  may be transferred to dishes of the other class.

2) Many Poskim require the dish soap that is used to wash dishes to have a Kosher certification as not to transfer any non kosher ingredients in the soap (very common for there to be oils/fats from non kosher animals in there) onto the utensils being washed.

Other Poskim, however, are lenient and do not require a Hechsher on dish soap. (See Igros Moshe Yoreh Deah Vol. 2 Siman 30)

As I was growing up, I remember people (I dont remember if friends or adults) would say that you're not supposed to look at the moon. Is there any truth to this?
 
    

Answer:

 

Yes, there is a lot of truth to this!
 
The Sefer Chareidim, one of the holy Mekubalim in the times of the Bais Yosef and the Arizal, writes (Perek 45:5) "It is prohibited to gaze at a rainbow...It is likewise  prohibited to gaze at the moon. Rabbeinu Meir used to be extremely stringent with this...as it is quoted in Sefer Shoshan Sodos"
 
In the Sefer Taamei HaMinhagim (Kuntres Achron to Siman 464:22) he quotes the Sefer Shevet HaMussar that Al Pi Kabalah it is just as bad to gaze at the moon as it is to gaze at a rainbow.
 
In the  long Nusach of Vidui from Rabbeinu Avraham, father of the Shla HaKadosh, where he enumerates hundreds of possible sins that a person needs to do Teshuva for, he lists as one of the sins " Gazing at the  [new] moon"
 
The Mishna Berura Siman 426:13 brings this as well, and says that by Kidush Levana when we must look at the moon before commencing the Bracha, acording to some opinions the moon should be glanced at for a moment and that's all, and according to others it can be looked at for the duration of the Bracha, but it seems clear that any extra gazing at the moon is indeed something that should be avoided at best and may even be considered a sin!

1) If only one sink is present in a kitchen, no utensils should be placed directly on the sink surface.

Rather, separate inserts should be bought, each with a distinct color and/or another clear indentifying feature, one for meat and one for dairy, and they should be inserted into the sink for each respective use. (See Shu"t Igros Moshe Yoreh Deah Vol. 1 Siman 42:4 and Shu"t Minchas Yitzchok Vol. 2 Siman 100)

Additionally, it is best if this single sink is kept covered when not in use, in order to avoid anything from falling onto its uncovered surface, as for all practical purposes the uncovered sink surface is considered unkosher. (The various reasons why this sink is considered Unkosher are a) hot liquids from a Kli Rishon of both meat and dairy are spilled into this sink b) It is common for small particles of food - both meat and dairy- to be smeared or left sitting in the sink. c) Oftentimes, these particles can sit on the surface of a wet sink for more than 24 hours and soak, and this soaking, even in cold water, can have a status of being cooked (Kavush K'Mevushal) d) pots, pans or other cooking/baking utensils that may have been placed in the sink while hot may have had particles of hot food on them which will be absorbed into the sink's surface. See Shu"t Minchas Yitzchok ibid.)

2) If utensils fell into such a [wet] sink, if they were there for more than 24 hours they need to be koshered.

 

If they were there for less than 24 hours, they just need to be rinsed off well. (ibid.)

Why do they say that each Jew is represented by one letter in the Torah, and there are 600,000 Jews and 600,000 letters in the Torah, whereas all the Chumashim say the count of letters in the Torah is only 300,000?
 
    

Answer:

 

A:  Although there are only a little more than 300,000 letteres in the Torah, kaballistically there are more as certain letters are broken into 2 and many of the Tagim, crowns of the letters, are used as well.
 
Just as there are more Jews than 600,000 yet they are all somehow a part of only 600,000 souls, so too there are 300,000 letters that are somehow broken up into 600,000 parts to correspond kabalistically.(See Zohar HaChadash to Shir HaShirim 74:4, Megaleh Amukos 186 and Shu"t Chavos Yair Siman 235)

 Our holy sages, the Chazal tell us

1) A Kosher kitchen should ideally contain 2 sinks, one for meat and one for dairy.

If the two sinks can be on to opposite ends of the Kitchen, or as separated from one another as possible, it is praiseworthy.  (See Shulchan Aruch Yoreh Deah Siman 95:3, Shu"t Igros Moshe Yoreh Deah Vol. 1 Siman 42:4 and  Shu"t Minchas Yitzchok Vol. 2 Siman 100)

If the 2 sinks are adjacent to one another (as is common in many homes to have a "double sink") it is proper to have a [large enough and permanent] separation between them to prevent splashing of hot water from one sink to the other, which often will happen  when washing dishes.

2) Additionally, when the two sinks are adjacent it is best to at least have separate faucets, as often there is food residue on the hands which when moving the faucets will be transferred onto it and when using the same faucet with hot water for the opposite type of food it is possible for the food that is stuck to the faucet to then be transferred onto the dishes of the opposite kind. This is especially so when washing meat and dairy dishes consecutively (common in many households on Motzaei Shabbos)

Also, two sinks that share one drain can present some Halachic problems if the drain ever gets stuffed up and the hot water (with particles of meat and dairy in it) backs up into both sinks.

If this ever happens, any utensils that are in the sinks should immediately be removed and rinsed with cold water. The sinks should also be cleaned and not used for 24 hours. A Rav should be consulted for Halacha L'ma'aseh of course. (See Shu"t Igros Moshe and Shu"t Minchas Yitzchok ibid.)

Why can't a girl marry a boy with the same name as her father?
 
    

Answer:

 

A: This is based on the Tzava'ah (will) of Rav Yehuda HaChasid (Tzava'ah 23) and applies to men and women equally. Apparently the reason had to do with sakana, danger, and is definitely based on kabalistic sources. The Arizal was known to be extremely  cautious about this as were the Ba'al HaTanya and other great Torah giants. (See Shu"t Tzemach Tzedek Even HaEzer Siman 143)
 
Volumes upon volumes have been written to deal with this issue and to find some way to explain it, and determine if it is indeed something that we need to avoid today.  This is not the forum for an extensive presentation of both sides.
 
