BASIS OF THE CASE:
Elections Canada set the date for the federal election on Mon. Oct. 21, 2019.
This date coincides with Shemini Atzeret.
THE ISSUES:
The Orthodox Jewish voter
75,000 Orthodox voters are forced to vote earlier than the rest of the country.
Advance Polls are also scheduled in part on Shabbos and Yom Tov. You have a
right to see the campaign through until the end before marking your ballot.
The Orthodox Jewish candidate
There exists an uneven playing ield for the Orthodox candidate in EgLaw where
her campaign will have to be shuttered in the run-up to and on EDay.
The Remedy within the Law
Canadian Election Law states that if a ixed election date falls on "a day of
cultural or religious signiicance" the CEO can recommend the date be moved to
the following day or the following Monday.
Stephane Perrault was well aware of the issues many months ago but chose not to
use the remedy provided to him within the law.