Many Poskim ruled that the Tzav'ah of Rav Yehuda HaChasid which contains many such directives (such as not cutting hair on Rosh Chodesh, not visiting the same grave twice in one day etc.) is only applicable to his decendants and not mandatory for all of Klal Yisroel. (See Shu"t Noda B'yehuda , Tinyana,  Even HaEzer Siman 79)
 
One thing seems clear from the majority of the Poskim, that if there is even a small difference in one of the names, then it is OK and not a problem at all (e.g. one is names Moshe and the other is named Moshe Tzvi, or one is Faiga and one is Faigel) (See Hanhagos of the Chazon Ishprinted in the back of Sefer Ta'ama D'Kra from Rav Chaim Kanievsky Shlita,  Os 31, that one who has 2 names it is considered one long name. He also writes there that parents should not name their child a name that is out of the ordinary that will cause the child embarrassment when he/she grows up)
 
Certain Poskim were extremely makpid on this while others were not. (Case in point: It is a well known fact that Rav Moshe Feinstein Zatzal, the Posek and Gadol  Hador, had two sons in law with the same name as him!)
 
If this is something that comes up, a Rav must be consulted to determine if it is a problem, and if it is, how to fix it (i.e. add a name, change the name etc.)

  תנא דבי אליהו כל השונה הלכות בכל יום מובטח לו שהוא בן עולם הבא, שנאמר הליכות עולם לו, אל תקרי הליכות אלא הלכות

1) One who buys or rents an  apartment whose kitchen was not kept Kosher, must not use the countertops  as they are, for food preparation  as we must  assume that non Kosher  was absorbed into the countertops and will thus be re-absorbed into any food that is now prepared on them.

The countertops must be covered before using them.

Alternately, if they are constructed of marble or stainless steel or other materials that can be Koshered (made Kosher), they can be koshered and then used regularly without a covering.

The method to Kosher such countertops is as follows, based on the Halachic concept of "K'Bolo Kach Polto- the way it became non Kosher (i.e. through hot food) is the  way it becomes Kosher (i.e. with hot water):

* Clean them thoroughly, including all the corners and joints, in order to remove any particles of food that may be in there.

*It is ideal for the countertop not to be used for 24 hours before beginning the Kashering process.

*Pour boiling water onto the countertop from a kettle of water [that is still plugged into the wall] to the point that the water is bubbling when it touches the countertop. The water should be dried and new boiling water poured onto the countertop in the same fashion, until every spot on the countertop has been touched with boiling water.

An alternate method to do this [especially if no water kettle is available with a long enough plug to be plugged in and reach every area of the countertop] is to pour boiling water over a heated stone or hot iron that is directly above the countertop and thus the water will boil and bubble and this will Kosher the countertop.

2) If the countertop was not used for 12 months, it possibly does not require Kashering at all. (See Darchei Teshuva Yoreh Deah Siman 122. See also Shu"t Igros Moshe Yoreh Deah Vol. 2 Siman 46 and Shu"t Shevet Haleivi Vol. 6 Siman 56)

If the countertop is made out of Formica or wood [especially if it has scratches in it ], a Rav must be consulted regarding which Koshering methods are acceptable, if any.

Do you make Shehechiyanu on becoming a  Bar Mitzva?
 
    

Answer:

 

A: There are various customs regarding Bar Mitzvah boys. Some have the custom to recite SheHechiyanu the first time they don Tefilin (which in many communities is a month before their actual Bar Mitzvah. See Rambam Hilchos Brachos  Perek 11:9  and Taz  Siman 22:1)
 
However, many Poskim maintain that no Shehechiyanu is recited on Tefilin (either because it's leather or for other reasons). The Biur Halacha Siman 22:1 suggests putting on a new garment right before putting on the tefillin for the first time, and recite SheHechiyanu on the garment and have in mind to exempt the Tefilin.
 
Becoming a Bar Mitzva in it of itself does not require a SheHechiyanu, as we do not recite  SheHechiyanu every time a Mitzva presents itself for the first time, unless it is a Mitzvah bound to a certain time (a cycled Mitzvah).

 NEW TOPIC: HILCHOS KASHRUS IN THE KITCHEN AND BEYOND
 

 

We will now B'Ezras Hashem begin learning some of the many intricate Halachos related to Kashrus (Keeping Kosher) in the Kitchen and beyond.

Keeping Kosher is of primary importance in living a Torah-True life and often a simple lack of knowledge leads to not keeping Kosher properly. Eating food that isn't 100% Kosher leads to souls being tainted Chas V'Shalom as it causes Timtum HaLev, stuffing up of the spiritual arteries and can lead to developing bad character traits as well as to being unable to absorb Torah knowledge and Mussar. (See Gemara Yoma 39a, Shulchan Aruch and Rama Yoreh Deah Siman 81:7, Aruch HaShulchan Yoreh Deah 81:34, Kaf HaChaim Siman 81: 64,   See also Rabbeinu Bachya  Parshas Mishpatim 23:19, Shu"t Chasam Sofer Orach Chaim Siman 23 and  Lev Eliyahu Parshas Shmos page 8 Ma'amar Metzius HaTeva HaRuchni B'Olam on  Perek 2 Posuk 7)

 Thus, I hope that a review of the Halachos ahead will strengthen us all in our observance of the laws of kashrus and  help keep our Neshamos clean and  make us better people and bring us all closer to our Father in heaven, which is the ultimate goal of each and every Jew.

1) Keeping a Kosher kitchen- and beyond-  requires more than just purchasing Kosher ingredients and not eating milk and meat together.

The preparation of the food must be done in such a way that the Kosher status of the food is not compromised.

Thus, every Kosher Kitchen should have two separate work areas (i.e. countertops), one for preparing dairy foods and one for preparing meat foods, as there are many ways in which foods can be absorbed into a countertop and render it meat/dairy and thus be re-absorbed into a food that is prepared on that countertop, and if it is a food of the opposite classification it will become problematic.

Ideally, these two areas should be at two opposite sides of the kitchen, or at a minimum at opposite sides of the sink(s). (See Pri Megadim, Aishel Avraham Orach Chaim beginning of Siman 173, Darchei Teshuva Yoreh Deah Siman 88:9-11, Kaf HaChaim Yoreh Deah 88:8)

If one is of means and is able to afford it, it would be best to have two additional areas, one for preparing Parve foods and one for preparing Pesach foods.

2 ) In a kitchen that  is very small and only has one work area, a noticeable and permanent  separation should be made  on that work area and each side should be designated for one kind of food.

If the area isn't large enough to divide into two areas, it must be dedicated for one kind of food preparation only (Meat or Dairy, whichever is most prepared in that kitchen), and when necessary to prepare the other kind of food (Dairy or meat), the area must be covered with an acceptable cover (preferably made from material that doesn't conduct heat, such as  plastic, P.V.C., Formica etc.)

It is preferable that this cover always be accessible in a designated spot (away from the countertop) and be available at a moment's notice whenever preparing the food so as not to mistakenly prepare one kind of food   directly on an  area designated for the other kind of food.

Last night I was asked to lead bentching at a sheva brachos.  I agreed.  Half way through the first bracha my wife says, "You didn't wash!" 
 
What should I have done at that point?  (I did eat about 5 oz of cooked barley and some other foods, but no bread.)  Did I invalidate anything or cause spiritual harm to the chosson and kallah, Chas V'Shalom?

I finished the first bracha and had the man sitting next to me say the ends of the succeeding brachos out loud and people answered Amen.  Almost nobody noticed. 

Did I still need an Al hamichya?

    

Answer:

 

B'dieved, the first Bracha of Birchas HaMazon suffices to exempt the barley. No spiritual harm was done to the Chasan and Kallah or to anyone else in the room!
 
In the future...if you remember while still in middle of the first Bracha, stop, and continue the nusach of Al HaMichya from "Al SheHinchalta L'Avoseinu" until the end. (See Mishna Berura  Siman 208: 75-79. and Kaf HaChaim 208:87)
 
If  the second Bracha (or further)  of Birchas HaMazon was started, stop immediately where you are, even in middle of a Bracha. (Psak of Rav Chaim Kanievsky Shlita quoted in Sefer Shgios Mi Yavin Perek 26:28)

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH

Halachos for Erev Shabbos Kodesh

1) The Bracha upon seeing a place where a miracle was performed is only recited when the actual site is seen (e.g. when the waters of the red sea are seen, as seeing the water conjures up the details of the miracle)

However, if only the general area of the site was seen, but the actual spot where the miracle occurred isn't seen, the Bracha is not recited.  (See Mishna Berura Siman 218:7)

If one isn't clear as to the exact location of the miracle, the Bracha should be recited in the general vicinity without Shem U'Malchus. (Kaf HaChaim 218:4)

However, even when only seeing the general area of the miracle, it is still praiseworthy to thank Hashem in your own words, without uttering the text of the Bracha.

 

2) When seeing a place where a miracle was performed for a well known personage, who is recognized by all or most of Klal Yisroel, the Bracha is recited as if it was a place where a miracle was performed for the entire Jewish nation.

Likewise, an individual who experienced a personal salvation, and through it a public Kiddush Hashem was facilitated, a Bracha is recited when seeing the site of their miracle. (See Shulchan Aruch Siman 218:7, Mishna Berura S"K 23 and 24 and Biur Halacha Dibur Hamaschil Al Nes and Dibur Hamaschil L'Fikach)

The text recited for the aforementioned Brachos is "Baruch Ata Hashem Elokeinu Melech HaOlam SheAsah Nes L'Tzadikim (or "L'Tzadik Ploni" or simply" L'Ploni") B'Makom HaZeh- Blessed Are You Hashem, Our G-d, Master of the world Who performed a miracle for the righteous (or "for this righteous person" or "for this individual") in this place" (Mishna Berura 218:25. See also Sha'ar HaTziyun S"K 21)

 

Halachos for Shabbos Kodesh

1) When someone R"L loses a parent [or another close relative], the following Bracha is recited: "Baruch Ata Hashem Elokeinu Melech HaOlam Dayan HaEmes- Blessed Are You Hashem, our G-d, Master of the world, the true judge".

This Bracha is also recited upon the passing of other people, even if they aren't relatives, if the news of their death causes distress. The prevalent custom, however,  in those instances is to recite the Bracha without Shem U'Malchus and simply say "Baruch Dayan HaEmes"

Upon hearing of the passing of a Talmid Chacham the Bracha should also be recited. Here too the prevalent Minhag has become to recite it without Shem U'malchus. (See Mishna Berura Siman 223:8 where he writes that this custom of saying it without Shem U'Malchus, especially when hearing of the passing of a Talmid Chacham, is not a right custom. See Halichos Shlomo Perek 23, Dvar Halacha 41 where he writes that although it isn't the custom, if one is intensely distressed at the passing of the individual he may indeed recite it with Shem U'Malchus)

2) If upon the death of one's father he is the lone person who receives an inheritance, the Bracha of "SheHechiyanu" is recited after the Bracha of 'Dayan HaEmes". (Even though, of course, he would rather his father still be alive and not get the inheritance, still the fact that he received new assets albeit via a sad method, the Bracha is recited. See Mishna Berura 223:9. See also Shu"t Shevet Haleivi Vol. 8 Siman 35:2. Some Poskim maintain that this SheHechiyanu is not recited at all. See Shu"t Teshuvos V'Hanhagos Vol. 2 Siman 140 where he gives reasons why many people do not recite this Bracha)

The same applies to one whose wife R"L dies and leaves behind her own money as an inheritance for him. (Mishna Berura 223:10)

If he is sharing the inheritance with other heirs, in place of SheHechiyanu, the Bracha of "HaTov V'hameitiv" is recited (as we have learned a while back that SheHechiyanu is for a personal Simcha and HaTov V'Hameitiv is for a shared Simcha. See Mishna Berura ibid.)

In regard to the question about hafrashas challah [ Q&A #405, you wrote that there needs to be a correct Shiur,in order for a Bracha to be recited], what is considered the correct shiur? 
  
 
 

Answer:

 

There are various Shiurim, based on different opinions as to what constitutes 43 and a 1/5th Beitzim (volume of eggs).
 
Some Shiurim require from a little more than 2 pounds, while other do not require until around 4 pounds.
 
According to the Chazon Ish's shiurim, the custom is to require 5 pounds of dough before  being mafrish challah with a bracha.
 
According to Rav Chaim No'eh's Shiurim it is 2.3 pounds for Hafrasha and  3.65 pounds for a Bracha.
 
It is best to try and have 5 pounds in order to be able to recite the Bracha according to all opinions. (See Shulchan Aruch Yoreh Deah Siman 324:1)

1) One who had a miracle happen to him/her, should give Tzedaka to the best of their ability, especially to support Torah study.

When giving this Tzedaka it is good to say the following: "I am giving this Tzedaka; May it be the will of Hashem that this Tzedaka be considered in the place of a Korban Todah (Sacrifice of thanksgiving) which I would have been obligated to bring in the times of the Bais HaMikdash"

It is also praiseworthy, as a way of expressing thanks for the miracle to recite the portion of the Korban Todah (VaYikra 7:12. See Shulchan Aruch HaRav Siman 1:9), and also   to do (i.e. donate) something in the city which will benefit the population of the city.

Also, each year on the anniversary of the day of the miracle it is especially important to thank Hashem for being saved, and be happy and spread the word to other people about the kindness of Hashem. (Mishna Berura Siman 218:32. See commentary of S'forno to VaYikra 7:11 where he writes that the reason that the Torah required so much bread to be brought when bringing a Korban Todah, is in order to make the one bringing the offering call his friends to help him finish it all, and thus word of the  miracle will be spread. )

2) Some people have the custom to make a Seduas Hoda'ah, a feast of thanks, each year on the anniversary of the miracle. (See Kaf HaChaim 218:60.See also Chayei Adam Klal 155:41 for a lengthy discussion)

This Seudah is considered a Seudas Mitzvah, as any feast made to commemorate the wondrous ways of Hashem is a Mitzvah (See Mishna Berura Siman 697:2. See also Shu"t Chavas Yair Siman 70 and Shu"t Chasam Sofer Yoreh Deah Siman 233)

May  a frum (orthodox) family attend a Jewish wedding that is officiated by a Conservative Rabbi? 
 
If not, can they attend a wedding where there is one Orthodox Rabbi and One Conservative Rabbi in attendance; the Orthodox Rabbi doing the Ketuba and the Conservative Rabbi doing the ceremony

Answer:

 

If a conservative rabbi is the  one officiating (mesader Kidushin), a frum person my not be at such a wedding.
 
If an orthodox rabbi is officiating, there is no prohibition to be there, but  it should be avoided unless absolutely necessary to be there.
 
If this wedding is taking place inside their temple (Bais HaKnesses) it could be more problematic, and the orthodox rabbi may not even be allowed to go and officiate.  A Rav must be consulted for Halacha L'Ma'aseh.
 
It doesnt matter who reads the kesuba. The main piece of information that  is the deciding factor is who is officiating. (Mesader Kidushin)

1)The Bracha on miracles (after the initial Birchas HaGomel) is only recited [with Shem U'Malchus]on those kinds of miracles that transpired in an unnatural way, or in cases where one was in clear danger of dying, and was saved, even in a natural way. (See Mishna Berura Siman 218:29)

However, on a miracle which transpired in [a seemingly] natural way (Such as having  robbers break into a home at night and surviving unscathed) the Bracha is recited without Shem U'malchus. (Shulchan Aruch Siman 218:9. See also Mishna Berura S"K 31 and 32.)

Some Poskim, however, maintain that anytime one was saved from real danger, even if it was via a natural method, the Bracha is recited. (See Shu"t Minchas Yitzchok Vol. 6 Siman 64. See also Chayei Adam Klal 65:4 and Nishmas Adam S"K 1. This is also the ruling of Rav Shmuel Wosner shlita in Shu"t Shevet Haleivi Vol. 7 Siman 28. See also Shu"t Avnei Yashfe Siman 46 where he quotes Rav Shmuel Wosner shlita as ruling that if a few people were in a serious car collision, and some of the people R"L were killed, the remaining passengers are considered to have been in immediate danger and saved, thus they must recite the Bracha each time they pass the site of the crash.)

For each specific situation a Rav must be consulted, as there are many specific variables that will contribute to a Rav's deciding which situations merit a Bracha.

 

2) The Bracha on seeing the site of a miracle is only recited if the danger  from which the person was saved, was specifically due to their  being at that place at that time (i.e. had they been in a different place they would either a) not have been in danger or b) not have been saved)

However, if one was cured from a sickness, no Bracha is recited when seeing the hospital (or any other place) where they happened to be when they became cured, as their miracle had nothing specific to do with that place. (Of course, Birchas HaGomel is recited as we learned. We are only discussing the Bracha on seeing the place of the miracle at a later date)

The same applies to a woman after giving birth to a child; no Bracha is recited when seeing the place where she gave birth to the child, as she could have given birth anywhere. (Shu"t Shevet Haleivi ibid.)

I was told that you're not allowed to cut up a salad very finely on Shabbos (like an Israeli salad).
 
What about slicing a tomato or other vegetable very thinly?
 
  
 
 

Answer:

 

Correct. Vegetables may not be diced into very small pieces on Shabbos. (unless it's for a small child or an older person who cannot eat bigger pieces, and even then only immediately before it  is served to the child. See Mishna Berur Siman 321:45 and Shu"t Igros Moshe Orach Chaim Vol. 4 Siman 74:2)
 
There is a minority opinion that maintains that even thinly slicing a vegetable (in one direction) poses a problem on Shabbos. (See K'tzos Hashulchan Siman 129 quoting the ruling of the Tzemach Tzedek)
 
However, the majority of contemporary Poskim, (based on the rulings of  Rav Moshe Feinstein Zatzal in  Igros Moshe Orach Chaim Vol 4 Siman 74, Tochen Os 3 and Rav Shlomo Zalmen Auerbach Zatzal in Shu"t Minchas Shlomo Siman 91:13), maintain that the prohibition wiill only be if the vegetable is being diced both in its length and its width, but if slicing only one direction, there is absolutely no prohibition to slice it as thin as you desire.

1) The Bracha on seeing the site of a miracle [that occurred to Klal Yisroel, an individual, or to one's father or Rebbi] is only recited once every thirty days. (Mishna Berura Siman 218:15)

An Avel (a mourner) does not recite the Bracha on miracles. (See Kaf HaChaim Siman 218:9)

 

2) If one sees a person to whom a miracle happened, according to some opinions, the following Bracha is recited: Baruch Ata Hashem Elokeinu Melech HaOlam SheAsah Nes L'Adam HaZeh (or "SheAsah Lecha Nes")- Blessed Are You Hashem, Our  G-d, Master of the world, Who performed a miracle for this person (or "Who performed a miracle for you")" (Rama Siman 218:6. See Mishna Berura Siman 218:22 and Sha'ar HaTziyun S"K 19 and 20)

Can you please explain were it says a person isn't suppose to whistle. 
  
 
 

Answer:

 

I know that there is a "legend" that says that whistling is prohibited due to its summoning of Sheidim (demons). However, there is no source for this in Halacha, and I have yet to find a reference to this even being a problem according to Kabbalah.
 
In fact, the Rama Siman 338:1 and Mishna Berura 338:3 clearly rule that whistling on Shabbos is permitted, even if one whistles a tune. This is true as well if the fingers are used to produce the whistling. (See Aruch HaShulchan 338:7)
 
If there would have been a problem with whistling, wouldnt the Poskim mention it, rather than simply ruling that it's permitted?
 
Of course, it isn't a refined, Jewish thing to crudely whistle in public. But, pleasant whistling to enhance a niggun, seems to be OK and can even be used  to enhance Avodas Hashem.
 
If you come across any sources that forbid it, please be so kind as to let me know, as I have been researching this for a while.

1) An individual who experienced a personal miracle, recites the following  Bracha upon seeing the site of the miracle: "Baruch Ata Hashem Elokeinu Melech HaOlam SheAsah Li Nes B'Makom HaZeh- Blessed Are You Hashem, Our  G-d, Master of the world, Who performed a miracle for me in this place" (Shulchan Aruch Siman 218:4)

2) Likewise, a son/daughter [and a grandson/granddaughter] and a student (Talmid Muvhak only) of the one who had the miracle performed for them recite a Bracha upon seeing the site of the miracle. (See Mishna Berura Siman 218:16 and Sha'ar HaTziyun S"K 7 regarding when great grandchildren would recite this Bracha. See also Aruch HaShulchan 218:7 who rules that great grandchildren never recite this Bracha. See also Halichos Shlomo Perek 23:9 for more guidelines regarding children and grandchildren. Regarding a Rebbi/Talmid Muvhak see Mishna Berura 218:20)

The text they say is "...SheAsah Nes L'Avi [or L'Imi or L'Zikni'/L'Z'keinasi or L'Rabi] B'Makom HaZeh- ...Who performed a miracle for my father [or my mother or  my grandfather/mother or my Rebbi]  in this place" (See Biur Halacha  Siman 218 Dibur Hamaschil V'Chol Yotzei Yereicho )

When eating say grapes from Israel and grapes from the US, what bracha acharona does one make. Does [the ending, Al Ha'Aretz V'Al] "PeroteHa" (fruits of the land of Israel) cover the non-Israeli fruit?
  
 
 

Answer:

 

According to many Poskim,the ending for Israeli produce exempts all the grapes.(See Orchos Rabbeinu page 88 and Shu"t Dvar Yehoshua Vol. 2 Siman 29 and Vol. 4 Siman 9)
 
Some Poskim maintain that if a kzayis was eaten of both varieties, the ending should be "Al Ha'Aretz V'Al PeiroSeHa V'Al Hapeiros" (See Ketzos HaShulchan Siman 60:5)
 
Some Poskim maintain that just "Al Ha'Aretz V'Al Hapeiros" should be recited on both. (Shu"t Shevet HaKehasi Vol. 4 Siman 64)
 
For Halacha L'Ma'aseh a Rav should be consulted.
 Our holy sages, the Chazal tell us

There is no need to specify the nature of the miracle, simply saying "Who performed miracles for our ancestors in this place" suffices. (Biur Halacha Siman 218 Dibur Hamaschil Mevarech)

However, since the exact location of these sites  isn't known for sure today, even when one sees the spot that is purported to be the location, the Bracha is recited without Shem U'Malchus. (See Kaf HaChaim 218:4. See also Mishna Berura 218:1-7 for a listing of some of these locations.)

2) A Ger (a convert to Judaism) may recite this Bracha and include the words "L'Avoseinu- for our ancestors" (See Sifsei Chachamim to Brachos 54a Dibur Hamaschil HaRoeh Makom)

This Bracha is only recited if the miracle was performed for all or most of the Jewish nation, and not for a miracle performed for any group of Jews. (Mishna Berura 218:10. Of course, the ones who experienced the miracle themselves recite their own Bracha, as we shall discuss in the near future)

Can a person who buys a dog or cat have them spayed or neutured as I have just recently learned that not doing this if you are not going to breed the dogs can cause them harm and they can even contract several different kinds of Cancer?
  
 
 

Answer:

 

Your question is one that has been the subject of much debate in recent years amongst the Poskim.
 
On the one hand, the Torah forbids causing harm to animals, and there is no question that this process does exactly that.
 
On the other hand, recent research has shown, as you indicated, that not spaying/neutering pets that will not breed, may indeed cause them  to be at risk of contracting diseases, and thus the Tzar Ba'alei Chaim aspect would go away as it is being done for their benefit.
 
Another option, which many Rabbis have suggested is the best option, is to have the pet undergo hormonal neutering, which is a less intrusive and virtually painless procedure, with the same desired effects. (From what I understand, it's a cheaper process as well)
 
Of course, a competent Orthodox Rabbi must be consulted for Halacha L'ma'aseh, before doing anything.

SPECIAL DOUBLE PORTION L'KAVOD SHABBOS KODESH

 
 

Halachos for Erev Shabbos Kodesh

1) A woman, after giving birth to a child, is considered like an ill person that recovered from an illness, and as such would seemingly to need to recite Birchas HaGomel.

However, there are various different customs regarding women and Birchas HaGomel, as we will now discuss.

Some Poskim rule that any time a woman is in a situation where she was saved from a danger, she should recite Birchas HaGomel, no different than a man.(Siddur Ya'avetz, Kitzur Shulchan Aruch Siman 65:2 and Ben Ish Chai Parsha Eikev Siman 65. See Halichos Shlomo Perek 23:4 that only after childbirth is Birchas HaGomel recited by women and not for other dangers that  they survive.)

Some have the custom for the woman to come to Shul and recite the Bracha in the Ezras Nashim (women's section of the Shul) at a time when ten men are present in the Shul. (See Shu"t Yechaveh Da'as Vol. 4 Siman 14 and 15 and Shu"t Yabia Omer Vol. 8 Siman 23:15)

Some have the custom that a minyan is assembled in the woman's home to daven a Tefilah and she recites the Bracha afterwards. ( See Shu"t Har Tzvi Siman 118, Ketzos HaShulchan Siman 65:6, Shu"t Tzitz Eliezer Vol. 19 Siman 53 and Shu"t Minchas Shlomo Vol. 2 Siman 4:31)

Others have the custom that the woman's husband should recite the Birchas HaGomel and she should answer Amen, and thus exempt herself with his Bracha. (See Mishna Berura Siman 219:17 that a man and his wife are considered one body and thus one may recite the Bracha of thanks on the others' behalf. However, if doing so in her presence the text of the Bracha must be changed to "HaGomel L'Chayavim Tovos SheGmalach Kol Tov" or if she is not present, he should say "HaGomel L'Chayavim Tovos SheGamal L'Ishti Kol Tov". The Aruch HaShulchan 219:9 frowns upon this custom)

Others have the custom that women do not recite Birchas HaGomel at all. (See Mishna Berura Siman 219:3 that this was the custom in his time, the reason being that Gomel needs to be recited in front of 10 men, and it isn't appropriate for a woman to do so. This is also the ruling of Shu"t Halachos Ketanos Vol. 2 Siman 161 and the Aruch HaShulchan 219:6. See also Shu"t Be'er Moshe Vol. 4 Siman 22 regarding alternative ways for a woman to express her thanks to Hashem without reciting Birchas HaGomel. See also Shu"t Teshuvos V'Hanhagos Vol. 4 Siman 53. See also Halichos Shlomo Perek 23:4)

 

Halachos for Shabbos Kodesh

 

1) Another custom is for the woman to recite the Bracha in the presence of nine women and one man. (Mishna Berura ibid, quoting opinion of Elya Rabbah, Chayei Adam and Knesses Hagedola. Rav Moshe Feinstein Zatzal, in the very last Teshuva that he wrote in his life (Printed in Orach Chaim Vol. 5 Siman 14) argues and maintains that there is no advantage to a "minyan" of women, and the Gomel is best recited in front of one person, a man or a woman, and if she is married it is best recited in front of her husband)

However, if the Bracha is being recited with less than ten men present, it is best recited without Shem U'Malchus. (Kaf HaChaim 219:3)

Some have the custom for the woman to recite Birchas HaGomel in front of ten male relatives only (Kaf HaChaim ibid.)

Each of the aforementioned customs has basis in Halacha, and each woman should conduct herself as per the custom of her community.

 

2) If a woman has the custom to recite Birchas HaGomel after giving birth to a child, she must wait [at least] seven days after the birth of the child to be considered completely healed. (Kaf HaChaim 219:7. See also Shu"t Be'er Moshe Vol. 8 Siman 120)

If I just ate a food, and then decided to wash, do I make a borei nefashos or al hamichya, and then wash, or do I not have to?
  
 
 

Answer:

 

Generally, a Bracha Achrona must first be recited on what you ate before washing and eating your Seudah. (It is best to try and not get yourself into this situation in the first place, due to Bracha Sh'Aina Tzerichah)
 
However, there are some instances when  no Bracha Achrona needs to made, and the Birchas HaMazon will exempt the food you ate before washing. They are:
 
1) The food was eaten in order to build up an appetite for the forthcoming meal.
 
2) The food was eaten in order to exempt a questionable item that will be eaten during the meal (e.g. reciting a Ha'Adama on something before washing, in order to eat  the canteloupe after washing, which is a subject of debate if a Bracha is needed on this fruit during the meal)
 
3) The food that was eaten before washing, will also be present and eaten during the meal.
 
4) The food that was eaten was a pastry (or other Pas HaBa B'Kisnin) which is questionable if it's considered bread
 
5) The food was eaten at Kiddush right before the Shabos meal.
 
If a food was eaten before the meal and it requires a Bracha Achrona, it must be recited, even if you remembered about it during the meal!
 
B'Dieved, if one already recited Birchas Hamazon, it covers the food that was eaten before washing, and no new Bracha Achrona should now be recited. Ideally, if this happens, it is good to specifically have in mind that the Birchas Hamazon should cover  that food as well.(See Mishna Berura Siman 176:2 for more details)

1) Ideally, the Bracha of Gomel should be recited within three days of being saved from the danger, even if by doing it within three days it will have to be said not in front of a Sefer Torah as is the custom. (See Mishna Berura Siman 219:20)

 

B'dieved, even up to five days is considered right away. (See Be'er Heitev 219:9)

However, if the Bracha was not recited within three [or five] days, it may still be recited for a while longer, as long as a very long time has not elapsed. (See Mishna Berura 219:8. See Shu"t Yabia Omer Vol. 3 Siman 16 and Shu"t Yechaveh Da'as Vol. 3 Siman 14. See also Shu"t Teshuvos V'Hanhagos Vol. 1Siman 197)

If indeed a long time has passed, to the point that  many of the details of the ordeal , or even the ordeal itself, is already being forgotten (5 days according to some Poskim, 30 days according to others and 12 months, according to all Poskim), the Bracha is no longer recited [with Shem U'malchus]. (See Aruch HaShulchan Siman 219:7 and Shu"t Shevet HaKehasi Vol. 1 Siman 100:1)

 

2) A minor does not recite Birchas HaGomel. (Mishna Berura Siman 219:3)

There are various opinions regarding women and Birchas HaGomel, and we shall B'Ezras Hashem discuss them in the near future in more detail.

According to those who hold like R' Yehuda Hachasid regarding no haircuts etc. on Rosh Chodesh [See Tzavo'as Rav Yehuda HaChasid #48], is there any difference when Rosh Chodesh is two days ? Is there a greater leniency on either of the two days?

  
 
 

Answer:

 

From the words of the Mogen Avraham Siman 260:1 it doesnt seem there is a difference between the 2 days of Rosh Chodesh regarding  this. So those that abide by the Tzav'ah of Rav Yehuda HaChasid should indeed not shave or cut their hair on both days of Rosh Chodesh.

1) The Bracha of Gomel must be recited in the presence of ten adult Jewish males. (Shulchan Aruch Siman 219:3)

 

The one reciting the Bracha may be counted amongst the ten. (Mishna Berura 219:6. See also Sha'ar HaTzion S"K 7 and Kaf HaChaim 219:19 for opinions that hold that ten additional men besides the one reciting the Bracha are required)

If it was recited with less than ten men present, it should be repeated again in front of ten men, but this time without Shem U'malchus. (Shulchan Aruch ibid. See also Ben Ish Chai Parshas Eikev Siman 62 and Shu"t Teshuvos V'Hanhagos Vol. 2 Siman 143)

If no ten men are present, the reciting of the Bracha should be postponed until 10 men can be gathered.

However,  if by postponing the Bracha it will cause 30 days to pass from when the  time the Bracha was obligated to be recited, it should be recited immediately even without ten people. (See Mishna Berura Siman 219:8)

2) Ideally at least two of the ten men present should be Talmidei Chachamim (Learned Torah scholars) who study Halacha. However, if such scholars are not readily available, the Bracha should be recited in front of any ten males. (Shulchan Aruch 219:3 and Be'er Heitev S"K 5. See also Biur Halacha Dibur Hamaschil Lo Sh'chichi Rabanan)

The prevalent custom is to recite Birchas HaGomel in Shul at Krias HaTorah. (Shulchan Aruch ibid. See Aishel Avraham (Butchatch) Siman 219 that the Bracha should be recited after the ending Bracha of the last person's Aliya)

Someone warmed up meat in a milchig microwave can I Kasher it ?
 
What about the trays?
  
 
 

Answer:

 

Yes,  a microwave can be Kashered, as follows:
 
It should be totally cleaned. A cup or bowl of water should be placed inside and the microwave turned on for approximately 10 minutes.  The bowl with water should then be placed in a different place in the microwave, and the microwave should be turned on for an additional 5-10 minutes.
 
If the microwave is being Kashered from a non Kosher usage (as opposed to just from milk and meat) 24 hours should be waited before doing the above procedure.
 
If there is a glass plate in the microwave, a Rav should be consulted regarding if it is able to be Kasherd, and if so, how. (See Piskei Teshuva Orach Chaim Siman 451 for more on this toipic)
 
In general, it's important to remember that anytime something dairy  is warmed up/cooked in a fleishig microwave (or vice versa), it should be covered well with a double wrapping.
 
If a Chometz microwave is being Kashered for Pesach, the food warmed up in it should be double wrapped, even after Kashering.
 
If there are any plastic components on the inside surface of the microwave, a Rav should be consulted to determine if it is possible to Kasher.
 
If the microwave has a browning element or is a convection oven, it needs to be cleaned, and then  turned on to its highest setting for 45 minutes, in order to reach its highest heat and thus  render the oven Kashered. There are certain models that do not reach the required temparature to effect a proper Kashering, so it's important to check with a Rav regarding your particular model.

1) One who flew on an airplane and landed safely must recite Birchas HaGomel, and according to many Poskim this applies to all flights regardless if they were domestic or overseas and regardless of the amount of time spent in the air. (See Shu"t Igros Moshe Orach Chaim Vol. 2 Siman 59 where Rav Moshe Feinstein Zatzal writes very strongly: "I heard that some Poskim rule that only for flights over water is the Gomel required, and there is no basis for this ruling, and of course the Bracha needs to be recited for all flights". See also Halichos Shlomo Perek 23:5.)

 

Some Poskim differentiate between flying between countries (where the Bracha needs to be recited even if not flying over water) and between two cities in one country (where no Bracha is recited). (See Shu"t Tzitz Eliezer Vol. 11 Siman 14)

 

Some Poskim including Rav Ovadia Yosef Shlita (in Shu"t Yechaveh Da'as Vol. 2 Siman 26) rule that only flights whose duration is more than 72 minutes require Birchas HaGomel.

 

Many Poskim, however,  have a hard time understanding this difference between short flights and long flights, as any amount of time spent in a speeding airplane hundreds of feet above the ground is a situation of extreme danger, as many plane crashes have happened almost  immediately upon takeoff. (See Shu"t L'Horos Nosson Vol. 11 Siman 14. See also Shu"t Teshuvos V'Hanhagos Vol. 1 Siman 193, Vol. 2 Siman 148 and Vol. 3 Siman 81 where he discusses  various different customs regarding this.)

Some Poskim say that today's days when air travel is much safer than it used to be, no Gomel is recited, or at minimum it is recited without Shem U'Malchus. (See Shu"t Chelkas Yaakov Siman 55, Shu"t Kinyan Torah Vol. 1 Siman 16 quoting the Brisker Rav Zatzal and Shu"t B'Tzel HaChachma Vol. 1 Siman 20)

For Halacha L'ma'aseh, as always, a Rav must be consulted to determine if and when to recite the Bracha of Gomel after flying.

I learned today in halachos of Aninus and Aveilus that a Kohen may only become tamei for one of his 7 deceased direct relatives if the body is whole and intact. 

 

Does this restriction apply to a relative who had during his life an surgery that resulted in removing an organ like appendix, a tooth, or a sinew removed, or say some cosmetic surgery was performed?

  
 
 

Answer:

 

You are correct, that a Kohen may only handle the body of one of his 7 relatives (His father, mother,son, daughter, wife, paternal brother, and paternal sister who was never married) when the body is whole. According to one opinion in the Shulchan Aruch, organs that were missing while the person was alive, are not a problem, and the body is still considered whole.(See Shulcan Aruch  Yoreh Deah Siman 373:9).
 
According to Rav Moshe Feinstein Zatzal (Igros Moshe Yoreh Deah Vol. 1 Siman 251) only missing organs that are evident on the outside of the body would proclude a Kohen from  touching the body of the relative, but internal blemishes (such as the examples you gave) are not a problem.
 
Of course, for Halacha L'Ma'aseh a Rav should be consulted.

1) One who travels through an uninhabited desert and makes it out safely, recites Birchas HaGomel (Shulchan Aruch Siman 219:1)

 
 

One who travels through a desert on a train where he is protected from the dangerous elements of the desert (e.g. snakes, scorpions, bandits etc.) does not recite Birchas HaGomel. (See Ketzos HaShulchan Siman 65:2)

 

2) However, if traveling by car, even in a caravan with others, where the danger of bandits still exists, Birchas HaGomel is indeed recited. (Sefer Birchas HaBayis Siman 327:4. He writes that this would apply to traveling by train as well if the danger of bandits still exists)

Reader's Question:

 

Shabbos comes in at a set time.

 

We greet shabbos kodesh with shabbos candles and tefillos.

 

My question is regarding Motzei shabbos. As much as we love shabbos and don't want her to leave, shabbos goes out at a certain time (based on each's minhag i.e. 45, 60 or 72 minutes past Shkiyah) .

 

What is the reason behind saying "Hamavdil bein kodesh l'chol" (when doing activity before havdalah)?

 
Is it necessary?
 
Or is it a way that we escort the shabbos queen away, along with havdalah?
 
If I do malacha once shabbos is completely over, without saying "hamavdil bein kodesh l'chol" and without hearing havdalah is this wrong-Shabbos is only here for 25 hours, after that isn't shabbos kodesh over?
 
 Also, a few of my friends and I were once debating what exactly should be recited? "Hamavdil Bein Kodesh L'chol" "Boruch Hamavdil bein kodesh lchol", or "Boruch Ata HaShem Elokeinu Melech Haolam Hamavdil Bein Kodesh L'chol"?
 
 
 
 

Answer:

 

There is a concept known as "Tosfos Shabbos" , adding on to Shabbos, both at the onset and at its conclusion. (See Biur Halacha Siman 261:2, that this is a biblical obligation)

 

There is no set amount that needs to be added, but at least a short amount needs to be added, and it is up to each individual how long to add. For example, a woman that lights candles 18 minutes before sunset on Friday night (or men who daven maariv early on Shabbos in the summer months)  accept Shabbos upon themselves early, and  may not do any Melachos after that time, even though it is technicalyy not Shabbos yet according to the clock!

 

The same applies to Motzei Shabbos, where each person should extend Shabbos for as long as possible. For example if one is still in middle of Seudah Shlishis well past sunset, it is still Shabbos and Retzei is still recited in Birchas HaMazon, even if the clock shows that Shabbos is over a long time already!

 

Thus, the only real way to know that Shabbos is over and that your "Tosfos Shabbos" is no longer being observed, is by reciting Havdalah, or at a minimum saying "Baruch HaMavdil Bein Kodesh L'Chol". Doing Melacha before saying these words, even if the clock says its Motzei Shabbos,  is very problematic, and should be avoided.

 

The accepted text to say is "Baruch HaMavdil Bain Kodesh L'Chol"

 

Even after saying this short text, no real Melacha should be done until after a proper Havdalah has been said/heard.

 Our holy sages, the Chazal tell us
